The state received money from the federal coronavirus state fiscal recovery fund pursuant to the "American Rescue Plan Act of 2021" (ARPA money). ARPA money was deposited into the "American Rescue Plan Act of 2021" cash fund and then transferred to various cash funds (recipient funds) and appropriated for various programs. The bill requires the state treasurer to transfer specified amounts of ARPA money from specified recipient funds at the close of the 2023-24 state fiscal year to the "American Rescue Plan Act of 2021" cash fund. The bill requires the state treasurer to transfer money from the general fund to a new ARPA refinance state money cash fund. Money in the new ARPA refinance state money cash fund is transferred to the specified recipient funds. The bill requires the general assembly to appropriate ARPA money from the "American Rescue Plan Act of 2021" cash fund to state departments for personal services in fiscal year 2023-24. For fiscal year 2024-25, the general assembly shall appropriate the balance of the cash fund for personal services or for other purposes permitted under the "American Rescue Plan Act of 2021", and the money so appropriated must be expended on or before January 31, 2025. On December 1, 2024, any unspent and unobligated money in a recipient fund, other than money designated for personal services or operating costs that will be spent by January 31, 2025, reverts to the "American Rescue Plan Act of 2021" cash fund. The reverted money is continuously appropriated to any department designated by the governor for any purpose that was funded with general fund money in the general appropriations act for fiscal year 2024-25. After December 31, 2024, any ARPA money in a recipient fund that was obligated as of December 31, 2024, but not expended on an eligible activity at the conclusion of the appropriation reverts to the "American Rescue Plan Act of 2021" cash fund and is continuously appropriated to any department designated by the governor for any purpose for which a general fund appropriation was made in the general appropriation act for the state fiscal year in which the reversion occurred. The amount of general fund money appropriated in a line item in a general appropriations act is reduced by the amount of ARPA money appropriated pursuant to the bill's provisions that is spent for the line item. The bill repeals the requirement for a subrecipient to obligate ARPA money by November 30, 2024. The bill authorizes the state controller to take certain measures to implement the bill and ensure that ARPA money is expended within the time allowed by federal law. The governor and the state controller shall jointly submit a report to the joint budget committee, the speaker of the HB24-1466 -2- house of representatives, the minority leader of the house of representatives, the president of the senate, and the minority leader of the senate about the transfers in the bill and about spending ARPA money. The bill makes changes to various programs related to refinancing ARPA money, including clarifying spending and obligation deadlines for program money that is not ARPA money and exempting the use of state money from requirements for capitol construction projects that use federal money. The bill makes changes to appropriations. Be it enacted by the General Assembly of the State of Colorado:1 SECTION 1. Legislative declaration - legislative intent.2 (1) The general assembly finds and declares that:3 (a) The state received money from the federal government4 pursuant to the federal "American Rescue Plan Act of 2021" (ARPA5 money), and federal law requires that money to be obligated by December6 31, 2024, and spent by December 31, 2026;7 (b) ARPA money not obligated by December 31, 2024, must be8 returned to the federal government;9 (c) The state appropriated ARPA money for a number of programs10 and purposes, but appropriating money is not an obligation for the11 purposes of federal law; and12 (d) To preserve the greatest flexibility for the state after December13 31, 2024, and to ensure the uninterrupted implementation of programs, it14 is in the best interest of the state to spend ARPA money before December15 31, 2024, on eligible ARPA uses and substitute state funds for programs16 that extend beyond December 31, 2024, and on personal services, as17 permitted by federal law, before January 31, 2025.18 (2) It is the general assembly's intent that:19 (a) Most of the ARPA money appropriated for programs intended20 to be spent after December 31, 2024, be substituted with state money,21 HB24-1466-3- changing the source of program funds while maintaining funding for the1 programs;2 (b) This act does not change the requirements, timelines, or3 spending deadlines for any program; and4 (c) The exchanged ARPA money be spent on personal services5 retroactively in fiscal year 2023-24 and in the first half of fiscal year6 2024-25 so that all of the state's unobligated ARPA money will be spent7 by the end of 2024, ensuring compliance with federal deadlines.8 SECTION 2. In Colorado Revised Statutes, 24-75-226, amend9 (2), (4)(a), (4)(c)(I), (4)(d), (5)(b) introductory portion, and (5)(f); and10 add (1)(a.7), (1)(c.5), (3.5), (4.1), (4.2), (4.3), and (6.5) as follows:11 24-75-226. "American Rescue Plan Act of 2021" cash fund -12 creation - recipient funds - limitations - reporting - appropriations -13 reduction in general fund appropriations - report - legislative14 declaration - definitions - repeal. (1) As used in this section, unless the15 context otherwise requires:16 (a.7) "D ISCRETIONARY ACCOUNT " MEANS THE DISCRETIONARY17 ACCOUNT CREATED IN THE FUND IN SUBSECTION (4)(a)(II) OF THIS18 SECTION.19 (c.5) "P ERSONAL SERVICES" HAS THE SAME MEANING AS SET FORTH20 IN SECTION 24-75-112 (1)(m).21 (2) The "American Rescue Plan Act of 2021" cash fund is hereby22 created in the state treasury. The general assembly may transfer25 money in the fund to another cash fund that is established for the purpose26 of using the money from the federal coronavirus state fiscal recovery27 HB24-1466 -7- fund. Transfers from the fund to the general fund are prohibited. A1 DEPARTMENT SHALL NOT USE MONEY APPROPRIATED PURSUANT TO THIS2 SUBSECTION (4) FOR ANY PURPOSE PROHIBITED BY THE "AMERICAN3 R ESCUE PLAN ACT OF 2021". A DEPARTMENT SHALL COMPLY WITH ALL4 REQUIREMENTS SET FORTH IN THIS SECTION .5 (II) If there is any of the money transferred to the fund under6 subsection (3)(a) of this section remaining in the fund after any transfers7 from the fund required by bills enacted during the 2021 regular legislative8 session, then, of the remainder in the fund, the lesser of three hundred9 million dollars or the remainder IS PLACED IN THE DISCRETIONARY10 ACCOUNT, WHICH IS CREATED IN THE FUND , AND is continuously11 appropriated to any department designated by the governor for any12 allowable purpose under the "American Rescue Plan Act of 2021".13 (III) The money specified in subsection (3)(d) of this section IS14 PLACED IN THE DISCRETIONARY ACCOUNT AND is continuously15 appropriated to any department designated by the governor for any16 expenditures necessary to respond to the public health emergency with17 respect to COVID-19.18 (IV) F OR THE 2023-24 STATE FISCAL YEAR, THE GENERAL19 ASSEMBLY SHALL APPROPRIATE MONEY FROM THE FUND TO ANY20 DEPARTMENTS FOR PERSONAL SERVICES THAT WERE PAID FROM THE21 GENERAL FUND IN STATE FISCAL YEAR 2023-24.22 (V) F OR THE 2024-25 STATE FISCAL YEAR, THE GENERAL23 ASSEMBLY SHALL APPROPRIATE THE BALANCE OF THE FUND , EXCLUDING24 MONEY REMAINING IN THE DISCRETIONARY ACCOUNT . THE GENERAL25 ASSEMBLY MAY MAKE THE REQUIRED APPROPRIATIONS TO ANY26 DEPARTMENT FOR PERSONAL SERVICES AND FOR OTHER PURPOSES27 HB24-1466 -8- PERMITTED UNDER THE "AMERICAN RESCUE PLAN ACT OF 2021". ANY1 MONEY APPROPRIATED PURSUANT TO THIS SUBSECTION (4)(a)(V) MUST BE2 OBLIGATED AS REQUIRED IN SUBSECTION (4)(d) OF THIS SECTION AND3 EXPENDED ON OR BEFORE JANUARY 31, 2025.4 (c) (I) Notwithstanding any provision of law to the contrary, in5 order to ensure proper accounting for and compliance with the "American6 Rescue Plan Act of 2021", whenever money is transferred or appropriated7 to a recipient fund that also has money from other sources, the state8 controller or department controller shall create a companion cash fund9 that includes only the money the state received from the federal10 coronavirus state fiscal recovery fund under section 9901 of title IX,11 subtitle M of the "American Rescue Plan Act of 2021", but that is12 otherwise legally identical to the recipient fund, except as otherwise13 provided in subsection (4)(c)(II) of this section. T HE STATE CONTROLLER14 MAY PRESCRIBE PROCEDURES TO PERMIT CONTINUED USE OF COMPANION15 FUNDS, WITH PROPER SEGREGATION OF FUND SOURCES THROUGH16 COMPLETION OF A PROJECT, FOR ANY MONEY APPROPRIATED FOR A USE17 PERMITTED PURSUANT TO THE "AMERICAN RESCUE PLAN ACT OF 