The bill creates the Colorado agriculture license plate. In addition
to the normal fees for a license plate, a person must pay 2 additional
one-time fees, one in the amount of $25 and one in the amount of $50, for
the issuance of the plate. The $25 fee is credited to the Colorado DRIVES
vehicle services account. Of the $50 fee, $25 is credited to the highway
users tax fund, and the remainder is credited to the agriculture

Be it enacted by the General Assembly of the State of Colorado:1
SECTION 1. In Colorado Revised Statutes, add 42-3-270 as2
follows:3
42-3-270.  Special plates - Colorado agriculture. (1)  O

ANUARY 1, 2025, OR WHEN THE DEPARTMENT IS ABLE TO ISSUE THE5
PLATES, THE DEPARTMENT SHALL ISSUE SPECIAL LICENSE PLATES TO6
QUALIFIED APPLICANTS IN ACCORDANCE WITH THIS SECTION FOR7
MOTORCYCLES, PASSENGER CARS, TRUCKS, OR NONCOMMERCIAL OR8
RECREATIONAL MOTOR VEHICLES THAT DO NOT EXCEED SIXTEEN9
THOUSAND POUNDS EMPTY WEIGHT .10

HERE IS ESTABLISHED THE COLORADO AGRICULTURE11
LICENSE PLATE.12

HE DEPARTMENT SHALL USE A DESIGN :13

ATTLEWOMEN, BUT THE DESIGN MUST CONFORM TO DEPARTMENT17
STANDARDS AND BE APPROVED BY THE DEPARTMENT .18

 PERSON MAY APPLY FOR A COLORADO AGRICULTURE LICENSE19
PLATE IF THE PERSON PAYS THE TAXES AND FEES REQUIRED UNDER THIS20
SECTION.21

HE AMOUNT OF THE TAXES AND FEES FOR SPECIAL LICENSE22
PLATES UNDER THIS SECTION IS THE SAME AS THE AMOUNT OF THE TAXES23
AND FEES FOR REGULAR MOTOR VEHICLE LICENSE PLATES ; EXCEPT THAT24
HB24-1369-2- THE DEPARTMENT SHALL COLLECT THE FEE SPECIFIED IN SECTION 42-3-3121
AND AN ADDITIONAL ONE-TIME FEE OF FIFTY DOLLARS FOR ISSUANCE OR2
REPLACEMENT OF THE LICENSE PLATE. THE DEPARTMENT SHALL TRANSMIT3
THE ADDITIONAL ONE-TIME FEE TO THE STATE TREASURER , WHO SHALL4
CREDIT TWENTY-FIVE DOLLARS OF THE FEE TO THE HIGHWAY USERS TAX5
FUND CREATED IN SECTION 43-4-201 AND THE REMAINDER OF THE FEE TO6
THE AGRICULTURE MANAGEMENT FUND CREATED IN SECTION 35-1-106.9.7

N APPLICANT MAY APPLY FOR PERSONALIZED COLORADO8
AGRICULTURE LICENSE PLATES. UPON PAYMENT OF THE ADDITIONAL FEE9
REQUIRED BY SECTION 42-3-211 (6)(a) FOR PERSONALIZED LICENSE10
PLATES, THE DEPARTMENT MAY ISSUE THE PLATES IF THE APPLICANT11
COMPLIES WITH SECTION 42-3-211. IF AN APPLICANT HAS EXISTING12
PERSONALIZED LICENSE PLATES FOR A MOTOR VEHICLE , THE APPLICANT13
MAY TRANSFER THE COMBINATION OF LETTERS OR NUMBERS TO A NEW SET14
OF COLORADO AGRICULTURE LICENSE PLATES FOR THE VEHICLE UPON15
PAYING THE FEE REQUIRED BY SECTION 42-3-211 (6)(a) AND UPON16
TURNING IN THE EXISTING PLATES TO THE DEPARTMENT . A PERSON WHO17
HAS OBTAINED PERSONALIZED LICENSE PLATES UNDER THIS SUBSECTION18

