The requirements established in the bill concern: ! Ventilation verification assessments, which include assessments of an HVAC system's filtration, ventilation exhaust, economizers, demand control ventilation, air distribution and building pressurization, general maintenance requirements, operational controls, and carbon dioxide output; ! The preparation of HVAC assessment reports; ! The review of HVAC assessment reports by mechanical engineers, who make recommendations regarding necessary repairs and improvements and estimate associated costs; ! HVAC adjustments, repairs, upgrades, and replacements; ! The preparation of HVAC verification reports and the submission of the reports to the state board of education; and ! Periodic inspections and ongoing maintenance. The bill establishes mandatory criteria that an HVAC contractor must satisfy in order to perform work described in the bill. A school administrative entity that undertakes HVAC infrastructure improvements using money made available by a federal government source or by a federal government source in combination with a state government source must do so using only contractors on the certified contractor list established by the department of labor and employment. The bill allows a school administrative entity to apply for grants to pay for HVAC infrastructure improvement projects and establishes requirements for school administrative entities that apply for grants from federal and state government sources. The bill allows the governor's office to expend money from the "Infrastructure Investment and Jobs Act" cash fund to provide grant writing support and project planning support to school administrative entities that are undertaking HVAC infrastructure improvement projects. Be it enacted by the General Assembly of the State of Colorado:1 SECTION 1. Legislative declaration. (1) The general assembly2 finds that:3 (a) Students and staff in Colorado's public schools deserve access4 to clean, healthy air along with proper heating and cooling to improve5 1307-2- their opportunities to learn;1 (b) Indoor air quality is one of several toxic threats to students in2 schools;3 (c) The condition of inadequate school facilities can expose4 students and staff to mold and legacy toxins such as lead, asbestos, and5 industrial products and chemicals known as PCBs; poor air quality and6 temperature control; inadequate lighting; and excessive noise; and7 (d) Improving the air quality in schools can result in higher8 attendance, better cognitive function, less asthma and other respiratory9 health problems, and improved academic performance.10 (2) The general assembly further finds that:11 (a) In Colorado, many of the conditions that cause unhealthy12 indoor air and environmental quality impact Colorado school buildings;13 (b) Various Colorado schools have been featured in news stories14 profiling funding shortages, heating and cooling issues, and the need for15 facility improvements;16 (c) The department of education's own Facility Insight Dashboard17 reports the average age of school infrastructure to be forty years; and18 (d) State school buildings receive a poor score on the department19 of education's