2021"18 THAT IS PARTIALLY REFINANCED.19 (d) (I) Money in the fund or a recipient fund THAT ORIGINATED20 FROM THE CORONAVIRUS STATE FISCAL RECOVERY FUND must be21 expended or obligated by December 31, 2024. Just prior to the close of22 business on December 30, 2024, any unexpended appropriations from a23 recipient fund THAT IS OF MONEY THAT ORIGINATED FROM THE24 CORONAVIRUS STATE FISCAL RECOVERY FUND AND THAT REMAINED IN THE25 RECIPIENT FUND AFTER THE REVERSION DESCRIBED IN SUBSECTION (4.2)26 OF THIS SECTION that are not for expenditures to be made after December27 HB24-1466 -9- 31, 2024, that were obligated before that date, revert to the "American1 Rescue Plan Act of 2021" cash fund, and the state treasurer shall transfer2 the unexpended and unobligated balance in the fund to the unemployment3 compensation fund created in section 8-77-101 (1). Any money THAT4 ORIGINATED FROM THE CORONAVIRUS STATE FISCAL RECOVERY FUND5 THAT IS obligated by December 31, 2024, must be expended by December6 31, 2026. Effective December 31, 2026, the state controller shall transmit7 any unexpended money in the fund or a recipient fund to the United8 States department of the treasury. M ONEY IN A RECIPIENT FUND THAT DID9 NOT ORIGINATE FROM THE CORONAVIRUS STATE FISCAL RECOVERY FUND10 MUST BE EXPENDED IN ACCORDANCE WITH ANY APPLICABLE LAW OR11 APPROPRIATION.12 (II) A subrecipient must spend or obligate money received from13 the fund or a recipient fund by November 30, 2024, and, by December 13,14 2024, shall notify the state agency from which the subrecipient received15 the money of the status of the money that is obligated or expended. The16 subrecipient shall return to the state any unexpended and unobligated17 money under terms dictated by the state controller, and the state treasurer18 shall transfer the amount returned to the unemployment compensation19 fund created in section 8-77-101 (1). Any money obligated by November20 30, 2024, must be expended by December 11, 2026. On or before21 December 11, 2026, the subrecipient shall return to the state any22 remaining money under terms dictated by the state controller and23 thereafter the state controller shall transmit the money to the United States24 department of the treasury in accordance with the treasury's requirements.25 (III) M ONEY IN THE FUND OR IN A RECIPIENT F UND THAT26 ORIGINATED FROM THE CORONAVIRUS STATE FISCAL RECOVERY FUND IS27 HB24-1466 -10- OBLIGATED WHEN IT IS OBLIGATED IN ACCORDANCE WITH THE "AMERICAN1 R ESCUE PLAN ACT OF 2021" AND ANY FEDERAL RULES PROMULGATED2 THEREUNDER. THE OBLIGATION CRITERIA IN THE "AMERICAN RESCUE3 P LAN ACT OF 2021" AND FEDERAL RULES DO NOT APPLY TO MONEY IN THE4 FUND OR IN A RECIPIENT FUND THAT DID NOT ORIGINATE FROM THE5 CORONAVIRUS STATE FISCAL RECOVERY FUND . MONEY THAT DID NOT6 ORIGINATE FROM THE CORONAVIRUS STATE FISCAL RECOVERY FUND THAT7 IS NOT OBLIGATED BY AN APPLICABLE DEADLINE IN STATE LAW DOES NOT8 REVERT AND REMAINS AVAILABLE FOR EXPENDITURE IN ACCOR DANCE9 WITH ANY APPLICABLE APPROPRIATION . The state controller shall10 determine whether money is obligated for purposes of determining the11 deadline for expenditures and the reversion or repayment of money in12 accordance with this subsection (4)(d).13 (4.1) (a) (I) E FFECTIVE JUNE 30, 2024, THE AMOUNT OF GENERAL14 FUND MONEY APPROPRIATED IN A LINE ITEM FOR PERSONAL SERVICES15 EXPENSES IN THE GENERAL APPROPRIATION ACT FOR STATE FISCAL YEAR16 2023-24, SENATE BILL 23-214, IS REDUCED BY THE AMOUNT OF FEDERAL17 FUNDS APPROPRIATED PURSUANT TO SUBSECTION (4)(a)(IV) OF THIS18 SECTION THAT WERE SPENT FOR PERSONAL SERVICES IN THE LINE ITEM .19 (II) E FFECTIVE NOVEMBER 30, 2024, THE AMOUNT OF GENERAL20 FUND MONEY APPROPRIATED IN A LINE ITEM FOR PERSONAL SERVICES21 EXPENSES IN THE GENERAL APPROPRIATION ACT FOR STATE FISCAL YEAR22 2024-25, HOUSE BILL 24-1430, IS REDUCED BY THE AMOUNT OF FEDERAL23 FUNDS APPROPRIATED PURSUANT TO SUBSECTION (4)(a)(V) OF THIS24 SECTION THAT WERE SPENT FOR PERSONAL SERVICES IN THE LINE ITEM .25 (b) T O THE EXTENT PERMITTED BY FEDERAL LAW , THE GOVERNOR26 AND A DEPARTMENT THAT IS APPROPRIATED MONEY THAT ORIGINATED27 HB24-1466 -11- FROM THE FUND SHALL SPEND THE MONEY FOR THE PURPOSE FOR WHICH1 IT IS APPROPRIATED BEFORE SPENDING MONEY FROM ANY OTHER SOURCE2 FOR THE SAME PURPOSE.3 (c) F OR THE PURPOSE OF BALANCING THE STATE BUDGET AS4 REQUIRED BY ARTICLE X OF THE STATE CONSTITUTION DURING THE 20245 REGULAR LEGISLATIVE SESSION , THE AMOUNTS APPROPRIATED IN THE6 GENERAL APPROPRIATION ACTS FOR STATE FISCAL YEAR 2023-24, SENATE7 B ILL 23-214, AND STATE FISCAL YEAR 2024-25, HOUSE BILL 24-1430, TO8 EACH DEPARTMENT FOR PERSONAL SERVICES IS REDUCED BY THE AMOUNT9 APPROPRIATED FROM THE FUND FOR THE DEPARTMENT 'S PERSONAL10 SERVICES FOR THE APPLICABLE STATE FISCAL YEAR .11 (4.2) (a) (I) O N DECEMBER 1, 2024, ANY UNSPENT AND12 UNOBLIGATED MONEY THAT ORIGINATED FROM THE CORONAVIRUS STATE13 FISCAL RECOVERY FUND, OTHER THAN MONEY DESIGNATED FOR PERS ONAL14 SERVICES OR OTHER OPERATING COSTS AS DESCRIBED IN SUBSECTION15 (4.2)(a)(II) OF THIS SECTION, THAT IS IN THE FUND, A RECIPIENT FUND, OR16 THE DISCRETIONARY ACCOUNT REVERTS TO THE FUND . MONEY THAT17 REVERTS TO THE FUND PURSUANT TO THIS SUBSECTION (4.2) IS18 CONTINUOUSLY APPROPRIATED UNTIL JANUARY 31, 2025, TO ANY19 DEPARTMENT DESIGNATED BY THE GOVERNOR FOR ANY PURPOSE FOR20 WHICH A GENERAL FUND APPROPRIATION WAS MADE IN THE GENERAL21 APPROPRIATION ACT FOR STATE FISCAL YEAR 2024-25, HOUSE BILL22 24-1430.23 (II) O N OR BEFORE NOVEMBER 30, 2024, THE OFFICE SHALL24 DETERMINE THE AMOUNT OF UNSPENT AND UNOBLIGATED MONEY IN THE25 FUND, A RECIPIENT FUND, OR THE DISCRETIONARY ACCOUNT THAT26 ORIGINATED FROM THE CORONAVIRUS STATE FISCAL RECOVERY FUND27 HB24-1466 -12- THAT WILL BE SPENT BY A DEPARTMENT FOR PERSONAL SERVICES AND1 OTHER OPERATING COSTS ON OR BEFORE JANUARY 31, 2025, AND SHALL2 REPORT THAT AMOUNT TO THE STATE CONTROLLER . PURSUANT TO3 SUBSECTION (4.2)(a)(I) OF THIS SECTION, MONEY DESIGNATED FOR4 PERSONAL SERVICES AND OTHER OPERATING COSTS REPORTED TO THE5 STATE CONTROLLER DOES NOT REVERT TO THE FUND ON DECEMBER 1,6 2024.7 (b) E FFECTIVE JANUARY 31, 2025, THE AMOUNT OF GENERAL FUND8 MONEY APPROPRIATED IN A LINE ITEM IN THE GENERAL APPROPRIATION9 ACT FOR STATE FISCAL YEAR 2024-25, HOUSE BILL 24-1430, IS REDUCED10 BY THE AMOUNT OF FEDERAL MONEY THAT ORIGINATED FROM THE11 CORONAVIRUS STATE FISCAL RECOVERY FUND APPROPRIATED PURSUANT12 TO SUBSECTION (4.2)(a) OF THIS SECTION AND THAT WAS SPENT FOR THE13 LINE ITEM.14 (4.3) (a) A FTER DECEMBER 31, 2024, ANY MONEY IN A RECIPIENT15 FUND THAT ORIGINATED FROM THE CORONAVIRUS STATE FISCAL16 RECOVERY FUND THAT WAS OBLIGATED AS OF DECEMBER 31, 2024, BUT17 NOT EXPENDED ON AN ELIGIBLE ACTIVITY AT THE CONCLUSION OF THE18 APPROPRIATION REVERTS TO THE FUND . MONEY THAT REVERTS TO THE19 FUND PURSUANT TO THIS SUBSECTION (4.3) IS CONTINUOUSLY20 APPROPRIATED THROUGH DECEMBER 31, 2026, TO ANY DEPARTMENT21 DESIGNATED BY THE GOVERNOR FOR ANY PURPOSE FOR WHICH A GENERAL22 FUND APPROPRIATION WAS MADE IN THE GENERAL APPROPRIATION ACT23 FOR THE STATE FISCAL YEAR IN WHICH THE REVERSION OCCURRED .24 (b) E FFECTIVE ON THE DATE OF THE APPLICABLE REVERSION , THE25 AMOUNT OF GENERAL FUND MONEY APPROPRIATED IN A LINE ITEM IN THE26 GENERAL APPROPRIATION ACT FOR THE STATE FISCAL YEAR IN WHICH THE27 HB24-1466 -13- REVERSION OCCURRED IS REDUCED BY THE AMOUNT OF FEDERAL MONEY1 THAT ORIGINATED FROM THE CORONAVIRUS STATE FISCAL RECOVERY2 FUND APPROPRIATED PURSUANT TO SUBSECTION (4.3)(a) OF THIS SECTION3 AND THAT WAS SPENT FOR THE LINE ITEM.4 (5) (b) The office and the state controller shall establish5 compliance requirements CONCERNING THE USE OF MONEY THAT6 ORIGINATED FROM THE CORONAVIRUS STATE FISCAL RECOVERY FUND for7 any department that receives an appropriation from the fund or a recipient8 fund or any person that receives money from a department. THE OFFICE9 AND THE STATE CONTROLLER MAY ESTABLISH COMPLIANCE10 REQUIREMENTS FOR MONEY THAT ORIGINATES FROM THE ARPA11 REFINANCE STATE MONEY CASH FUND CREATED IN SECTION 24-75-226.5.12 If a department or person fails to comply with these requirements, then:13 (f) The general assembly may appropriate money from the FUND14 OR THE revenue loss restoration cash fund created in section 24-75-22715 to the department of personnel for use by the state controller and to the16 office for any direct or indirect expenses related to the administration of17 this subsection (5).18 (6.5) (a) T HE GOVERNOR AND THE STATE CONTROLLER SHALL19 JOINTLY SUBMIT A REPORT TO THE JOINT BUDGET COMMITTEE , THE20 SPEAKER OF THE HOUSE OF REPRESENTATIVES , THE MINORITY LEADER OF21 THE HOUSE OF REPRESENTATIVES , THE PRESIDENT OF THE SENATE, AND22 THE MINORITY LEADER OF THE SENATE, AS DESCRIBED IN THIS SUBSECTION23 (6.5).24 (b) O N OR BEFORE SEPTEMBER 15, 2024, THE GOVERNOR AND25 STATE CONTROLLER SHALL SUBMIT A REPORT THAT INCLUDES :26 (I) T HE TOTAL EXPENDITURE BY THE