The bill creates the Colorado agriculture license plate. In addition to the normal fees for a license plate, a person must pay 2 additional one-time fees, one in the amount of $25 and one in the amount of $50, for the issuance of the plate. The $25 fee is credited to the Colorado DRIVES vehicle services account. Be it enacted by the General Assembly of the State of Colorado:1 SECTION 1. In Colorado Revised Statutes, add 42-3-270 as2 follows:3 42-3-270. Special plates - Colorado agriculture. (1) O N4 J ANUARY 1, 2025, OR WHEN THE DEPARTMENT IS ABLE TO ISSUE THE5 PLATES, THE DEPARTMENT SHALL ISSUE SPECIAL LICENSE PLATES TO6 QUALIFIED APPLICANTS IN ACCORDANCE WITH THIS SECTION FOR7 MOTORCYCLES, PASSENGER CARS, TRUCKS, OR NONCOMMERCIAL OR8 RECREATIONAL MOTOR VEHICLES THAT DO NOT EXCEED SIXTEEN9 THOUSAND POUNDS EMPTY WEIGHT .10 (2) (a) T HERE IS ESTABLISHED THE COLORADO AGRICULTURE11 LICENSE PLATE.12 (b) T HE DEPARTMENT SHALL USE A DESIGN :13 (I) T HAT INCLUDES A TAGLINE TO READ "FEEDING THE WORLD";14 AND15 (II) S UBMITTED BY OR DEVELOPED WITH THE LOGAN COUNTY16 C ATTLEWOMEN, BUT THE DESIGN MUST CONFORM TO DEPARTMENT17 STANDARDS AND BE APPROVED BY THE DEPARTMENT .18 (3) A PERSON MAY APPLY FOR A COLORADO AGRICULTURE LICENSE19 PLATE IF THE PERSON PAYS THE TAXES AND FEES REQUIRED UNDER THIS20 SECTION.21 (4) T HE AMOUNT OF THE TAXES AND FEES FOR SPECIAL LICENSE22 PLATES UNDER THIS SECTION IS THE SAME AS THE AMOUNT OF THE TAXES23 1369-2- AND FEES FOR REGULAR MOTOR VEHICLE LICENSE PLATES ; EXCEPT THAT1 THE DEPARTMENT SHALL COLLECT THE FEE SPECIFIED IN SECTION 42-3-3122 AND AN ADDITIONAL ONE-TIME FEE OF FIFTY DOLLARS FOR ISSUANCE OR3 REPLACEMENT OF THE LICENSE PLATE. THE DEPARTMENT SHALL TRANSMIT4 THE ADDITIONAL ONE-TIME FEE TO THE STATE TREASURER , WHO SHALL5 CREDIT TWENTY-FIVE DOLLARS OF THE FEE TO THE HIGHWAY USERS TAX6 FUND CREATED IN SECTION 43-4-201 AND THE REMAINDER OF THE FEE TO7 THE AGRICULTURE MANAGEMENT FUND CREATED IN SECTION 35-1-106.9.8 (5) A N APPLICANT MAY APPLY FOR PERSONALIZED COLORADO9 AGRICULTURE LICENSE PLATES. UPON PAYMENT OF THE ADDITIONAL FEE10 REQUIRED BY SECTION 42-3-211 (6)(a) FOR PERSONALIZED LICENSE11 PLATES, THE DEPARTMENT MAY ISSUE THE PLATES IF THE APPLICANT12 COMPLIES WITH SECTION 42-3-211. IF AN APPLICANT HAS EXISTING13 PERSONALIZED LICENSE PLATES FOR A MOTOR VEHICLE , THE APPLICANT14 MAY TRANSFER THE COMBINATION OF LETTERS OR NUMBERS TO A NEW SET15 OF COLORADO AGRICULTURE LICENSE PLATES FOR THE VEHICLE UPON16 PAYING THE FEE REQUIRED BY SECTION 42-3-211 (6)(a) AND UPON17 TURNING IN THE EXISTING PLATES TO THE DEPARTMENT . A PERSON WHO18 HAS OBTAINED PERSONALIZED LICENSE PLATES UNDER THIS SUBSECTION19 (5) MUST PAY THE ANNUAL FEE IMPOSED BY SECTION 42-3-211 (6)(b) TO20 RENEW THE PERSONALIZED PLATES. THE FEES UNDER THIS SUBSECTION (5)21 ARE IN ADDITION TO ALL OTHER APPLICABLE TAXES AND FEES .22 SECTION 2. In Colorado Revised Statutes, amend 42-3-312 as23 follows:24 42-3-312. Special license plate surcharge. In addition to any25 other fee imposed by this article 3, an applicant for a special license plate26 created by rule in accordance with section 42-3-207, as the section existed27 1369 -3- when the plate was created, personalized plates issued under section1 42-3-211, or special license plates issued under sections 42-3-212 to2 42-3-214, sections 42-3-217 to 42-3-218, sections 42-3-221 to 42-3-234,3 sections 42-3-237 to 42-3-258, sections 42-3-260 to 42-3-265, 42-3-267,4 42-3-268, and section 42-3-269 AND SECTIONS 42-3-267 TO 42-3-2705 shall pay an issuance fee of twenty-five dollars; except that the fee is not6 imposed on special license plates exempted from additional fees for the7 issuance of a military special license plate by section 42-3-213 (1)(b)(II).8 The department shall transfer the money from the fee to the state9 