Facility Condition Index.20 (3) The general assembly further finds that:21 (a) Despite efforts by state agencies and school districts to22 improve indoor environmental quality in classrooms and other school23 buildings, many of Colorado's school districts lack the funding and staff24 to improve facility conditions and thereby improve school health25 outcomes;26 (b) According to the American Society of Civil Engineers' 202027 1307 -3- infrastructure report card, Colorado schools have an approximately $141 billion funding gap between the need for infrastructure replacements,2 repairs, or upgrades and money available from regular funding and budget3 processes;4 (c) The current funding sources for schools do not equitability5 distribute funds, leaving many schools in rural and disproportionately6 impacted communities unable to pay for necessary retrofits and updates;7 (d) The passage of the federal "Inflation Reduction Act of 2022"8 and "Bipartisan Infrastructure Law", which was enacted in the federal9 "Infrastructure Investment and Jobs Act", have made billions of dollars10 in federal money available to combine with current and planned state or11 local funding that can help public schools improve air quality, improve12 student performance and staff retention, and realize significant energy13 savings for school districts;14 (e) Accessing this federal money would not only improve air15 quality in schools but also bring billions of dollars in economic16 investments in quality projects to Colorado communities and workers;17 and18 (f) Unfortunately, many of the schools with the most pressing19 infrastructure improvement needs lack the staff capacity to track, apply20 for, and manage grant funding available at the state and federal level.21 (4) Therefore, the general assembly declares that, in order to help22 schools address health concerns and energy efficiency needs, this act:23 (a) Makes local education providers, including the Colorado24 school for the deaf and the blind, eligible to receive grants from the25 "Infrastructure Investment and Jobs Act" cash fund created in Senate Bill26 22-215, which was enacted in 2022;27 1307 -4- (b) Authorizes the governor's office to coordinate with outside1 entities to provide local education providers, including the Colorado2 school for the deaf and the blind, with project planning, grant writing, and3 other technical assistance, such as school ventilation and energy4 efficiency verification, as needed;5 (c) Ensures that school districts' federal funding applications6 remain competitive by requiring the use of certified contractors or the7 negotiation of a project labor agreement to complete HVAC infrastructure8 improvement projects receiving federal funding and requiring compliance9 with the labor standards outlined in federal funding opportunities; 10 (d) Will save schools money by ensuring that facility improvement11 projects are completed by a highly skilled workforce and result in12 measurable energy efficiency improvements and health improvements for13 students and staff; and14 (e) Allows Colorado's school districts to choose to undergo an15 HVAC assessment and find a pathway to fund any improvements16 