STATE OF MONEY THAT27 HB24-1466 -14- ORIGINATED FROM THE CORONAVIRUS STATE FISCAL RECOVERY F UND AND1 RELATED ADJUSTMENTS TO THE GENERAL FUND , AS DESCRIBED IN2 SUBSECTION (4.1) OF THIS SECTION, INCLUDING THE AMOUNT EXPENDED3 FROM THE FUND BY EACH DEPARTMENT FOR PERSONAL SERVICES FOR THE4 2023-24 STATE FISCAL YEAR FROM THE MONEY APPROPRIATED PURSUANT5 TO SUBSECTION (4)(a)(IV) OF THIS SECTION; AND6 (II) A N EXPLANATION OF ANY FURTHER ACTIONS THAT THE7 GOVERNOR AND ANY STATE DEPARTMENT WILL TAKE TO ENSURE THAT8 MONEY THAT ORIGINATED FROM THE CORONAVIRUS STATE FISCAL9 RECOVERY FUND IS FULLY EXPENDED IN COMPLIANCE WITH THE10 "A MERICAN RESCUE PLAN ACT OF 2021".11 (c) O N OR BEFORE FEBRUARY 15, 2025, THE GOVERNOR AND THE12 STATE CONTROLLER SHALL SUBMIT A REPORT THAT INCLUDES UPDATED13 INFORMATION ABOUT EACH OF THE SUBJECTS REQUIRED IN THE REPORT14 DESCRIBED IN SUBSECTION (6.5)(b)(I) OF THIS SECTION AND ANY15 EXPENDITURE FROM THE FUND PURSUANT TO SUBSECTION (4.2) OF THIS16 SECTION, INCLUDING THE AMOUNT EXPENDED FROM THE FUND BY EACH17 DEPARTMENT AS OF DECEMBER 31, 2024.18 SECTION 3. In Colorado Revised Statutes, add 24-75-226.5 as19 follows:20 24-75-226.5. ARPA refinance state money cash fund - creation21 - reduction in general fund appropriations - legislative intent -22 definitions - repeal. (1) A S USED IN THIS SECTION, UNLESS THE CONTEXT23 OTHERWISE REQUIRES:24 (a) "A MERICAN RESCUE PLAN ACT OF 2021" MEANS THE FEDERAL25 "A MERICAN RESCUE PLAN ACT OF 2021", PUB.L. 117-2, AS THE ACT MAY26 BE SUBSEQUENTLY AMENDED .27 HB24-1466 -15- (b) "CASH FUND" MEANS THE ARPA REFINANCE STATE MONEY1 CASH FUND CREATED IN THIS SECTION.2 (c) "C OMPANION FUND" MEANS A COMPANION CASH FUND3 CREATED BY THE STATE CONTROLLER PURSUANT TO SECTION 24-75-2264 (4)(c) THAT IS ASSOCIATED WITH A CASH FUND AND THAT INCLUDES ONLY5 THE MONEY THE STATE RECEIVED FROM THE CORONAVIRUS STATE FISCAL6 RECOVERY FUND.7 (d) "C ORONAVIRUS STATE FISCAL RECOVERY FUND " HAS THE SAME8 MEANING AS SET FORTH IN SECTION 24-75-226 (1)(a.5).9 (e) "R EFINANCE DISCRETIONARY ACCOUNT " MEANS THE10 REFINANCE DISCRETIONARY ACCOUNT CREATED IN THE CASH FUND11 PURSUANT TO SUBSECTION (1)(c) OF THIS SECTION.12 (2) (a) T HE ARPA REFINANCE STATE MONEY CASH FUND IS13 CREATED IN THE STATE TREASURY. THE CASH FUND CONSISTS OF MONEY14 TRANSFERRED TO THE CASH FUND PURSUANT TO SUBSECTION (3) OF THIS15 SECTION AND ANY OTHER MONEY THAT THE GENERAL ASSEMBLY MAY16 APPROPRIATE OR TRANSFER TO THE CASH FUND .17 (b) I N ACCORDANCE WITH SECTION 24-36-114 (1), THE STATE18 TREASURER SHALL CREDIT ALL INTEREST AND INCOME DERIVED FROM THE19 DEPOSIT AND INVESTMENT OF MONEY IN THE CASH FUND TO THE GENERAL20 FUND.21 (c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n Colorado Revised Statutes, 24-75-109, amend16 (1)(f)(II); and add (1)(g) and (3.5) as follows:17 24-75-109. Controller may allow expenditures in excess of18 appropriations - limitations - appropriations for subsequent fiscal19 year restricted - repeal. (1) For the purpose of closing the state's books,20 and subject to the provisions of this section, the controller may, on or21 after May 1 of any fiscal year and before the forty-fifth day after the close22 thereof, upon approval of the governor, allow any department, institution,23 or agency of the state, including any institution of higher education, to24 make an expenditure in excess of the amount authorized by an item of25 appropriation for such fiscal year if:26 (f) The overexpenditure is by the department of education for27 HB24-1466 -20- either:1 (II) Distributing money to a participating school food authority to2 increase wages or provide stipends for individuals whom the participating3 school food authority employs to directly prepare and serve food for4 school meals, pursuant to section 22-82.9-206 (1); OR5 (g) T HE OVEREXPENDITURE IS OF MONEY THAT ORIGINATED FROM6 THE CORONAVIRUS STATE FISCAL RECOVERY FUND IN EXCESS OF THE7 AMOUNT AUTHORIZED BY AN ITEM OF APPROPRIATION OR THE AMOUNT IN8 A RECIPIENT FUND OR THE DISCRETIONARY ACCOUNT , AS EACH IS DEFINED9 IN SECTION 24-75-226, IN STATE FISCAL YEAR 2023-24 IF THE MONEY THAT10 FUNDED THE APPROPRIATION IS TRANSFERRED FROM THE RECIPIENT FUND11 OR DISCRETIONARY ACCOUNT TO THE "AMERICAN RESCUE PLAN ACT OF12 2021" CASH FUND PURSUANT TO SECTION 24-75-226 (3.5).13 (3.5) (a) N OTWITHSTANDING SUBSECTION (3) OF THIS SECTION, FOR14 AN OVEREXPENDITURE DESCRIBED IN SUBSECTION (1)(g) OF THIS SECTION,15 THE CONTROLLER SHALL RESTRICT , IN AN AMOUNT EQUAL TO SAID16 OVEREXPENDITURE, CORRESPONDING ITEMS OF APPROPRIATION MADE FOR17 THE FISCAL YEAR FOLLOWING THE FISCAL YEAR FOR WHICH THE18 OVEREXPENDITURE OCCURS , AS FOLLOWS:19 (I) A N APPROPRIATION FROM THE GENERAL FUND TO THE SAME20 DEPARTMENT FOR THE SAME PURPOSE OR , IF THERE IS NO APPROPRIATION21 FROM THE GENERAL FUND TO THE SAME DEPARTMENT FOR THE SAME22 PURPOSE, A CORRESPONDING ITEM OR ITEMS OF APPROPRIATION FROM THE23 GENERAL FUND, AS DESCRIBED IN SUBSECTION (3) OF THIS SECTION; AND24 (II) A N APPROPRIATION TO THE SAME DEPARTMENT FOR PERSONAL25 SERVICES MADE PURSUANT TO SECTION 24-75-226 (4)(a)(V), OR, IF THERE26 IS NO APPROPRIATION TO THE SAME DEPARTMENT FOR PERSONAL SERVICES27 HB24-1466 -21- MADE PURSUANT TO SECTION 24-75-226 (4)(a)(V), AN APPROPRIATION TO1 THE DEPARTMENT OF CORRECTIONS FOR PERSONAL SERVICES MADE2 PURSUANT TO SECTION 24-75-226 (4)(a)(V).3 (b) (I) T HE DEPARTMENT, INSTITUTION, OR AGENCY SHALL NOT BE4 ALLOWED TO EXPEND ANY AMOUNT RESTRICTED PURSUANT TO5 SUBSECTION (3.5)(a)(I) OF THIS SECTION. A DEPARTMENT THAT HAS AN6 APPROPRIATION RESTRICTED PURSUANT TO SUBSECTION (3.5)(a)(II) OF7 THIS SECTION MAY SUBMIT A REQUEST FOR A SUPPLEMENTAL8 APPROPRIATION FOR AN AMOUNT EQUAL TO THE AMOUNT RESTRICTED .9 (II) W HILE THE SUPPLEMENTAL APPROPRIATION PROCESS IS THE10 APPROPRIATE MEANS BY WHICH TO RESTORE FUNDING THAT WAS11 RESTRICTED PURSUANT TO THIS SUBSECTION (3.5), IT IS THE INTENT OF THE12 GENERAL ASSEMBLY THAT EACH DEPARTMENT RECEIVE THE FULL AMOUNT13 OF MONEY APPROPRIATED FOR A PROGRAM FOR WHICH AN14 OVEREXPENDITURE IS MADE PURSUANT TO SUBSECTION (1)(g) OF THIS15 SECTION OR FOR AN APPROPRIATION THAT IS RESTRICTED PURSUANT TO16 THIS SUBSECTION (3.5), THOUGH IT MAY BE NECESSARY TO ADJUST THE17 SOURCE OF THE MONEY THAT FUNDS THE APPROPRIATION .18 (c) O N OR BEFORE DECEMBER 31, 2024, THE STATE CONTROLLER19 SHALL REPORT TO THE JOINT BUDGET COMMITTEE INFORMATION ABOUT20 EACH OVEREXPENDITURE MADE PURSUANT TO SUBSECTION (1)(g) OF THIS21 SECTION AND EACH APPROPRIATION RESTRICTED PURSUANT TO THIS22 SUBSECTION (3.5).23 (d) T HIS SUBSECTION (3.5) IS REPEALED, EFFECTIVE JUNE 30, 2028.24 SECTION 5. In Colorado Revised Statutes, 24-75-201.1, amend25 (1)(d)(XXIII) as follows:26 24-75-201.1. Restriction on state appropriations - legislative27 HB24-1466 -22- declaration - definitions. (1) (d) For each fiscal year, unrestricted1 general fund year-end balances must be retained as a reserve in the2 following amounts:3 (XXIII) For the fiscal year 2022-23 and each fiscal year thereafter,4 fifteen percent of the amount appropriated for expenditure from the5 general fund for that fiscal year; EXCEPT THAT FOR THE 2023-24 AND6 2024-25 FISCAL YEARS, THE AMOUNT RETAINED AS A RESERVE MUST BE7 FIFTEEN PERCENT OF THE AMOUNT APPROPRIATED FOR EXPENDITURE FROM8 THE GENERAL FUND FOR THAT FISCAL YE AR PLUS FIFTEEN PERCENT OF THE9 AMOUNT APPROPRIATED FROM THE ARPA REFINANCE STATE MONEY CASH10 FUND CREATED IN SECTION 24-75-226.5 FOR THAT FISCAL YEAR.11 SECTION 6. In Colorado Revised Statutes, 24-30-202, add (4.3)12 as follows:13 24-30-202. Procedures - vouchers, warrants, and checks -14 rules - penalties - definitions - repeal. (4.3) (a) T HE CONTROLLER MAY15 RETROACTIVELY ADJUST ENCUMBRANCES AGAINST APPROPRIATIONS FOR16 CONTRACTS AND GRANTS AUTHORIZED PURSUANT TO THE AUTHORITY TO17 SPEND MONEY FROM THE "AMERICAN RESCUE PLAN ACT OF 2021" CASH18 FUND, CREATED IN SECTION 24-75-226 (4)(a)(II), IF THE FUNDING SOURCE19 FOR THE CONTRACT OR GRANT IS SUBSEQUENTLY REFINANCED . ANY20 RETROACTIVE CONTRACT OR GRANT ENCUMBRANCE ADJUSTMENTS21 BETWEEN FUNDING SOURCES AUTHORIZED IN THIS SECTION ARE NOT22 PERMITTED TO INCREASE THE TOTAL ENCUMBRANCE .23 (b) T HIS SUBSECTION (4.3) IS REPEALED, EFFECTIVE JULY 1, 2027.24 SECTION 7. In Colorado Revised Statutes, 24-75-227, amend25 (2)(a) and (3)(a); and add (3.9) as follows:26 24-75-227. Revenue loss restoration cash fund - creation -27 HB24-1466 -23- allowable uses - definitions - repeal. (2) (a) The revenue loss1 restoration cash fund is created in the state treasury. The fund consists of2 money credited to the fund in accordance with subsection (2)(b) of this3 section and section 24-75-229 (4)(b) AND ANY OTHER MONEY THAT THE4 GENERAL ASSEMBLY MAY APPROPRIATE OR TRANSFER TO THE FUND .5 Subject to the limitations set forth in subsection (3) of this section, the6 general assembly may appropriate money from the fund to a department7 for the provision of government