treasurer, who shall credit it to the Colorado DRIVES vehicle services10 account created in section 42-1-211 (2).11 SECTION 3. In Colorado Revised Statutes, amend 35-1-106.912 as follows:13 35-1-106.9. Agriculture management fund - creation.14 (1) There is hereby created in the state treasury The agriculture15 management fund IS CREATED IN THE STATE TREASURY. The fund shall 16 consist CONSISTS of money transferred pursuant to section 38-13-801.517 (3), any money realized from the sale of the inspection and consumer18 services division facility and other real property associated with that19 facility that are all located in the Highlands neighborhood of Denver,20 Colorado, and any money realized from the sale of the warehouse and21 storage facility located at 5000 Packing House Road, Denver, Colorado22 SECTIONS 38-13-801.5 (3) AND 42-3-270.23 (2) The department shall use such THE money to fund agricultural24 efforts approved by the commissioner, including but not limited to,25 funding additional department employees necessary to implement and26 manage approved programs. Money IN THE FUND may be used for direct27 1369 -4- assistance or grant assistance for conservation districts created pursuant1 to article 70 of this title 35. Money in the fund may be used for expenses2 related to the department's office consolidation as authorized by House3 Bill 13-1234, enacted in 2013, and as authorized by House Bill 16-1460,4 enacted in 2016. THE MONEY TRANSFERRED TO THE FUND PURSUANT TO5 SECTION 42-3-270 MAY BE USED TO SUPPORT OR EXPAND MARKETING6 PROGRAMS DESIGNED TO HELP CONSUMERS , RESTAURANTS, AND7 RETAILERS IDENTIFY AND PURCHASE COLORADO AGRICULTURAL8 PRODUCTS.9 (3) Money in the fund is subject to annual appropriation to the10 department. Any money not expended or encumbered from any11 appropriation at the end of any fiscal year shall remain REMAINS available12 for expenditure in the next fiscal year without further appropriation. All13 interest derived from the deposit and investment of money in the fund14 shall be credited to the fund and shall not be transferred or credited to the15 general fund or any other fund.16 SECTION 4. Appropriation. (1) For the 2024-25 state fiscal17 year, $15,775 is appropriated to the department of revenue. This18 appropriation is from the Colorado DRIVES vehicle services account in19 the highway users tax fund created in section 42-1-211 (2), C.R.S. To20 implement this act, the department may use this appropriation as follows:21 (a) $1,225 for use by the executive director's office for personal22 services related to administration and support; 23 (b) $1,782 for payments to OIT;24 (c) $864 for use by the division of motor vehicles for personal25 services related to vehicle services; and26 (d) $11,904 for DRIVES maintenance and support. 27 1369 -5- (2) For the 2024-25 state fiscal year, $17,431 is appropriated to the1 department of revenue for use by the division of motor vehicles. This2 appropriation is from the license plate cash fund created in section3 42-3-301 (1)(b), C.R.S. To implement this act, the division may use this4 appropriation for license plate ordering.5 SECTION 5. Act subject to petition - effective date. This act6 takes effect at 12:01 a.m. on the day following the expiration of the7 ninety-day period after final adjournment of the general assembly; except8 that, if a referendum petition is filed pursuant to section 1 (3) of article V9 of the state constitution against this act or an item, section, or part of this10 act within such period, then the act, item, section, or part will not take11 effect unless approved by the people at the general election to be held in12 November 2024 and, in such case, will take effect on the date of the13 official declaration of the vote thereon by the governor.14 1369 -6-