identified without mandating that any school must undergo an assessment17 or HVAC improvements.18 SECTION 2. In Colorado Revised Statutes, add 22-32-152 as19 follows:20 22-32-152. School ventilation and energy efficiency21 verification and repair - definitions - applicability of section -22 ventilation verification assessment - filtration - HVAC assessment23 report - mechanical engineer review - adjustments, repairs, upgrades,24 and replacements - HVAC verification report - periodic inspections25 and ongoing maintenance - certified contractors - grants.26 (1) Definitions. A S USED IN THIS SECTION, UNLESS THE CONTEXT27 1307 -5- OTHERWISE REQUIRES:1 (a) "ANAB" MEANS THE AMERICAN NATIONAL STANDARDS2 I NSTITUTE NATIONAL ACCREDITATION BOARD.3 (b) "ASHRAE" MEANS THE AMERICAN SOCIETY OF HEATING,4 R EFRIGERATION AND AIR-CONDITIONING ENGINEERS.5 (c) "C ERTIFIED CONTRACTOR" MEANS A CONTRACTOR ON THE6 CERTIFIED CONTRACTOR LIST.7 (d) "C ERTIFIED CONTRACTOR LIST " MEANS THE CERTIFIED8 CONTRACTOR LIST CREATED BY THE DEPARTMENT OF LABOR AND9 EMPLOYMENT PURSUANT TO SECTION 40-3.2-105.6 (3)(a).10 (e) "C ERTIFIED TAB TECHNICIAN" MEANS A TECHNICIAN11 CERTIFIED TO PERFORM TESTING, ADJUSTING, AND BALANCING OF HVAC12 SYSTEMS BY:13 (I) T HE ASSOCIATED AIR BALANCE COUNCIL;14 (II) T HE NATIONAL ENVIRONMENTAL BALANCING BUREAU;15 (III) T HE TESTING, ADJUSTING AND BALANCING BUREAU; OR16 (IV) A SUCCESSOR ORGANIZATION OF AN ORGANIZATION NAMED17 IN SUBSECTION (1)(e)(I), (1)(e)(II), OR (1)(e)(III) OF THIS SECTION.18 (f) "CO2" MEANS CARBON DIOXIDE.19 (g) "D EPARTMENT" MEANS THE DEPARTMENT OF EDUCATION20 CREATED IN SECTION 24-1-115.21 (h) "HVAC" MEANS HEATING , VENTILATION, AND AIR22 CONDITIONING.23 (i) "HVAC ASSESSMENT REPORT" MEANS THE HVAC ASSESSMENT24 REPORT DESCRIBED IN SUBSECTION (4) OF THIS SECTION.25 (j) "INTERNATIONAL MECHANICAL CODE" MEANS THE 202126 INTERNATIONAL MECHANICAL CODE PUBLISHED BY THE INTERNATIONAL27 1307 -6- CODE COUNCIL OR THE MOST RECENT VERSION ADOPTED BY THE OFFICE1 OF THE STATE ARCHITECT CREATED IN SECTION 24-30-1302.5.2 (k) "ISO/IEC 17024 PERSONNEL CERTIFICATION STANDARD "3 MEANS THE ISO/IEC 17024 PERSONNEL CERTIFICATION ACCREDITATION4 STANDARD DEVELOPED BY THE INTERNATIONAL ORGANIZATION FOR5 S TANDARDIZATION AND THE INTERNATIONAL ELECTROTECHNICAL6 C OMMISSION FOR THE PURPOSE OF CERTIFYING PERSONNEL .7 (l) "L OCAL EDUCATION PROVIDER " MEANS: 8 (I) A LOCAL EDUCATION PROVIDER , AS DEFINED IN SECTION 9 22-16-103 (4); AND 10 (II) T HE COLORADO SCHOOL FOR THE DEAF AND THE BLIND 11 CREATED IN SECTION 22-80-102.12 (m) "MECHANICAL ENGINEER" MEANS A PROFESSIONAL ENGINEER13 WHO IS LICENSED PURSUANT TO PART 2 OF ARTICLE 120 OF TITLE 12 AND14 HAS PROFESSIONAL EXPERIENCE WITH HVAC SYSTEMS.15 (n) "MERV" MEANS MINIMUM EFFICIENCY REPORTING VALUE , AS16 ESTABLISHED BY ANAB/ASHRAE STANDARD 52.2-2017, "METHOD OF17 T ESTING GENERAL VENTILATION AIR-CLEANING DEVICES FOR REMOVAL18 E FFICIENCY BY PARTICLE SIZE".19 (o) "NOX" HAS THE MEANING SET FORTH IN SECTION 25-7-150220 (8).21 (p) "OCCUPIED AREAS" MEANS THE CLASSROOMS, AUDITORIUMS,22 GYMNASIUMS, CAFETERIAS, NURSES' OFFICES, RESTROOMS, AND OFFICES23 OF A SCHOOL.24 (q) "PPM" MEANS PARTS PER MILLION.25 (r) "PROJECT LABOR