services, including kindergarten through8 twelfth grade public education, housing, state employees, asset9 maintenance, seniors, criminal justice, state parks, agriculture, and10 transportation infrastructure. The general assembly may transfer money11 from the fund to another cash fund to be used for the provision of such12 government services.13 (3) (a) The total amount that the general assembly appropriates or14 transfers from the fund shall not exceed:15 (I) Three hundred fifty-seven million dollars for the fiscal year16 2021-22; AND17 (II) Three hundred thirty-three million dollars for the fiscal year18 2022-23. and 19 (III) Three hundred ten million dollars for the fiscal year 2023-24.20 (3.9) P URSUANT TO SECTION 24-75-226.5 (6), ON DECEMBER 31,21 2026, THE STATE TREASURER SHALL TRANSFER ANY UNEXPENDED AND22 UNENCUMBERED MONEY IN THE FUND THAT ORIGINATES FROM THE ARPA23 REFINANCE STATE MONEY CASH FUND TO THE ARPA REFINANCE STATE24 MONEY CASH FUND.25 SECTION 8. In Colorado Revised Statutes, 24-75-228, amend26 (4); and add (2.5)(d) and (5.8) as follows:27 HB24-1466 -24- 24-75-228. Economic recovery and relief cash fund - creation1 - allowable uses - interim task force - report - legislative declaration2 - definitions - repeal. (2.5) (d) A NY MONEY THAT ORIGINATES FROM THE3 ARPA REFINANCE STATE MONEY CASH FUND THAT IS TRANSFERRED TO A4 FUND PURSUANT TO SECTION 24-75-226.5 TO REFINANCE MONEY THAT5 WAS TRANSFERRED FROM THE ECONOMIC RECOVERY AND RELIEF CASH6 FUND PURSUANT TO THIS SUBSECTION (2.5) MUST BE SPENT FOR THE SAME7 PURPOSE AS THE REFINANCED MONEY AS SET FORTH IN SUBSECTION8 (2.5)(a) OF THIS SECTION.9 (4) A department may expend money THAT ORIGINATES FROM10 MONEY THE STATE RECEIVED FROM THE FEDERAL CORONAVIRUS STATE11 FISCAL RECOVERY FUND THAT IS appropriated or transferred from the fund12 for purposes permitted under the "American Rescue Plan Act of 2021"13 and shall not use the money for any purpose prohibited by the act. A14 department or any person who receives money from the fund shall comply15 with any requirements set forth in section 24-75-226.16 (5.8) P URSUANT TO SECTION 24-75-226.5 (6), ON DECEMBER 31,17 2026, THE STATE TREASURER SHALL TRANSFER ANY UNEXPENDED AND18 UNENCUMBERED MONEY IN THE FUND THAT ORIGINATES FROM THE ARPA19 REFINANCE STATE MONEY CASH FUND TO THE ARPA REFINANCE STATE20 MONEY CASH FUND.21 SECTION 9. In Colorado Revised Statutes, 24-75-229, amend22 (5); and add (6.8) as follows:23 24-75-229. Affordable housing and home ownership cash fund24 - creation - allowable uses - task force - legislative declaration -25 definitions - repeal. (5) A department may expend money THAT26 ORIGINATES FROM MONEY THE STATE RECEIVED FROM THE FEDERAL27 HB24-1466 -25- CORONAVIRUS STATE FISCAL RECOVERY FUND THAT IS appropriated from1 the fund for purposes permitted under the "American Rescue Plan Act of2 2021" and shall not use the money for any purpose prohibited by the act.3 A department, nonprofit organization, or local government, including a4 county, municipality, special district, or school district, or any other5 person who receives money from the fund shall comply with any6 requirements set forth in section 24-75-226.7 (6.8) P URSUANT TO SECTION 24-75-226.5 (6), ON DECEMBER 31,8 2026, THE STATE TREASURER SHALL TRANSFER ANY UNEXPENDED AND9 UNENCUMBERED MONEY IN THE FUND THAT ORIGINATES FROM THE ARPA10 REFINANCE STATE MONEY CASH FUND TO THE ARPA REFINANCE STATE11 MONEY CASH FUND.12 SECTION 10. In Colorado Revised Statutes, 24-75-230, amend13 (3); and add (4.8) as follows:14 24-75-230. Behavioral and mental health cash fund - creation15 - allowable uses - task force - definitions - repeal. (3) A department16 may expend money THAT ORIGINATES FROM MONEY THE STATE RECEIVED17 FROM THE FEDERAL CORONAVIRUS STATE FISCAL RECOVERY FUND THAT18 IS appropriated from the fund for purposes permitted under the "American19 Rescue Plan Act of 2021" Pub.L. 117-2, as the act may be subsequently20 amended, and shall not use the money for any purpose prohibited by the21 act. A department or any person who receives money from the fund shall22 comply with any requirements set forth in section 24-75-226. 23 (4.8) P URSUANT TO SECTION 24-75-226.5 (6), ON DECEMBER 31,24 2026, THE STATE TREASURER SHALL TRANSFER ANY UNEXPENDED AND25 UNENCUMBERED MONEY IN THE FUND THAT ORIGINATES FROM THE ARPA26 REFINANCE STATE MONEY CASH FUND TO THE ARPA REFINANCE STATE27 HB24-1466 -26- MONEY CASH FUND.1 SECTION 11. In Colorado Revised Statutes, 24-75-231, amend2 (3); and add (3.8) as follows:3 24-75-231. Workers, employers, and workforce centers cash4 fund - creation - allowable uses - definitions - repeal. (3) A5 department may expend money THAT ORIGINATES FROM MONEY THE6 STATE RECEIVED FROM THE FEDERAL CORONAVIRUS STATE FISCAL7 RECOVERY FUND THAT IS appropriated from the fund for purposes8 permitted under the "American Rescue Plan Act of 2021" and shall not9 use the money for any purpose prohibited by that act. A department or any10 person who receives money from the fund shall comply with any11 requirements set forth in section 24-75-226.12 (3.8) P URSUANT TO SECTION 24-75-226.5 (6), ON DECEMBER 31,13 2026, THE STATE TREASURER SHALL TRANSFER ANY UNEXPENDED AND14 UNENCUMBERED MONEY IN THE FUND THAT ORIGINATES FROM THE ARPA15 REFINANCE STATE MONEY CASH FUND TO THE ARPA REFINANCE STATE16 MONEY CASH FUND.17 SECTION 12. In Colorado Revised Statutes, 13-32-114, amend18 (4) as follows:19 13-32-114. Judicial department information technology cash20 fund - creation - uses. (4) In addition to the money deposited in the fund21 pursuant to subsection (1) of this section, the fund consists of money22 transferred to the fund from the revenue loss restoration cash fund23 pursuant to section 24-75-227 (3.5) AND MONEY TRANSFERRED TO THE24 FUND FROM THE ARPA REFINANCE STATE MONEY CASH FUND PURSUANT25 TO SECTION 24-75-226.5. Such transferred money is subject to annual26 appropriation by the general assembly to the judicial department for27 HB24-1466 -27- information technology infrastructure upgrades from the 2022-23 fiscal1 year through the 2024-25 fiscal year; except that all such transferred2 money THAT ORIGINATES FROM MONEY THE STATE RECEIVED FROM THE3 FEDERAL CORONAVIRUS STATE FISCAL RECOVERY FUND must be expended4 or encumbered OBLIGATED by the judicial department prior to December5 31, 2024.6 SECTION 13. In Colorado Revised Statutes, 23-3.9-302, amend7 (4)(b) as follows:8 23-3.9-302. Student educator stipend program - created -9 guidelines - definition - repeal. (4) (b) The department or the stipend10 recipients shall spend or obligate any money received pursuant to this11 subsection (4) by December 30, 2024. Any money obligated by December12 31, 2024, must be expended by December 31, 2026 IN ACCORDANCE WITH13 SECTION 24-75-226 (4)(d).14 SECTION 14. In Colorado Revised Statutes, 23-3.9-303, amend15 (4)(b) as follows:16 23-3.9-303. Educator test stipend program - created -17 guidelines - repeal. (4) (b) The department or the stipend recipient shall18 spend or obligate any stipend money received pursuant to this subsection19 (4) by December 30, 2024. Any money obligated by December 31, 2024,20 must be expended by December 31, 2026 IN ACCORDANCE WITH SECTION21 24-75-226 (4)(d).22 SECTION 15. In Colorado Revised Statutes, 23-3.9-402, amend23 (1)(b) as follows:24 23-3.9-402. Temporary educator loan forgiveness program -25 administration - eligibility. (1) (b) The general assembly shall26 appropriate to the commission ten million dollars from the economic27 HB24-1466 -28- recovery and relief cash fund created pursuant to section 24-75-228 to1 fund the temporary educator loan forgiveness program. The commission2 or a loan forgiveness recipient shall spend or obligate any money received3 pursuant to this section by December 30, 2024. Any money obligated by4 December 31, 2024, must be expended by December 31, 2026 IN5 ACCORDANCE WITH SECTION 24-75-226 (4)(d).6 SECTION 16. In Colorado Revised Statutes, 24-32-104, amend7 (7)(c) and (7)(d) introductory portion as follows:8 24-32-104. Functions of the division - interconnectivity grant9 program - interconnectivity grant program fund - reporting -10 definition. (7) (c) The interconnectivity grant program fund is hereby11 created in the state treasury and consists of money the state received from12 the federal coronavirus state fiscal recovery fund created in the federal13 "American Rescue Plan Act of 2021", Pub.L. 117-2; MONEY14 TRANSFERRED TO THE FUND FROM THE ARPA REFINANCE STATE MONEY15 CASH FUND PURSUANT TO SECTION 24-75-226.5; and any money that the16 general assembly may appropriate TO THE FUND. Within three days after17 June 28, 2021, the state treasurer shall transfer five million dollars from18 the economic recovery and relief cash fund created in section 24-75-22819 (2)(a) to the fund for use by the division for the purpose of reviewing and20 awarding grants