The bill authorizes the department of education to commission a financial study (study) with an independent contractor to analyze the costs to provide students the opportunity to obtain college credits, industry credentials, and work-based learning experiences. Dashes through the words or numbers indicate deletions from existing law. and workforce readiness programs, including costs and opportunities for savings to the state and school districts, district charter schools, institute charter schools, and boards of cooperative services (local education providers). The bill requires the office of information technology (office) to build, or contract with a third-party vendor to build, the Colorado statewide longitudinal data system (data system) to establish a consistent, appropriate, secure, and legal means of data sharing and connecting multiple data sets into the data system to support effective state investments, inform policy research, and assist Colorado citizens in making choices related to their education and training pathways. The office shall work with contributing state agencies, local education providers, institutions of higher education, partner entities, and policymakers. The bill creates the Colorado state longitudinal data system governing board (governing board) to support the office with the development and implementation of the data system. The governing board is required to convene the systems build and implementation interagency advisory group and the sustainability interagency advisory group to support and advise the governing board on the technical development, implementation, use, and function of the data system. The bill requires the office to submit an interim report on January 15, 2025, and an annual report on education and workforce readiness beginning April 15, 2026, and each April 15 thereafter, to the general assembly, the state board of education, and the governor summarizing the education and workforce outcomes and postsecondary and workforce programs using the data system. Be it enacted by the General Assembly of the State of Colorado:1 SECTION 1. In Colorado Revised Statutes, add 22-35-115 as2 follows:3 22-35-115. Postsecondary and workforce readiness programs4 - financial study - funding - reports - legislative declaration -5 definitions. (1) (a) T HE GENERAL ASSEMBLY FINDS AND DECLARES THAT :6 (I) C OLORADO'S ECONOMIC VITALITY DEPENDS ON A HIGHLY7 EDUCATED, SKILLED, AND DIVERSE WORKFORCE READY TO MEET THE JOB8 DEMANDS OF A POST -PANDEMIC WORLD . THIS REQUIRES A9 LEARNER-CENTERED APPROACH TO OFFERING PROGRAMS DESIGNED TO10 1364-2- INTEGRATE SECONDARY, POSTSECONDARY, AND WORK-BASED LEARNING1 OPPORTUNITIES FOR STUDENTS ENROLLED IN HIGH SCHOOL AND ,2 ULTIMATELY, CREATING PATHWAYS AND WORKFORCE OPTIONS THAT3 ALLOW STUDENTS IN COLORADO TO GRADUATE HIGH SCHOOL WITH A4 CAREER-CONNECTED LEARNING OPPORTUNITY .5 (II) C OLORADO IS CONSIDERED A NATIONAL LEADER IN6 POSTSECONDARY AND WORKFORCE READINESS POLICIES AND HAS7 ENACTED STATUTES THAT PROVIDE RESOURCES AND FUNDING8 MECHANISMS TO DISTRICTS THAT OFFER POSTSEC ONDARY AND9 WORKFORCE OPPORTUNITIES IN HIGH SCHOOL , INCLUDING