AGREEMENT " HAS THE MEANING SET FORTH26 IN 48 CFR 52.222-34.27 1307 -7- (s) "QUALIFIED ADJUSTING PERSONNEL" MEANS:1 (I) A CERTIFIED TAB TECHNICIAN; OR2 (II) A WORKER WHO IS UNDER THE DIRECT SUPERVISION OF A3 CERTIFIED TAB TECHNICIAN.4 (t) "QUALIFIED PERSONNEL" MEANS QUALIFIED TESTING5 PERSONNEL, QUALIFIED ADJUSTING PERSONNEL , OR OTHER WORKFORCE6 THAT IS HIRED BY AND UNDER THE DIRECT SUPERVISION OF A CERTIFIED7 CONTRACTOR FOR THE PURPOSE OF PERFORMING HVAC WORK.8 (u) "QUALIFIED TESTING PERSONNEL" MEANS:9 (I) A CERTIFIED TAB TECHNICIAN; OR10 (II) A N INDIVIDUAL CERTIFIED TO PERFORM VENTILATION11 ASSESSMENTS OF HVAC SYSTEMS BY THE INTERNATIONAL CERTIFICATION12 B OARD OR THROUGH AN EQUIVALENT CERTIFICATION PROGRAM OR BODY13 ACCREDITED UNDER THE ISO/IEC 17024 PERSONNEL CERTIFICATION14 STANDARD.15 (v) "REGISTERED APPRENTICESHIP PROGRAM " HAS THE MEANING16 SET FORTH IN SECTION 8-15.7-101 (13).17 (w) "SCHOOL" MEANS AN EDUCATIONAL FACILITY OPERATED BY18 A LOCAL EDUCATION PROVIDER .19 20 21 (x) "TAB" MEANS TESTING, ADJUSTING, AND BALANCING OF AN22 HVAC SYSTEM.23 (2) Applicability of section. (a) O N AND AFTER THE EFFECTIVE24 DATE OF THIS SECTION, IF A LOCAL EDUCATION PROVIDER UNDERTAKES25 HVAC INFRASTRUCTURE IMPROVEMENTS AT A SCHOOL USING MONEY26 MADE AVAILABLE BY A FEDERAL GOVERNMENT SOURCE OR BY A FEDERAL27 1307 -8- GOVERNMENT SOURCE IN COMBINATION WITH A STATE GOVERNMENT1 SOURCE SPECIFICALLY FOR SUCH PURPOSE , THE LOCAL EDUCATION2 PROVIDER SHALL COMPLY WITH THE PROCEDURES SET FORTH IN THIS3 SECTION IN IMPLEMENTING THE HVAC INFRASTRUCTURE IMPROVEMENTS .4 (b) N OTWITHSTANDING ANY PROVISION OF THIS SECTION TO THE5 CONTRARY, A LOCAL EDUCATION PROVIDER IS NOT REQUIRED TO SATISFY6 THE REQUIREMENTS OF THIS SECTION UNLESS THE LOCAL EDUCATION7 PROVIDER RECEIVES MONEY FROM A FEDERAL GOVERNMENT SOURCE OR8 FROM A FEDERAL GOVERNMENT SOURCE IN COMBINATION WITH A STATE9 GOVERNMENT SOURCE , WHICH MONEY IS MADE AVAILABLE FOR THE10 SPECIFIC PURPOSE OF IMPLEMENTING HVAC SYSTEM IMPROVEMENTS.11 (3) Ventilation verification assessment. Q UALIFIED PERSONNEL12 SHALL PERFORM ALL OF THE FOLLOWING :13 (a) Filtration. MERV 13 OR BETTER FILTRATION MUST BE14 INSTALLED IN A SCHOOL'S HVAC SYSTEM WHERE FEASIBLE. QUALIFIED15 PERSONNEL SHALL:16 (I) R EVIEW SYSTEM CAPACITY AND AIRFLOW TO DETERMINE THE17 HIGHEST MERV FILTRATION THAT CAN BE INSTALLED WITHOUT18 ADVERSELY IMPACTING EQUIPMENT ;19 (II) R EPLACE OR UPGRADE FILTERS WHERE NEEDED AND VERIFY20 THAT FILTERS ARE INSTALLED CORRECTLY ; AND21 (III) I SSUE RECOMMENDATIONS FOR ADDITIONAL MAINTENANCE ,22 FREQUENCY OF FILTER REPLACEMENTS , OR UPGRADES TO ALLOW FOR23 MORE PROTECTIVE FILTRATION AND RECORD THE RECOMMENDATIONS IN24 THE HVAC ASSESSMENT REPORT.25 (b) Ventilation and exhaust. A FTER ASSESSING THE FILTRATION26 AS DESCRIBED IN SUBSECTION (3)(a) OF THIS SECTION, QUALIFIED27 1307 -9- PERSONNEL SHALL ASSESS THE VENTILATION RATES IN THE SCHOOL 'S1 OCCUPIED AREAS TO DETERMINE WHETHER THEY MEET THE MINIMUM2 VENTILATION RATE REQUIREMENTS SET FORTH IN THE INTERNATIONAL3 MECHANICAL CODE. ASSESSMENT OF THE VENTILATION AND EXHAUST4 MUST INCLUDE ALL THE FOLLOWING :5 (I) C ALCULATION OF THE ESTIMATED MINIMUM OUTSIDE AIR6 VENTILATION RATES