under the grant program. The money in the fund is21 subject to appropriation by the general assembly.22 (d) With respect to grants awarded from money transferred to the23 interconnectivity grant program fund from the economic recovery and24 relief cash fund created in section 24-75-228 (2)(a) OR FROM THE ARPA25 REFINANCE STATE MONEY CASH FUND CREATED IN SECTION 24-75-226.5,26 grants may only be awarded for broadband projects that, pursuant to27 HB24-1466 -29- treasury department interim regulations implementing the federal1 "American Rescue Plan Act of 2021", Pub.L. 117-2, provide broadband2 infrastructure that is designed to provide service to unserved or3 underserved households and businesses and that is designed to, upon4 completion:5 SECTION 17. In Colorado Revised Statutes, 24-32-721, amend6 (1) as follows:7 24-32-721. Colorado affordable housing construction grants8 and loans - housing development grant fund - creation - housing9 assistance for persons with behavioral, mental health, or substance10 use disorders - cash fund - appropriation - report to general assembly11 - rules - definitions - repeal. (1) There is created in the state treasury the12 housing development grant fund, which fund is administered by the13 division and is referred to in this section as the "fund". The fund consists14 of money credited to the fund in accordance with section 39-26-12315 (3)(b); money transferred to the fund in accordance with section16 24-22-118 (2); MONEY TRANSFERRED TO THE FUND FROM THE ARPA17 REFINANCE STATE MONEY CASH FUND PURSUANT TO SECTION 24-75-226.5;18 money appropriated to the fund by the general assembly; all money19 transferred to the fund from the marijuana tax cash fund created in section20 39-28.8-501 (1) and any other cash fund maintained by the state; all21 money transferred to the fund from the general fund and the revenue loss22 restoration cash fund created in section 24-75-227 (2) pursuant to23 subsections (6) and (7) of this section; all money collected by the division24 for purposes of this section from federal grants, from other contributions,25 gifts, grants, and donations received from any other organization, entity,26 or individual, public or private; and from any fees or interest earned on27 HB24-1466 -30- such money. The division is authorized and directed to solicit, accept,1 expend, and disburse all money collected for the fund from the sources2 specified in this subsection (1) for the purpose of making grants, loans,3 or other forms of assistance that may be awarded under section4 24-32-721.7 and for program administration as provided in this section.5 All such money must be transmitted to the state treasurer to be credited6 to the fund. The money in the fund is continuously appropriated to the7 division for the purposes of this section.8 SECTION 18. In Colorado Revised Statutes, 24-32-729, amend9 (4)(b) as follows:10 24-32-729. Transformational affordable housing through local11 investments - grant program - investments eligible for funding -12 report - definitions - repeal. (4) Funds. (b) The state treasurer shall13 credit all interest and income derived from the investment and deposit of14 money in the fund to the fund. Except as otherwise required by this15 subsection (4)(b), all money not expended or encumbered, and all interest16 earned on the investment or deposit of money in the fund, must remain in17 the fund and shall not revert to the general fund or any other fund at the18 end of any fiscal year. The money in the fund is continuously19 appropriated to the division for the purposes of this section. Any money20 in the fund THAT ORIGINATES FROM THE MONEY THE STATE RECEIVED21 FROM THE CORONAVIRUS STATE FISCAL RECOVERY FUND that is not22 expended or obligated by December 30, 2024, reverts to the "American23 Rescue Plan Act of 2021" cash fund created in section 24-75-226 (2) in24 accordance with section 24-75-226 (4)(d).25 SECTION 19. In Colorado Revised Statutes, 24-32-732, amend26 (5)(a), (5)(d) introductory portion, and (5)(f) as follows:27 HB24-1466 -31- 24-32-732. Connecting Coloradans experiencing homelessness1 with services, recovery care, and housing supports grant program -2 funding - report - definitions - repeal. (5) Connecting Coloradans3 experiencing homelessness with services, recovery care, and housing4 supports fund - transfer of money to the fund - appropriation.5 (a) The connecting Coloradans experiencing homelessness with services,6 recovery care, and housing supports fund is created in the department.7 The fund consists of money transferred to the fund in accordance with8 subsection (5)(d) of this section; MONEY TRANSFERRED TO THE FUND9 FROM THE ARPA REFINANCE STATE MONEY CASH FUND PURS UANT TO10 SECTION 24-75-226.5; money appropriated to the fund by the general11 assembly; and any gifts, grants, or donations from any public or private12 sources, including governmental entities, that the division is authorized13 to seek and accept.14 (d) Within three business days of May 31, 2022, the state treasurer15 shall transfer one hundred five million dollars from the economic16 recovery and relief cash fund created in section 24-75-228 that originates17 from the money the state received from the federal coronavirus state18 fiscal recovery fund to the fund for the purpose of implementing this19 section. The department shall only use the money transferred pursuant to20 this subsection (5)(d), AND ANY MONEY TRANSFERRED TO THE FUND THAT21 ORIGINATES FROM THE ARPA REFINANCE STATE MONEY CASH FUND THAT22 IS SUBSTITUTED FOR MONEY TRANSFERRED FROM THE ECONOMIC23 RECOVERY AND RELIEF CASH FUND PURSUANT TO THIS SUBSECTION (5)(d),24 for:25 (f) Money spent pursuant to this subsection (5)(f) SUBSECTION (5)26 must conform with the allowable purposes set forth in the federal27 HB24-1466 -32- "American Rescue Plan Act of 2021", Pub.L. 117-2, as amended. The1 division shall spend or obligate such appropriation prior to December 30,2 2024, and expend the appropriation on or before December 31, 2026 IN3 ACCORDANCE WITH SECTION 24-75-226 (4)(d).4 SECTION 20. In Colorado Revised Statutes, 24-32-3207, amend5 (6)(b) as follows:6 24-32-3207. Colorado heritage communities fund - creation -7 source of funds. (6) (b) The division of local government in the8 department shall use the money transferred pursuant to subsection (6)(a)9 of this section, AND ANY MONEY THAT IS TRANSFERRED FROM THE ARPA10 REFINANCE STATE MONEY CASH FUND TO THE COLORADO HERITAGE11 COMMUNITIES FUND PURS UANT TO SECTION 24-75-226.5 TO REFINANCE12 MONEY THAT WAS TRANSFERRED TO THE COLORADO HERITAGE13 COMMUNITIES FUND PURSUANT TO SUBSECTION (6)(a)(I) OF THIS SECTION,14 for the creation, implementation, and administration of the local15 government affordable housing development incentives grant program16 created in section 24-32-130 (2) in accordance with the requirements of17 section 24-32-130.18 SECTION 21. In Colorado Revised Statutes, 24-33.5-532,19 amend (4) as follows:20 24-33.5-532. Behavioral health information and data-sharing21 in the criminal justice system - grants - appropriation - repeal.22 (4) For the 2022-23 state fiscal year, the general assembly shall23 appropriate three million five hundred thousand dollars from the24 behavioral and mental health cash fund created in section 24-75-230 to25 the department for the purposes of this section. Any money remaining at26 the end of the 2022-23 state fiscal year from this appropriation is further27 HB24-1466 -33- appropriated to the department for the purposes of this section. Any1 money that is not expended or obligated by December 30, 2024, reverts2 to the "American Rescue Plan Act of 2021" cash fund created in section3 24-75-226 (2) THE DEPARTMENT SHALL OBLIGATE AND SPEND THE MONEY4 RECEIVED PURSUANT TO THIS SUBSECTION (4) in accordance with section5 24-75-226 (4)(d). Any money obligated by December 30, 2024, must be6 expended by December 31, 2026.7 SECTION 22. In Colorado Revised Statutes, 24-37.5-904,8 amend (1.5)(f)(II) and (2)(a) as follows:9 24-37.5-904. Digital inclusion grant program - income-eligible10 household reimbursement program - creation - award criteria -11 digital inclusion grant program fund - definition - reporting - repeal.12 (1.5) (f) (II) All money used for implementation of the program must be13 obligated by December 31, 2024. AND SPENT IN ACCORDANCE WITH14 SECTION 24-75-226 (4)(d).15 (2) (a) The digital inclusion grant program fund is hereby created16 in the state treasury and consists of money the state received from the17 federal coronavirus state fiscal recovery fund created in the federal18 "American Rescue Plan Act of 2021", Pub.L. 117-2; MONEY19 TRANSFERRED TO THE FUND FROM THE ARPA REFINANCE STATE MONEY20 CASH FUND PURSUANT TO SECTION 24-75-226.5; and any money that the21 general assembly may appropriate TO THE FUND. Within three days after22 June 28, 2021, the state treasurer shall transfer