THE ABILITY TO10 EARN COLLEGE CREDITS, OBTAIN INDUSTRY CREDENTIALS, OR EXPERIENCE11 WORK-BASED LEARNING;12 (III) T HE GENERAL ASSEMBLY HAS ENACTED STATUTES DIRECTING13 COMMUNITY COLLEGES AND THE STATE WORKFORCE DEVELOPMENT14 COUNCIL TO CREATE AND EXPAND CAREER PATHWAYS IN A WIDE VARIETY15 OF CAREERS RANGING FROM MANUFACTURING CAREER PATHWAYS TO16 INTEGRATED CAREER PATHWAYS WITHIN GROWING INDUSTRY SECTORS TO17 CAREER PATHWAYS FOR TEACHERS ;18 (IV) T HESE STATUTES AND PROGRAMS HAVE LED TO A SIGNIFICANT19 EXPANSION OF WORK -BASED LEARNING AND PARTNERSHIPS WITH20 EMPLOYERS AND A NOTABLE INCREASE IN THE NUMBER OF STUDENTS21 COMPLETING COURSES IN HIGH SCHOOL THAT QUALIFY FOR BOTH22 SECONDARY AND POSTSEC ONDARY CREDIT , INDUSTRY CREDENTIAL23 PROGRAMS, AND WORK-BASED LEARNING EXPERIENCES. THE COLORADO24 DEPARTMENT OF EDUCATION REPORTS THAT BETWEEN 2016 AND 2023,25 OVER SIXTY-FIVE THOUSAND STUDENTS COMPLETED QUALIFYING26 ADVANCED PLACEMENT COURSES THR OUGH THE CAREER DEVELOPMENT27 1364 -3- SUCCESS PROGRAM , OBTAINED INDUSTRY CREDENTIALS , AND1 PARTICIPATED IN WORK-BASED LEARNING EXPERIENCES .2 (V) T HE TASK FORCE CREATED IN HOUSE BILL 21-1330 CALLED3 FOR EXPANDING INNOVATIVE HIGH SCHOOL , POSTSECONDARY, AND4 WORKFORCE OPTIONS AND PATHWAYS , WHICH BROADLY INCLUDE5 WORK-BASED LEARNING, CREDENTIAL COMPLETION , APPRENTICESHIPS,6 AND OTHER EXPERIENCES, WITH A FOCUS ON HIGH-NEED, IN-DEMAND,7 HIGH-VALUE BUSINESS- AND INDUSTRY-FOCUSED CAREER PATHWAYS ;8 (VI) I N RESPONSE, THE GENERAL ASSEMBLY PASSED HOUSE BILL9 22-1215, WHICH CREATED A TASK FORCE TO REVIEW THE COMPLICATED10 AND INTERWOVEN SET OF ISSUES RELATED TO PROGRAM APPROVAL ,11 AVAILABILITY, AND FUNDING THAT RESULTS IN UNEQUAL STUDENT ACCESS12 TO POSTSECONDARY AND WORKFORCE READINESS PROGRAMS ACROSS THE13 STATE AND TO MAKE RECOMMENDATIONS TO ADDRESS THESE ISSUES ;14 (VII) T HE IMPORTANT WORK CONDUCTED BY THE MEMBERS OF THE15 TASK FORCE PROVIDED CRITICAL RECOMMENDATIONS FOR HOW THE STATE16 CAN ENSURE THAT EVERY STUDENT IN COLORADO CAN GRADUATE FROM17 HIGH SCHOOL WITH COLLEGE CREDITS ; AN IN-DEMAND, INDUSTRY18 CREDENTIAL; OR A QUALITY, WORK-BASED LEARNING EXPERIENCE;19 (VIII) T HE RECOMMENDATIONS OF THE TASK FORCE CENTER ON20 SIMPLIFYING PROGRAMS , ALIGNING INCENTIVES , UNDERSTANDING21 EFFECTS, AND DEVELOPING AND IMPROVING SYSTEMS THAT BETTER22 CONNECT EDUCATION AND THE WORKFORCE ;23 (IX) N OTABLY, THE TASK FORCE WAS UNABLE TO EVALUATE THE24 EFFECT OF POSTSECONDARY AND WORKFORCE READINESS PROGRAMS DUE25 TO THE LIMITED ACCESS TO OUTCOME DATA AND LACK OF CONSISTENT26 OUTCOME DATA, AND THE ABSENCE OF DISAGGREGATED DATA AND A27 1364 -4- LONGITUDINAL DATA SYSTEM TO CONNECT LONG -TERM WAGE OUTCOMES1 WITH PARTICIPATION IN THESE PROGRAMS ;2 (X) T HE TASK FORCE MADE THIRTEEN RECOMMENDATIONS AND3 RECOMMENDED THE STATE BEGIN BY FOCUSING ON STREAMLINING4 ADMINISTRATION, DEVELOPING A LONGITUDINAL DATA SYSTEM , AND5 CREATING SUSTAINABLE FUNDING . THE TASK FORCE REPORT CONCLUDED6 WITH ENCOURAGEMENT TO THINK BEYOND EXISTING PROGRAMS AND TO7 DEVELOP, "A STREAMLINED SYSTEM THAT SERVES LEARNERS IN ALL THEIR8 EDUCATION AND WORKFORCE READINESS TRAINING AND IS EASY TO9 