FOR EACH OCCUPIED AREA BASED ON THE MAXIMUM7 ANTICIPATED OCCUPANCY AND THE MINIMUM REQUIRED VENTILATION8 RATE PER OCCUPANT. CALCULATIONS MUST BE BASED ON MAXIMUM9 ANTICIPATED CLASSROOM OR OTHER OCCUPIED AREA OCCUPANCY RATES10 AND DETERMINED BY THE INTERNATIONAL MECHANICAL CODE ;11 (II) M EASUREMENT OF OUTSIDE AIR AND VERIFICATION THAT THE12 SYSTEM PROVIDES THE MINIMUM OUTSIDE AIR VENTILATION RATES13 CALCULATED PURSUANT TO SUBSECTION (3)(b)(I) OF THIS SECTION;14 (III) V ERIFICATION OF COIL VELOCITIES AND UNIT DISCHARGE AIR15 TEMPERATURES REQUIRED TO MAINTAIN DESIRED INDOOR CONDITIONS16 AND TO AVOID MOISTURE CARRYOVER FROM COOLING COILS ;17 (IV) V ERIFICATION THAT SEPARATION BETWEEN OUTDOOR AIR18 INTAKES AND EXHAUST DISC HARGE OUTLETS MEETS THE REQUIREMENTS19 OF THE INTERNATIONAL MECHANICAL CODE ;20 (V) C ONFIRMATION THAT THE AIR HANDLING UNIT IS BRINGING IN21 OUTDOOR AIR AND REMOVING EXHAUST AIR AS INTENDED BY THE SYSTEM22 DESIGN; AND23 (VI) M EASUREMENT OF ALL EXHAUST AIR VOLUME FOR EXHAUST24 FANS, SUCH AS RESTROOM EXHAUST FANS , INCLUDING DOCUMENTATION25 OF ANY DISCREPANCIES FROM SYSTEM DESIGN .26 (c) Economizers. F OR HVAC SYSTEMS WITH ECONOMIZERS ,27 1307 -10- QUALIFIED PERSONNEL SHALL TEST SYSTEM ECONOMIZER DAMPERS FOR1 PROPER OPERATION. ECONOMIZER DAMPERS AND CONTROLS THAT ARE2 NOT PROPERLY FUNCTIONING SHALL BE REPAIRED BY A CERTIFIED3 CONTRACTOR AND THE CERTIFIED CONTRACTOR 'S QUALIFIED PERSONNEL.4 Q UALIFIED PERSONNEL SHALL RECORD RECOMME NDATIONS FOR5 ADDITIONAL MAINTENANCE , REPLACEMENT, OR UPGRADES IN THE HVAC6 ASSESSMENT REPORT.7 (d) Demand control ventilation. (I) I F DEMAND CONTROL8 VENTILATION SYSTEMS ARE INSTALLED , QUALIFIED PERSONNEL SHALL9 VERIFY THEIR PROPER OPERATION.10 (II) D EMAND CONTROL VENTILATION SYSTEMS THAT ARE NOT11 PROPERLY FUNCTIONING SHALL BE REPAIRED BY A CERTIFIED CONTRACTOR12 AND THE CERTIFIED CONTRACTOR 'S QUALIFIED PERSONNEL.13 (III) I F A DEMAND CONTROL VENTILATION SYSTEM IS14 RECOMMENDED TO BE DISABLED OR IS UNABLE TO PROVIDE15 RECOMMENDED VENTILATION RATES , THE HVAC SYSTEM MUST BE16 CONFIGURED TO MEET THE MINIMUM VENTILATION RATE REQUIREMENTS17 WITHOUT USE OF THE DEMAND CONTROL VENTILATION SYSTEM AND18 TESTED AND ADJUSTED TO ACHIEVE THE ESTIMATED MINIMUM OUTSIDE19 AIR VENTILATION RATE, AS DESCRIBED IN SUBSECTION (3)(b)(I) OF THIS20 SECTION.21 (IV) Q UALIFIED PERSONNEL SHALL RECORD RECOMMENDATIONS22 FOR ADDITIONAL MAINTENANCE , REPLACEMENT, OR UPGRADES IN THE23 HVAC ASSESSMENT REPORT.24 (e) Air distribution and building pressurization. (I) Q UALIFIED25 PERSONNEL SHALL:26 (A) P ERFORM SURVEY READINGS OF INLETS AND OUTLETS TO27 1307 -11- VERIFY THAT ALL VENTILATION IS REACHING THE SERVED ZONES AND1 THAT THERE IS ADEQUATE AIR DISTRIBUTION ;2 (B) V ERIFY THAT INLETS AND OUTLETS ARE BALANCED WITHIN3 TOLERANCE OF THE SYSTEM DESIGN ; AND4 (C) D OCUMENT READ VALUES AND DEFICIENCIES . IF THE ORIGINAL5 SYSTEM DESIGN VALUES ARE NOT AVAILABLE , QUALIFIED PERSONNEL6 SHALL DOCUMENT AVAILABLE INFORMATION AND NOTE THE7 UNAVAILABILITY OF SYSTEM DESIGN VALUES IN THE HVAC ASSESSMENT8 REPORT.9 (II) Q UALIFIED PERSONNEL SHALL VERIFY BUILDING AND SPACE10 PRESSURE TO ENSURE THAT:11 (A) T HE PRESSURE DIFFERENTIAL IS WITHIN