thirty-five million dollars23 from the economic recovery and relief cash fund created in section24 24-75-228 (2)(a) to the fund for use by the broadband office for the25 purpose of reviewing and awarding grants under the grant program. The26 money in the fund is subject to appropriation by the general assembly.27 HB24-1466 -34- SECTION 23. In Colorado Revised Statutes, 24-46.3-704,1 amend (2)(d) as follows:2 24-46.3-704. Work force innovation grant program - creation3 - local boards to administer - eligibility for grants - use of grants -4 grant proposal requirements - other innovation activities performed5 by local boards - reporting to statewide database. (2) (d) All grants6 awarded pursuant to this section must be obligated by December 31,7 2024, and expended by December 31, 2026 AND SPENT IN ACCORDANCE8 WITH SECTION 24-75-226 (4)(d).9 SECTION 24. In Colorado Revised Statutes, 24-48.5-406,10 amend (1)(a) introductory portion as follows:11 24-48.5-406. Regional talent development initiative grant12 program fund. (1) (a) There is created in the state treasury the regional13 talent development initiative grant program fund. T HE FUND CONSISTS OF14 MONEY TRANSFERRED TO THE FUND PURSUANT TO THIS SUBSECTION (1)15 AND MONEY TRANSFERRED TO THE FUND FROM THE ARPA REFINANCE16 STATE MONEY CASH FUND PURSUANT TO SECTION 24-75-226.5. Three days17 after May 26, 2022, the state treasurer shall transfer ninety-one million18 dollars from the workers, employers, and workforce centers cash fund19 created in section 24-75-231 (2)(a) to the fund as follows:20 SECTION 25. In Colorado Revised Statutes, 24-75-219, amend21 (7)(a)(I) as follows:22 24-75-219. Transfers - transportation - capital construction -23 definitions - repeal. (7) In addition to any other transfers required by this24 section:25 (a) On June 30, 2021, from the money that the state received from26 either the federal coronavirus state fiscal recovery fund under section27 HB24-1466 -35- 9901 of title IX, subtitle M of the federal "American Rescue Plan Act of1 2021", Pub.L. 117-2, which is eligible to be used as specified in section2 602 (c)(I)(C) of said section 9901, or from the general fund, as specified,3 the state treasurer shall transfer:4 (I) One hundred eighty-two million one hundred sixty thousand5 dollars from money the state received from the federal coronavirus state6 fiscal recovery fund to the state highway fund. Of this amount,7 twenty-two million one hundred sixty thousand dollars is for the purpose8 of providing additional funding for the revitalizing main streets program9 and five hundred thousand dollars is for the purpose of acquiring,10 planning the development of, or developing the Burnham Yard rail11 property in Denver. A NY MONEY THAT IS TRANSFERRED FROM THE ARPA12 REFINANCE STATE MONEY CASH FUND TO THE STATE HIGHWAY FUND13 PURSUANT TO SECTION 24-75-226.5 TO REFINANCE MONEY THAT WAS14 TRANSFERRED TO THE STATE HIGHWAY FUND PURSUANT TO THIS15 SUBSECTION (7)(a)(I) MUST BE SPENT FOR THE SAME PURPOSES AS THE16 REFINANCED MONEY, AS SET FORTH IN THIS SUBSECTION (7)(a)(I).17 SECTION 26. In Colorado Revised Statutes, 25-1.5-102, amend18 (1)(e) as follows:19 25-1.5-102. Epidemic and communicable diseases - powers and20 duties of department - rules - definitions. (1) The department has, in21 addition to all other powers and duties imposed upon it by law, the22 powers and duties provided in this section as follows:23 (e) For fiscal year 2022-23, the general assembly shall appropriate24 ten million dollars from the economic recovery and relief cash fund25 created in section 24-75-228 to the department. The department shall use26 this appropriation for recruitment and re-engagement efforts of workers27 HB24-1466 -36- in the health-care profession with current or expired licenses and staffing.1 Any money remaining at the end of the 2022-23 state fiscal year from this2 appropriation is further appropriated to the department for the purposes3 of this section. Any money that is not expended or obligated by December4 30, 2024, reverts to the "American Rescue Plan Act of 2021" cash fund5 created in section 24-75-226 (2) THE DEPARTMENT SHALL OBLIGATE AND6 SPEND THE MONEY RECEIVED PURSUANT TO THIS SUBSECTION (1)(e) in7 accordance with section 24-75-226 (4)(d). Any money obligated by8 December 30, 2024, must be expended by December 31, 2026.9 SECTION 27. In Colorado Revised Statutes, 25-1.5-406, amend10 (9) as follows:11 25-1.5-406. School nurse grant program - creation - eligibility12 - award of grants - rules - report - legislative declaration - definitions.13 (9) The general assembly shall appropriate three million dollars from the14 economic recovery and relief cash fund created in section 24-75-228 to15 the department for the grant program. Any money remaining at the end of16 the 2022-23 state fiscal year from this appropriation is further17 appropriated to the department for the purposes of this section. Any18 money that is not expended or obligated by December 30, 2024, reverts19 to the "American Rescue Plan Act of 2021" cash fund created in section20 24-75-226 (2) THE DEPARTMENT SHALL OBLIGATE AND SPEND THE MONEY21 RECEIVED PURSUANT TO THIS SUBSECTION (9) in accordance with section22 24-75-226 (4)(d). Any money obligated by December 30, 2024, must be23 expended by December 31, 2026.24 SECTION 28. In Colorado Revised Statutes, 25.5-1-207, amend25 (2)(d) as follows:26 25.5-1-207. Rural provider access and affordability stimulus27 HB24-1466 -37- grant program - advisory committee - fund - reporting - rules -1 definitions - repeal. (2) Grant program - permissible uses of grant2 money. (d) To be eligible to receive grant money THAT ORIGINATES3 FROM THE MONEY THE STATE RECEIVED FROM THE CORONAVIRUS STATE4 FISCAL RECOVERY FUND for a capital expenditure, a grant recipient must5 submit to the state department a written justification as set forth in 316 CFR 35.6 (b)(4) for the capital expenditure; except that this requirement7 does not apply if the state department determines that the written8 justification is not required based on how the expenditures authorized9 under this section will be reported to the United States department of the10 treasury. F OR GRANT MONEY THAT DOES NOT ORIGINATE FROM THE11 MONEY THE STATE RECEIVED FROM THE CORONAVIRUS STATE FISCAL12 RECOVERY FUND, A WRITTEN JUSTIFICATION IS NOT REQUIRED, EXCEPT AS13 THE STATE DEPARTMENT DETERMINES NECESSARY TO COMPLY WITH14 FEDERAL WRITTEN JUSTIFICATION REQUIREMENTS .15 SECTION 29. The department shall either spend or obligate1 such appropriation prior to December 30, 2024, and expend the2 appropriation on or before December 31, 2026 IN ACCORDANCE WITH3 SECTION 24-75-226 (4)(d).4 SECTION 35. Behavioral health crisis response system - services17 - request for proposals - criteria - reporting - rules - definitions -18 repeal. (1.5) (b) (II) T HE USE OF money spent APPROPRIATED pursuant to19 this subsection (1.5) AND MONEY THAT ORIGINATES FROM THE ARPA20 REFINANCE STATE MONEY CASH FUND , CREATED IN SECTION 24-75-226.5,21 APPROPRIATED FOR THE SAME PURPOSE , must conform with the allowable22 purposes set forth in the federal "American Rescue Plan Act of 2021",23 Pub.L. 117-2, as the act may be subsequently amended. The state24 department shall either spend or obligate such appropriation prior to25 December 30, 2024, and expend the appropriation on or before December26 31, 2026 IN ACCORDANCE WITH SECTION 24-75-226 (4)(d).27 HB24-1466 -41- SECTION 37. In Colorado Revised Statutes, 27-60-114, amend1 (8) and (11) as follows:2 27-60-114. Colorado land-based tribe behavioral health3 services grant - creation - funding - definitions - repeal. (8) To be4 eligible to receive a grant, a grant applicant THAT REQUESTS GRANT5 MONEY THAT ORIGINATES FROM THE MONEY THE STATE RECEIVED FROM6 THE CORONAVIRUS STATE FISCAL RECOVERY FUND must submit to the state7 department a written justification as set forth in 31 CFR 35.6 (b)(4) for8 the capital expenditure; except that this requirement does not apply if the9 state department determines that the written justification is not required10 based on how the expenditures authorized pursuant to this section will be11 reported to the United States department of the treasury. The grant recipient shall spend or obligate all21 grant money awarded to the grant recipient by December 31, 2024. Any 22 money obligated by December 31, 2024, must be expended by December23 31, 2026 IN ACCORDANCE WITH SECTION 24-75-226 (4)(d).24 SECTION 38. In Colorado Revised Statutes, 27-60-405, amend25 (2)(b) as follows:26 27-60-405. Grant program funding - requirements - reports27 HB24-1466 -42- - appropriation. (2) (b) For each grant awarded for a capital1 expenditure, the BHA is responsible for preparing the written justification2 required pursuant to 31 CFR 35.6 (b)(4). A grant applicant that requests3 grant money THAT ORIGINATES FROM THE MONEY THE STATE RECEIVED4 FROM THE