NAVIGATE FOR ALL THOSE WHO SUPPORT THEM ."10 (XI) T HE TASK FORCE ALSO RECOMMENDED PRIORITIZING THE11 THIRD RECOMMENDATION : "ESTABLISH AND UTILIZE A ROBUST STATEWIDE12 LONGITUDINAL DATA SYSTEM . THE SYSTEM SHOULD INTERFACE WITH13 DATA REPORTED FROM THE RELEVANT ENTITIES THAT IS SHAREABLE14 ACROSS AGENCIES AND COMPLY WITH EXISTING STATUTORY PARAM ETERS ,15 INCLUDING STATE AND FEDERAL DATA PRIVACY LAWS . THERE SHOULD16 ALSO BE AN INVESTMENT IN A PUBLIC -FACING DASHBOARD WITH17 EDUCATION AND EMPLOYMENT OUTCOMES TO HELP INFORM DECISIONS18 MADE BY LEARNERS AND FAMILIES ."19 (XII) T HE COLORADO DEPARTMENT OF EDUCATION , THE20 C OLORADO WORKFORCE DEVELOPMENT C OUNCIL , THE COLORADO21 DEPARTMENT OF HIGHER EDUCATION , AND THE OFFICE OF INFORMATION22 TECHNOLOGY HAVE LED EFFORTS TO EXPAND DATA SHARING TO ANSWER23 KEY QUESTIONS REGARDING EDUCATION AND WORKFORCE ISSUES , WHILE24 PROTECTING STUDENT PRIVACY AND SECURITY , AT THE BEHEST OF STATE25 AGENCIES AND THE GENERAL ASSEMBLY ;26 (XIII) T HESE STATE PARTNERSHIPS ARE IN ADDITION TO27 1364 -5- ONE-ON-ONE DATA-SHARING EFFORTS THAT EXIST FOR SPECIFIC, EXISTING,1 STATUTORILY REQUIRED REPORTS ;2 (XIV) C OLORADO DOES NOT HAVE A SINGLE, LONGITUDINAL DATA3 SYSTEM, WHICH, AS SEEN IN OTHER STATES, CAN PROVIDE A SINGLE STOP4 IN A NEUTRAL AGENCY TO EXAMINE THE LONG -TERM EFFECTS OF5 INVESTMENTS MADE BY THE STATE IN WORKFORCE DEVELOPMENT6 PROGRAMS THAT SIT PRIMARILY , BUT NOT ENTIRELY, IN EDUCATION,7 WORKFORCE, AND ECONOMIC DEVELOPMENT AGENCIES ; AND8 (XV) A DDRESSING THE RECOMMENDATIONS PROVIDED BY THE9 TASK FORCE WILL REQUIRE PARTNERSHIP WITHIN AND BE YOND THE10 GENERAL ASSEMBLY AND GOVERNMENT PARTNERS AND REQUIRES11 INTENTIONALITY TO ENSURE THAT THE STATE IS TAKING ACTION IN THE12 BEST INTEREST OF ITS STUDENTS.13 (b) T HE GENERAL ASSEMBLY FINDS, THEREFORE, THAT:14 (I) T O BEGIN THE WORK OF ENSURING STUDENTS HAVE EQUITABLE15 ACCESS IN HIGH SCHOOL TO COLLEGE CREDIT , QUALITY INDUSTRY16 CREDENTIALS, AND WORK-BASED LEARNING EXPERIENCES , THE STATE17 MUST BEGIN BY UNDERSTANDING THE COSTS FOR STUDENTS TO OBTAIN18 THESE EXPERIENCES, AND AS RECOMMENDED BY THE TASK FORCE ,19 EXAMINE THE LONG -TERM EFFECT OF THESE OPPORTUNITIES FOR20 STUDENTS;21 (II) S TUDYING THE COSTS FOR POSTSECONDARY AND WORKFORCE22 PROGRAMS AND IMPLEMENTING A STATEWIDE LONGITUDINAL DATA23 SYSTEM WILL LAY CRITICAL FOUNDATION FOR IMPLEMENTING THE24 RECOMMENDATIONS INTO STATE SYSTEMS IN 2025 TO MODERNIZE,25 SIMPLIFY, AND BETTER INTEGRATE OPPORTUNITIES FOR STUDENTS TO26 OBTAIN COLLEGE CREDIT, INDUSTRY CREDENTIALS, AND WORK-BASED27 1364 -6- LEARNING OPPORTUNITIES; AND1 (III) T HERE IS UNDERSTANDING OF AND COMMITMENT TO THE2 CONCLUSION OF THE TASK FORCE REPORT : "THE RECOMMENDATIONS ARE3 INTERTWINED AND SHOULD BE SCAFFOLDED AS SUCH , WITH THE4 UNDERSTANDING THAT THEY WILL TAKE TIME TO IMPLEMENT . THE TASK5 FORCE BELIEVES THAT IMPLEMENTING ALL RECOMMENDATIONS IS6 NECESSARY TO MEANINGFULLY IMPROVE [POSTSECONDARY AND7 WORKFORCE READINESS]..."8 (2) A S USED IN THIS SECTION, UNLESS THE CONTEXT OTHERWISE9 REQUIRES:10 (a) "C OLORADO STATEWIDE LONGITUDINAL DATA SYSTEM " MEANS11 THE STATEWIDE DATA SYSTEM THAT