Be it enacted by the General Assembly of the State of Colorado:1 SECTION 1. In Colorado Revised Statutes, 22-2-407, add (3.5)2 as follows:3 22-2-407. (3.5) A N APPROVED FACILITY SCHOOL OR FACILITY MAY5 ACT AS A SCHOOL FOOD AUTHORITY PURSUANT TO THE PROVISIONS OF THE6 FEDERAL "RICHARD B. RUSSELL NATIONAL SCHOOL LUNCH ACT", 427 U.S.C. SEC. 1751 ET SEQ., OR THE FEDERAL "CHILD NUTRITION ACT OF8 1966", 42 U.S.C. SEC. 1771 ET SEQ.9 SECTION 2. In Colorado Revised Statutes, 22-32-120, add10 (8)(a.2) and (8)(a.4) as follows:11 22-32-120. Food services - facilities - school food authorities -12 rules. (8) As used in this section, "school food authority" means:13 (a.2) T HE COLORADO SCHOOL FOR THE DEAF AND THE BLIND14 AUTHORIZED PURSUANT TO SECTION 22-80-102;15 (a.4) A N APPROVED FACILITY SCHOOL OR FACILITY, AS DEFINED IN16 SECTION 22-2-402;17 SECTION 3. In Colorado Revised Statutes, 22-54-123, add18 (2)(a.2) and (2)(a.4) as follows:19 22-54-123. Richard B. Russell national school lunch act -20 appropriation of state matching funds - definition. (2) As used in this21 section, unless the context otherwise requires, "school food authority"22 means:23 (a.2) T HE COLORADO SCHOOL FOR THE DEAF AND THE BLIND24 AUTHORIZED PURSUANT TO SECTION 22-80-102;25 1206-2- (a.4) AN APPROVED FACILITY SCHOOL OR FACILITY, AS DEFINED IN1 SECTION 22-2-402;2 SECTION 4. In Colorado Revised Statutes, 22-54-123.5, add3 (2)(b)(I.2) and (2)(b)(I.4) as follows:4 22-54-123.5. School breakfast program - appropriation -5 low-performing schools - definition. (2) As used in this section:6 (b) "School food authority" means:7 (I.2) T HE COLORADO SCHOOL FOR THE DEAF AND THE BLIND8 AUTHORIZED PURSUANT TO SECTION 22-80-102;9 (I.4) A N APPROVED FACILITY SCHOOL OR FACILITY, AS DEFINED IN10 SECTION 22-2-402;11 SECTION 5. In Colorado Revised Statutes, 22-80-102, add12 (3)(c) as follows:13 22-80-102. Educational institution. (3) (c) N OTWITHSTANDING14 SUBSECTION (3)(b) OF THIS SECTION, THE SCHOOL IS A RESIDENTIAL CHILD15 CARE FACILITY PURSUANT TO SECTION 26-6-905 AND MAY ACT AS A16 SCHOOL FOOD AUTHORITY FOR THE PURPOSES OF THE FEDERAL "RICHARD17 B. RUSSELL NATIONAL SCHOOL LUNCH ACT", 42 U.S.C. SEC. 1751 ET18 SEQ., OR THE FEDERAL "CHILD NUTRITION ACT OF 1966", 42 U.S.C. SEC.19 1771 ET SEQ.20 SECTION 6. Appropriation. For the 2023-24 state fiscal year,21 $17,752 is appropriated to the department of education. This22 appropriation is from the healthy school meals for all program general23 fund exempt account. To implement this act, the department may use this24 appropriation for school meal reimbursements.25 SECTION 7. Safety clause. The general assembly finds,26 determines, and declares that this act is necessary for the immediate27 1206 -3- preservation of the public peace, health, or safety or for appropriations for1 the support and maintenance of the departments of the state and state2 institutions.3 1206 -4-