CORONAVIRUS STATE FISCAL RECOVERY FUND for a capital5 expenditure must submit to the BHA information requested by the BHA6 for inclusion in the written justification; except that this requirement does7 not apply if the BHA determines that the written justification is not8 required based on how the expenditures authorized pursuant to this part9 4 will be reported to the United States department of the treasury. F OR10 GRANT MONEY THAT DID NOT ORIGINATE FROM THE MONEY THE STATE11 RECEIVED FROM THE CORONAVIRUS STATE FISCAL RECOVERY FUND , A12 WRITTEN JUSTIFICATION IS NOT REQUIRED , EXCEPT AS THE BHA13 DETERMINES NECESSARY TO COMPLY WITH FEDERAL WRITTEN14 JUSTIFICATION REQUIREMENTS.15 SECTION 39. In Colorado Revised Statutes, 27-60-505, amend16 (2) introductory portion and (3)(b) as follows:17 27-60-505. Grant program funding - requirements - reports.18 (2) Of the money appropriated to the state department, REGARDLESS OF19 THE SOURCE, the BHA shall award grants in the following manner:20 (3) (b) To be eligible to receive grant money for a capital21 expenditure, the grant applicant THAT REQUESTS GRANT MONEY THAT22 ORIGINATES FROM THE MONEY THE STATE RECEIVED FROM THE23 CORONAVIRUS STATE FISCAL RECOVERY FUND must submit to the BHA a24 written justification as set forth in 31 CFR 35.6 (b)(4) for the capital25 expenditure; except that this requirement does not apply if the BHA26 determines that the written justification is not required based on how the27 HB24-1466 -43- expenditures authorized pursuant to this part 5 will be reported to the1 United States department of the treasury. F OR GRANT MONEY THAT DID2 NOT ORIGINATE FROM THE MONEY THE STATE RECEIVED FROM THE3 CORONAVIRUS STATE FISCAL RECOVERY FUND , A WRITTEN JUSTIFICATION4 IS NOT REQUIRED, EXCEPT AS THE BHA DETERMINES NECESSARY TO5 COMPLY WITH FEDERAL WRITTEN JUSTIFICATION REQUIREMENTS .6 SECTION 40. In Colorado Revised Statutes, 27-71-103, amend7 (3) as follows:8 27-71-103. Mental health residential facilities - additional9 beds. (3) The department shall distribute the money for the creation of10 additional beds pursuant to this section no later than December 30, 2024.11 Any person receiving money pursuant to this section shall spend or12 obligate all money received by December 30, 2024. Any money obligated 13 by December 30, 2024, must be expended by December 30, 2026 IN14 ACCORDANCE WITH SECTION 24-75-226 (4)(d).15 SECTION 41. In Colorado Revised Statutes, 27-80-127, amend16 (2)(a)(II) as follows:17 27-80-127. Children and youth in need of residential mental18 health and substance use treatment - repeal. (2) (a) (II) T HE USE OF19 money spent APPROPRIATED pursuant to this subsection (2) AND MONEY20 THAT ORIGINATES FROM THE ARPA REFINANCE STATE MONEY CASH FUND,21 CREATED IN SECTION 24-75-226.5, APPROPRIATED FOR THE SAME PURPOSE,22 must conform with the allowable purposes set forth in the federal23 "American Rescue Plan Act of 2021", Pub.L. 117-2, as amended. The24 department shall either spend or obligate such appropriation prior to25 December 30, 2024, and expend the appropriation on or before December26 31, 2026 IN ACCORDANCE WITH SECTION 24-75-226 (4)(d).27 HB24-1466 -44- SECTION 42. In Colorado Revised Statutes, 27-90-112, amend1 (2)(a)(II) as follows:2 27-90-112. Youth neuro-psych facility - funding - repeal.3 (2) (a) (II) Money spent pursuant to this subsection (2) must conform4 with the allowable purposes set forth in the federal "American Rescue5 Plan Act of 2021", Pub.L. 117-2, as amended. The department of human6 services shall either spend or obligate such appropriation prior to7 December 30, 2024, and expend the appropriation on or before December8 31, 2026 IN ACCORDANCE WITH SECTION 24-75-226 (4)(d).9 SECTION 43. In Colorado Revised Statutes, 27-94-107, amend10 (1) as follows:11 27-94-107. Renovation for additional beds. (1) The department12 of human services shall renovate a building at the center to add at least13 sixteen inpatient beds. The department shall spend or obligate all money14 appropriated for the renovation by December 30, 2024. Any money15 obligated by December 30, 2024, must be expended by December 30,16 2026 IN ACCORDANCE WITH SECTION 24-75-226 (4)(d).17 SECTION 44. In Colorado Revised Statutes, 35-1-117, amend18 (2)(b)(III), (3)(c)(III), and (6)(c) as follows:19 35-1-117. Community food access program - creation -20 purpose - duties and responsibilities - grant program - advisory21 committee - funding - reporting - rules - definitions - repeal.22 (2) (b) (III) T HE USE OF money spent APPROPRIATED pursuant to this23 subsection (2)(b) must conform with the allowable purposes set forth in24 the federal "American Rescue Plan Act of 2021", Pub.L. 117-2, as25 amended. The department shall either spend or obligate such26 appropriation prior to December 30, 2024, and expend the appropriation27 HB24-1466 -45- on or before December 31, 2026 IN ACCORDANCE WITH SECTION1 24-75-226 (4)(d).2 (3) (c) (III) Money spent pursuant to this subsection (3)(c) must3 conform with the allowable purposes set forth in the federal "American4 Rescue Plan Act of 2021", Pub.L. 117-2, as amended. The department5 shall either spend or obligate such appropriation prior to December 30,6 2024, and expend the appropriation on or before December 31, 2026 IN7 ACCORDANCE WITH SECTION 24-75-226 (4)(d).8 (6) (c) T HE USE OF money spent APPROPRIATED pursuant to this9 subsection (6) must conform with the allowable purposes set forth in the10 federal "American Rescue Plan Act of 2021", Pub.L. 117-2, as amended.11 The department of human services shall either spend or obligate such12 appropriation prior to December 30, 2024, and expend the appropriation13 on or before December 31, 2026 IN ACCORDANCE WITH SECTION14 24-75-226 (4)(d).15 SECTION 45. In Colorado Revised Statutes, 37-60-134, amend16 (7)(b) as follows:17 37-60-134. Groundwater compact compliance and18 sustainability fund - creation - conservation district19 recommendations for expenditures - state engineer approval -20 legislative declaration - transfer - definitions - reports - notice to21 revisor of statutes - repeal. (7) (b) On August 15, 2024, if there is22 unobligated OR UNENCUMBERED money in the fund, the state treasurer23 shall:24 (I) If the amount of unobligated OR UNENCUMBERED money is25 twenty million dollars or less, transfer all of the unobligated money to the26 water plan implementation account; or27 HB24-1466 -46- (II) If the amount of unobligated OR UNENCUMBERED money is1 greater than twenty million dollars, transfer to the water plan2 implementation account twenty million dollars.3 SECTION 46. Appropriation - adjustments to 2023 long bill.4 (1) For the 2023-24 state fiscal year, $495,000,000 is appropriated to the5 department of corrections. This appropriation is from the "American6 rescue plan act of 2021" cash fund created in section 24-75-226 (2),7 C.R.S., and is of money the state received from the federal coronavirus8 state fiscal recovery fund. To implement this act, the department may use9 this appropriation for centrally appropriated personal services pursuant to10 section 24-75-226 (4)(a)(IV), C.R.S. Amounts appropriated for centrally11 appropriated personal services may be expended by a department in any12 line item that includes a general fund appropriation for personal services13 up to the amount that is spent for personal services in the line item for14 state fiscal year 2023-24.15 (2) To implement this act and pursuant to section 24-75-22616 (4.1)(c), C.R.S., the total general fund appropriation made in the annual17 general appropriation act for the 2023-24 state fiscal year to the18 department of corrections is decreased by $495,000,000. To implement19 the reduction in the department's total general fund appropriation, and20 pursuant to section 24-75-226 (4.1)(a)(I), C.R.S., the amount of general21 fund money appropriated in a specific line item for personal services22 expenses for state fiscal year 2023-24 is reduced by the amount of money23 from the "American rescue plan act of 2021" cash fund that is expended24 in a line item under subsection (1) of this section.25 SECTION 47. Appropriation - adjustments to 2024 long bill.26 (1) For the 2024-25 state fiscal year, $324,000,000 is appropriated to the27 HB24-1466 -47- department of corrections. This appropriation is from the "American1 rescue plan act of 2021" cash fund created in section 24-75-226 (2),2 C.R.S., and is of money the state received from the federal coronavirus3 state fiscal recovery fund. To implement this act, the department may use4 this appropriation for centrally appropriated personal services pursuant to5 section 24-75-226 (4)(a)(V), C.R.S. Amounts appropriated for centrally6 appropriated personal services may be expended by a department in any7 line item that includes a general fund appropriation for personal services8 up to the amount that is spent for personal services in the