CONNECTS DATA FROM12 CONTRIBUTING STATE AGENCIES AND PARTNER ENTITIES AND SUPPORTS13 THE PURPOSES IDENTIFIED IN SECTION 24-37.5-124 (2)(a).14 (b) "P OSTSECONDARY AND WORKFORCE READINESS PROGRAMS "15 MEANS PROGRAMS FOR COLORADO HIGH SCHOOL STUDENTS TO DEVELOP16 THE KNOWLEDGE AND COMPETENCIES NEEDED TO SUCCEED IN17 POSTSECONDARY SETTINGS AND TO ADVANCE IN CAREER PATHWAYS AS18 LIFELONG LEARNERS AND CONTRIBUTING CITIZENS .19 (3) (a) T HE DEPARTMENT SHALL COMMISSION A FINANCIAL STUDY20 TO ANALYZE COSTS TO THE STATE, LOCAL EDUCATION PROVIDERS, AND21 STUDENTS, AND POTENTIAL COST SAVINGS WHEN PROVIDING STUDENTS22 THE OPPORTUNITY TO OBTAIN COLLEGE CREDITS , INDUSTRY CREDENTIALS,23 AND WORK-BASED LEARNING EXPERIENCES. THE FINANCIAL STUDY MUST24 INCLUDE AN ANALYSIS ON THE EFFECTS OF CONSOLIDATING CERTAIN25 POSTSECONDARY AND WORKFORCE READINESS PROGRAMS . THE26 DEPARTMENT SHALL CONTRACT WITH AN INDEPENDENT CONTRACTOR , IN27 1364 -7- ACCORDANCE WITH THE "PROCUREMENT CODE", ARTICLES 101 TO 112 OF1 TITLE 24, TO CONDUCT THE FINANCIAL STUDY AND PREPARE A FINAL2 REPORT SUMMARIZING THE FINANCIAL STUDY 'S METHODOLOGIES ,3 FINDINGS, AND RECOMMENDATIONS .4 (b) T HE DEPARTMENT, THE DEPARTMENT OF LABOR AND5 EMPLOYMENT, THE COLORADO WORKFORCE DEVELOPMENT C OUNCIL , THE6 DEPARTMENT OF HIGHER EDUCATION , THE COLORADO COMMISSION ON7 HIGHER EDUCATION, AND THE CAREER AND TECHNICAL EDUCATION8 DIVISION WITHIN THE COLORADO COMMUNITY COLLEGE SYSTEM SHALL9 PROVIDE GUIDANCE AND INPUT , AS NECESSARY, TO ASSIST THE10 INDEPENDENT CONTRACTOR IN PREPARING THE FINAL REPORT .11 (c) L EGISLATIVE COUNCIL STAFF AND JOINT BUDGET COMMITTEE12 STAFF SHALL PROVIDE INPUT ON THE FINANCIAL MODELING TO ASSESS THE13 COSTS AND SAVINGS OF POSTSECONDARY AND WORKFORCE READINESS14 PROGRAMS.15 (4) (a) T HE FINANCIAL STUDY COMMISSIONED PURSUANT TO16 SUBSECTION (3)(a) OF THIS SECTION MUST INCLUDE A REVIEW OF THE17 FOLLOWING POSTSECONDARY AND WORKFORCE READINESS PROGRAMS :18 (I) T HE ASCENT PROGRAM CREATED IN SECTION 22-35-108;19 (II) T HE CAREER DEVELOPMENT SUCCESS PROGRAM CREATED IN20 SECTION 22-54-138;21 (III) T HE CONCURRENT ENROLLMENT PROGRAMS DESCRIBED IN22 SECTION 22-35-104;23 (IV) E ARLY COLLEGE HIGH SCHOOLS;24 (V) P ATHWAYS IN TECHNOLOGY EARLY COLLEGE HIGH SCHOOLS25 CREATED IN PART 1 OF ARTICLE 35.3 OF THIS TITLE 22;26 (VI) T EACHER RECRUITMENT EDUCATION AND PREPARATION27 1364 -8- PROGRAM CREATED IN SECTION 22-35-108.5; AND1 (VII) K-12 WORK-BASED LEARNING OPPORTUNITIES DESCRIBED IN2 SECTION 8-83-602 (5).3 (b) T HE FINANCIAL STUDY MAY INCLUDE A REVIEW OF :4 (I) T HE JOHN W. THE SYSTEMS ADVISORY GROUP MEMBERS MUST HAVE AN11 UNDERSTANDING OF EACH CONTRIBUTING AGENCY 'S DATA SYSTEM,12 PROCESSES, AND STRUCTURES. THE SYSTEMS ADVISORY GROUP SHALL13 ADVISE AND SUPPORT THE GOVERNING BOARD 'S DUTIES PURSUANT TO14 SUBSECTION (4) OF THIS SECTION. THE CASH FUND CONSISTS OF MONEY1 TRANSFERRED TO THE CASH FUND PURSUANT TO SUBSECTION (8)(b) OF2 THIS SECTION AND ANY OTHER MONEY THAT THE GENERAL ASSEMBLY MAY3 APPROPRIATE OR TRANSFER TO THE CASH FUND . THE STATE TREASURER4 SHALL CREDIT ALL INTEREST AND INCOME DERIVED FROM THE DEPOSIT5 AND INVESTMENT OF MONEY IN THE