TOLERANCE OF12 DESIGN, IF KNOWN;13 (B) T HE SCHOOL BUILDING IS NOT OVER PRESSURIZED ; AND14 (C) I F APPLICABLE, ROOMS DESIGNATED FOR TEMPORARY15 OCCUPATION BY SICK STUDENTS OR STAFF MAINTAIN A NEGATIVE16 PRESSURE, OR AS OTHERWISE DESIGNED.17 (f) General maintenance. Q UALIFIED PERSONNEL SHALL VERIFY18 COIL CONDITION, CONDENSATE DRAI NAGE , COOLING COIL AIR19 TEMPERATURE DIFFERENTIAL (ENTERING AND LEAVING DRY BULB ), HEAT20 EXCHANGER AIR TEMPERATURE DIFFERENTIAL (ENTERING AND LEAVING21 DRY BULB), AND DRIVE ASSEMBLY CONDITION . QUALIFIED PERSONNEL22 SHALL RECORD RECOMMENDATIONS FOR ADDITIONAL MAINTENANCE ,23 REPLACEMENT, OR UPGRADES IN THE HVAC ASSESSMENT REPORT.24 (g) Operational controls. Q UALIFIED PERSONNEL SHALL REVIEW25 CONTROL SEQUENCES TO VERIFY THAT SYSTEMS WILL MAINTAIN INTENDED26 VENTILATION, TEMPERATURE, AND HUMIDITY CONDITIONS DURING SCHOOL27 1307 -12- OPERATION.1 (h) CO2 monitoring. (a) A T13 LEAST ONCE EVERY FIVE YEARS, QUALIFIED PERSONNEL SHALL PERFORM14 THE DUTIES CONCERNING ASSESSMENT , MAINTENANCE, ADJUSTMENT,15 OPERATIONAL CONTROLS , AND CO2 MONITORS DESCRIBED IN16 SUBSECTIONS (3) TO (6) OF THIS SECTION.17 (b) FOR CO2 MONITORS INSTALLED IN OCCUPIED AREAS, AS18 DETERMINED BY QUALIFIED PERSONNEL, IF THE CO2 CONCENTRATION19 ALARM SET POINT IS EXCEEDED FO R MORE THAN FIFTEEN MINUTES MORE20 THAN FOUR TIMES IN A MONTH, QUALIFIED ADJUSTING PERSONNEL SHALL21 EITHER ADJUST THE OCCUPIED AREA'S VENTILATION RATES OR INSTALL A22 DIRECT OUTSIDE AIRFLOW MEASUREMENT DEVICE AND VERIFY ITS23 ACCURACY TO ENSURE PEAK CO2 CONCENTRATIONS IN THE OCCUPIED24 AREA REMAIN BELOW THE SET POINT .25 (c) E ACH LOCAL EDUCATION PROVIDER SHALL:26 (I) R ECORD EACH INCIDENT IN WHICH A CO2 CONCENTRATION27 1307 -18- ALARM SET POINT WAS BREACHED ;1 (II) R ETAIN EACH RECORD FOR AT LEAST FIVE YEARS ; AND2 (III) M AKE THE RECORDS AVAILABLE TO THE PUBLIC UPON3 REQUEST.4 (9) Certified contractors. O N AND AFTER THE EFFECTIVE DATE OF THIS SECTION , IF THE13 SCHOOL UNDERTAKES HVAC INFRASTRUCTURE IMPROVEMENTS USING14 MONEY MADE AVAILABLE BY A FEDERAL GOVERNMENT SOURCE OR BY A15 FEDERAL GOVERNMENT SOURCE IN COMBINATION WITH A STATE16 GOVERNMENT SOURCE SPECIFICALLY FOR SUCH PURPOSE , THE SCHOOL17 SHALL COMPLY WITH THE REQUIREMENTS DESCRIBED IN SECTION18 22-32-152 IN IMPLEMENTING THE HVAC INFRASTRUCTURE19 IMPROVEMENTS.20 SECTION 7. In Colorado Revised Statutes, 24-75-232, amend21 (1)(d) and (2)(d); and add (1)(d.5) and (5)(e) as follows:22 24-75-232. "Infrastructure Investment and Jobs Act" cash23 fund - creation - allowable uses - report - legislative declaration -24 definitions - repeal. (1) The general assembly finds and declares that:25 (d) In order for the state to be competitive for the highest range of26 funding available to it under the federal act, it is necessary for27 1307 -23- departments to have funds available as a nonfederal match, although due1 to still-evolving federal guidance the amounts needed and specific types2 of projects may not be known in time for this money to be appropriated3 in the annual general appropriation act; and4 (d.5) WITH THE PASSAGE OF THE "INFLATION REDUCTION ACT OF5 2022" AND THE "BIPARTISAN INFRASTRUCTURE LAW" BILLIONS OF6 DOLLARS