 MUST PAY THE ANNUAL FEE IMPOSED BY SECTION 42-3-211 (6)(b) TO19
RENEW THE PERSONALIZED PLATES. THE FEES UNDER THIS SUBSECTION (5)20
ARE IN ADDITION TO ALL OTHER APPLICABLE TAXES AND FEES .21
SECTION 2. In Colorado Revised Statutes, amend 42-3-312 as22
follows:23
42-3-312.  Special license plate surcharge. In addition to any24
other fee imposed by this article 3, an applicant for a special license plate25
created by rule in accordance with section 42-3-207, as the section existed26
when the plate was created, personalized plates issued under section27

-3- 42-3-211, or special license plates issued under sections 42-3-212 to1
42-3-214, sections 42-3-217 to 42-3-218, sections 42-3-221 to 42-3-234,2
sections 42-3-237 to 42-3-258, sections 42-3-260 to 42-3-265, 42-3-267,3
42-3-268, and section 42-3-269 AND SECTIONS 42-3-267 TO 42-3-2704
shall pay an issuance fee of twenty-five dollars; except that the fee is not5
imposed on special license plates exempted from additional fees for the6
issuance of a military special license plate by section 42-3-213 (1)(b)(II).7
The department shall transfer the money from the fee to the state8
treasurer, who shall credit it to the Colorado DRIVES vehicle services9
account created in section 42-1-211 (2).10
SECTION 3. In Colorado Revised Statutes, amend 35-1-106.911
as follows:12
35-1-106.9.  Agriculture management fund - creation.13
(1)  There is hereby created in the state treasury The agriculture14
management fund 
IS CREATED IN THE STATE TREASURY. The fund shall

consist CONSISTS of money transferred pursuant to section 38-13-801.516
(3), any money realized from the sale of the inspection and consumer17
services division facility and other real property associated with that18
facility that are all located in the Highlands neighborhood of Denver,19
Colorado, and any money realized from the sale of the warehouse and20
storage facility located at 5000 Packing House Road, Denver, Colorado21
SECTIONS 38-13-801.5 (3) AND 42-3-270.22
(2)  The department shall use such THE money to fund agricultural23
efforts approved by the commissioner, including but not limited to,24
funding additional department employees necessary to implement and25
manage approved programs. Money 
IN THE FUND may be used for direct26
assistance or grant assistance for conservation districts created pursuant27

-4- to article 70 of this title 35. Money in the fund may be used for expenses1
related to the department's office consolidation as authorized by House2
Bill 13-1234, enacted in 2013, and as authorized by House Bill 16-1460,3
enacted in 2016. THE MONEY TRANSFERRED TO THE FUND PURSUANT TO4
SECTION 42-3-270 MAY BE USED TO SUPPORT OR EXPAND MARKETING5
PROGRAMS DESIGNED TO HELP CONSUMERS , RESTAURANTS, AND6
RETAILERS IDENTIFY AND PURCHASE COLORADO AGRICULTURAL7
PRODUCTS.8
(3)  Money in the fund is subject to annual appropriation to the9
department. Any money not expended or encumbered from any10
appropriation at the end of any fiscal year shall remain REMAINS available11
for expenditure in the next fiscal year without further appropriation. All12
interest derived from the deposit and investment of money in the fund13
shall be credited to the fund and shall not be transferred or credited to the14
general fund or any other fund.15
SECTION 4. Act subject to petition - effective date. This act16
takes effect at 12:01 a.m. on the day following the expiration of the17
ninety-day period after final adjournment of the general assembly; except18
that, if a referendum petition is filed pursuant to section 1 (3) of article V19
of the state constitution against this act or an item, section, or part of this20
act within such period, then the act, item, section, or part will not take21
effect unless approved by the people at the general election to be held in22
November 2024 and, in such case, will take effect on the date of the23
official declaration of the vote thereon by the governor.24