CASH FUND TO THE CASH FUND .6 (b) ON JULY 1, 2024, THE STATE TREASURER SHALL TRANSFER FIVE7 MILLION DOLLARS FROM THE GENERAL FUND TO THE CASH FUND FOR8 PURPOSES OF THIS SECTION.9 (c) SUBJECT TO ANNUAL APPROPRIATION BY THE GENERAL10 ASSEMBLY FOR THE 2024-25, 2025-26, AND 2026-27 STATE FISCAL YEARS,11 THE OFFICE AND THE DEPARTMENT OF EDUCATION MAY EXPEND MONEY12 FROM THE CASH FUND FOR PURPOSES OF THIS SECTION .13 (d) ANY MONEY APPROPRIATED IN A STATE FISCAL YEAR14 PURSUANT TO THIS SECTION THAT IS UNENCUMBERED OR UNEXPENDED AT15 THE END OF THAT STATE FISCAL YEAR REMAINS AVAILABLE FOR16 EXPENDITURE IN THE NEXT FISCAL YEAR FOR THE SAME PURPOSES17 WITHOUT FURTHER APPROPRIATION .18 (e) THE STATE TREASURER SHALL TRANSFER ALL UNEXPENDED19 AND UNENCUMBERED MONEY IN THE CASH FUND ON SEPTEMBER 1, 2027,20 TO THE GENERAL FUND.21 (f) THIS SUBSECTION (8) IS REPEALED, EFFECTIVE OCTOBER 1,22 2027.23 (9) THE OFFICE MAY SEEK, ACCEPT, AND EXPEND GIFTS, GRANTS,24 OR DONATIONS FROM PRIVATE OR PUBLIC SOURCES FOR THE PURPOSES OF25 THIS SECTION.26 SECTION 4. In Colorado Revised Statutes, 26.5-1-111, add3 (3.5) as follows:4 26.5-1-111. Data system - collection - analysis - cross-agency5 agreements. (3.5) T HE DEPARTMENT SHALL CONTRIBUTE EDUCATION6 AND WORKFORCE READINESS DATA BEGINNING IN THE 2025-26 STATE7 FISCAL YEAR, AS NECESSARY , TO THE COLORADO STATEWIDE8 LONGITUDINAL DATA SYSTEM CONSISTENT WITH THE GOVERNANCE9 PRACTICES ESTABLISHED BY THE COLORADO STATEWIDE LONGITUDINAL10 DATA SYSTEM GOVERNING BOARD PURSUANT TO SECTION 24-37.5-124 (4).11 SECTION 18. Appropriation. (1) For the 2024-25 state fiscal12 year, $800,005 is appropriated to the department of education. This13 appropriation is from the general fund. To implement this act, the14 department may use this appropriation as follows:15 (a) $21,700 for use by management and administration for general16 department and program administration;17 (b) $10,900 for use by school district operations for administration18 related to public school finance; and19 (c) $767,405 for use by student pathways for implementation of20 H.B. 22-1215 task force report, which amount is based on an assumption21 that the division will require an additional 0.2 FTE.22 (2) For the 2024-25 state fiscal year, $202,992 is appropriated to23 the department of education for use by management and administration.24 This appropriation is from the statewide longitudinal data system cash25 fund created in section 24-37.5-124 (8)(a), C.R.S., and is based on an26 assumption that the division will require an additional 1.0 FTE. To27 1364 -29- implement this act, the division may use this appropriation for1 information technology services.2 (3) For the 2024-25 state fiscal year, $4,432,419 is appropriated3 to the office of the governor for use by the office of information4 technology. This appropriation is from the statewide longitudinal data5 system cash fund created in section 24-37.5-124 (8)(a), C.R.S., and is6 based on an assumption that the office will require an additional 6.9 FTE.7 To implement this act, the office may use this appropriation for enterprise8 solutions.9 SECTION 19. Safety clause.