IN FEDERAL MONEY ARE AVAILABLE TO HELP PUBLIC SCHOOLS7 IMPROVE AIR QUALITY IN SCHOOLS, STUDENT PERFORMANCE, AND STAFF8 RETENTION; AND9 (2) As used in this section, unless the context otherwise requires:10 (d) "Local government" means a county, a municipality, a city and11 county, A LOCAL EDUCATION PROVIDER , or a special district.12 (5) (e) (I) THE OFFICE SHALL USE EXISTING RESOURCES FUNDED BY13 THE FUND TO PROVIDE GRANT WRITING SUPPORT, ADMINISTRATIVE14 SUPPORT, AND PROJECT PLANNING PURSUANT TO SUBSECTION (1)(e)(V) OF15 THIS SECTION TO SCHOOL DISTRICTS, BOCES, THE COLORADO SCHOOL16 FOR THE DEAF AND THE BLIND , CHARTER SCHOOLS, AND INSTITUTE17 CHARTER SCHOOLS, INCLUDING SUCH ENTITIES THAT ARE UNDERTAKING18 HVAC INFRASTRUCTURE IMPROVEMENTS AS DESCRIBED IN SECTION19 22-32-152.20(II) AS PART OF THE REPORT ISSUED PURSUANT TO SUBSECTION21 (7)(a) OF THIS SECTION, THE OFFICE SHALL SUBMIT A REPORT TO THE JOINT22 BUDGET COMMITTEE AND THE CAPITAL DEVELOPMENT COMMITTEE23 CONCERNING THE NUMBER OF APPLICANTS FOR MATCHING FUNDS FROM24 LOCAL EDUCATION PROVIDERS REVIEWED BY THE OFFICE BEFORE25 OCTOBER 2, 2025. THE REPORT MUST INCLUDE THE AMOUNT OF26 REQUESTED MATCHING FUNDS, THE RECOMMENDE D AMOUNT OF27 1307 -24- MATCHING FUNDS, AND AN EXPLANATION FOR THE DIFFERENCE, IF ANY,1 BETWEEN THE REQUESTED AMOUNTS AND THE RECOMMENDED AMOUNTS.2 (III) FOR THE PURPOSES OF THIS SUBSECTION (5)(e), THE OFFICE3 MAY USE EXISTING MONEY APPROPRIATED FROM THE FUND TO PROVIDE4 GRANT WRITING SUPPORT, ADMINISTRATIVE SUPPORT, AND PROJECT5 PLANNING PURSUANT TO SUBSECTION (1)(e)(V) OF THIS SECTION TO6 REVIEW THE WORK OF APPLICANTS AND TO CONNECT APPLICANTS WITH7 THIRD PARTIES WITH EXPERTISE PERTAINING TO FEDERAL FUNDING8 APPLICATION TECHNICAL ASSISTANCE , INCLUDING ASSISTANCE9 CONCERNING:10 (A) S CHOOL VENTILATION AND ENERGY EFFICIENCY VERIFICATION ;11 (B) S USTAINABILITY PROJECT PLANNING;12 (C) G RANT WRITING;13 (D) T ECHNICAL ASSISTANCE , SUCH AS ENGINEERING OR14 FEASIBILITY STUDIES, NEEDED TO IMPROVE OR MAKE THE CASE FOR A15 GRANT APPLICATION;16 (E) C OMPLIANCE WITH FEDERAL LABOR STANDARDS ;17 (F) I NCENTIVES FOR TAX CREDITS;18 (G) P ROCUREMENT MATERIALS ASSOCIATED WITH THE FEDERAL19 "B UILD AMERICA, BUY AMERICA ACT", SECTION 70901 ET SEQ., OF THE20 FEDERAL "INFRASTRUCTURE INVESTMENT AND JOBS ACT", PUB.L. 117-58;21 (H) P ROJECT FINANCING EXPERTISE , SUCH AS CREATING AN22 ON-BILL FINANCING AND REPAYMENT PROGRAM ;23 (I) C OMPLIANCE WITH LABOR STANDARDS OUTLINED IN FEDERAL24 FUNDING GUIDANCE; AND25 (J) C OMMUNITY BENEFIT PLAN DEVELOPMENT AND COMMUNITY26 BENEFIT AGREEMENT NEGOTIATION AND IMPLEMENTATION , SUCH AS BEST27 1307 -25- PRACTICES OR CONSULTANT FUNDS FOR COMMUNITY MEMBERS .1 (IV) IF THERE ARE APPROVED APPLICATIONS FOR HVAC2 INFRASTRUCTURE IMPROVEMENT PROJECTS AT SCHOOL PROJECTS AS3 DESCRIBED IN SECTION 22-32-152, THE OFFICE MAY SEEK A4 SUPPLEMENTAL APPROPRIATION FROM THE FUND .5 SECTION 8. Safety clause. The general assembly finds,6 determines, and declares that this act is necessary for the immediate7 preservation of the public peace, health, or safety or for appropriations for8 the support and maintenance of the departments of the state and state9 institutions.10 1307 -26-