line item as of9 January 31, 2025.10 (2) To implement this act and pursuant to section 24-75-22611 (4.1)(c), C.R.S., the total general fund appropriation made in the annual12 general appropriation act for the 2024-25 state fiscal year to the13 department of corrections is decreased by $324,000,000. To implement14 the reduction in the department's total general fund appropriation, and15 pursuant to section 24-75-226 (4.1)(a)(II), C.R.S., the amount of general16 fund money appropriated in a line item for personal services expenses for17 state fiscal year 2024-25 is reduced by the amount of money from the18 "American rescue plan act of 2021" cash fund that is expended in a line19 item under subsection (1) of this section.20 SECTION 48. Appropriation - adjustments to 2023 long bill.21 (1) For the 2023-24 state fiscal year, $214,000,000 is appropriated to the22 department of human services. This appropriation is from the "American23 rescue plan act of 2021" cash fund created in section 24-75-226 (2),24 C.R.S., and is of money the state received from the federal coronavirus25 state fiscal recovery fund. To implement this act, the department may use26 this appropriation for centrally appropriated personal services pursuant to27 HB24-1466 -48- section 24-75-226 (4)(a)(IV), C.R.S. Amounts appropriated for centrally1 appropriated personal services may be expended by a department in any2 line item that includes a general fund appropriation for personal services3 up to the amount that is spent for personal services in the line item for4 state fiscal year 2023-24.5 (2) To implement this act and pursuant to section 24-75-2266 (4.1)(c), C.R.S., the total general fund appropriation made in the annual7 general appropriation act for the 2023-24 state fiscal year to the8 department of human services is decreased by $214,000,000. To9 implement the reduction in the department's total general fund10 appropriation, and pursuant to section 24-75-226 (4.1)(a)(I), C.R.S., the11 amount of general fund money appropriated in a specific line item for12 personal services expenses for state fiscal year 2023-24 is reduced by the13 amount of money from the "American rescue plan act of 2021" cash fund14 that is expended in a line item under subsection (1) of this section. 15 SECTION 49. Appropriation - adjustments to 2024 long bill.16 (1) For the 2024-25 state fiscal year, $63,182,048 is appropriated to the17 department of human services. This appropriation is from the "American18 rescue plan act of 2021" cash fund created in section 24-75-226 (2),19 C.R.S., and is of money the state received from the federal coronavirus20 state fiscal recovery fund. To implement this act, the department may use21 this appropriation for centrally appropriated personal services pursuant to22 section 24-75-226 (4)(a)(V), C.R.S. Amounts appropriated for centrally23 appropriated personal services may be expended by a department in any24 line item that includes a general fund appropriation for personal services25 up to the amount that is spent for personal services in the line item as of26 January 31, 2025.27 HB24-1466 -49- (2) To implement this act and pursuant to section 24-75-2261 (4.1)(c), C.R.S., the total general fund appropriation made in the annual2 general appropriation act for the 2024-25 state fiscal year to the3 department of human services is decreased by $63,182,048. To implement4 the reduction in the department's total general fund appropriation, and5 pursuant to section 24-75-226 (4.1)(a)(II), C.R.S., the amount of general6 fund money appropriated in a line item for personal services expenses for7 state fiscal year 2024-25 is reduced by the amount of money from the8 "American rescue plan act of 2021" cash fund that is expended in a line9 item under subsection (1) of this section.10 SECTION 50. Appropriation - adjustments to 2023 long bill.11 (1) For the 2023-24 state fiscal year, $309,000,000 is appropriated to the12 judicial department, excluding judicial independent agencies. This13 appropriation is from the "American rescue plan act of 2021" cash fund14 created in section 24-75-226 (2), C.R.S., and is of money the state15 received from the federal coronavirus state fiscal recovery fund. To16 implement this act, the department, excluding judicial independent17 agencies, may use this appropriation for centrally appropriated personal18 services pursuant to section 24-75-226 (4)(a)(IV), C.R.S. Amounts19 appropriated for centrally appropriated personal services may be20 expended by a department in any line item that includes a general fund21 appropriation for personal services up to the amount that is spent for22 personal services in the line item for state fiscal year 2023-24.23 (2) To implement this act and pursuant to section 24-75-22624 (4.1)(c), C.R.S., the total general fund appropriation made in the annual25 general appropriation act for the 2023-24 state fiscal year to the judicial26 department, excluding judicial independent agencies, is decreased by27 HB24-1466 -50- $309,000,000. To implement the reduction in the department's total1 general fund appropriation, and pursuant to section 24-75-226 (4.1)(a)(I),2 C.R.S., the amount of general fund money appropriated in a specific line3 item for personal services expenses for state fiscal year 2023-24 is4 reduced by the amount of money from the "American rescue plan act of5 2021" cash fund that is expended in a line item under subsection (1) of6 this section.7 SECTION 51. Appropriation - adjustments to 2024 long bill.8 (1) For the 2024-25 state fiscal year, $200,000,000 is appropriated to the9 judicial department, excluding judicial independent agencies. This10 appropriation is from the "American rescue plan act of 2021" cash fund11 created in section 24-75-226 (2), C.R.S., and is of money the state12 received from the federal coronavirus state fiscal recovery fund. To13 implement this act, the department, excluding judicial independent14 agencies, may use this appropriation for centrally appropriated personal15 services pursuant to section 24-75-226 (4)(a)(V), C.R.S. Amounts16 appropriated for centrally appropriated personal services may be17 expended by a department in any line item that includes a general fund18 appropriation for personal services up to the amount that is spent for19 personal services in the line item as of January 31, 2025.20 (2) To implement this act and pursuant to section 24-75-22621 (4.1)(c), C.R.S., the total general fund appropriation made in the annual22 general appropriation act for the 2024-25 state fiscal year to the judicial23 department, excluding judicial independent agencies, is decreased by24 $200,000,000. To implement the reduction in the department's total25 general fund appropriation, and pursuant to section 24-75-226 (4.1)(a)(II),26 C.R.S., the amount of general fund money appropriated in a line item for27 HB24-1466 -51- personal services expenses for state fiscal year 2024-25 is reduced by the1 amount of money from the "American rescue plan act of 2021" cash fund2 that is expended in a line item under subsection (1) of this section. 3 SECTION 52. Appropriation to the departments of education,4 higher education, and public health and environment for the fiscal5 year beginning July 1, 2022. In Session Laws of Colorado 2022, amend6 section 5 of chapter 175, (SB 22-147), as section 5 (1) and (2) are7 amended by HB 24-____, as follows:8 Section 5. Appropriation. (1) For the 2022-23 state fiscal year,9 $4,600,000 is appropriated to the department of higher education for use10 by the regents of the university of Colorado. This appropriation is from11 the behavioral and mental health cash fund created in section 24-75-23012 (2)(a), C.R.S., and C.R.S. OF THIS AMOUNT, $185,931 is of money the13 state received from the federal coronavirus state fiscal recovery fund.14 FUND AND $4,414,069 ORIGINATES FROM THE GENERAL FUND . To15 implement this act, the regents may use this appropriation for the16 Colorado pediatric psychiatry consultation and access program. Any17 money appropriated in this section not expended prior to July 1, 2023, is18 further appropriated to the regents from July 1, 2023, through December19 31, 2026, for the same purpose.20 (2) For the 2022-23 state fiscal year, $5,000,000 is appropriated21 to the department of education. This appropriation is from the behavioral22 and mental health cash fund created in section 24-75-230 (2)(a), C.R.S.,23 is of money the state received from the federal coronavirus state fiscal24 recovery fund, and is based on an assumption that the department will25 require an additional 0.4 FTE. O F THIS AMOUNT, $1,483,419 IS OF MONEY26 THE STATE RECEIVED FROM THE FEDERAL CORONAVIRUS STATE FISCAL27 HB24-1466 -52- RECOVERY FUND AND $3,516,581 ORIGINATES FROM THE GENERAL FUND .1 To implement this act, the department may use this appropriation for the2 behavioral health care professionals matching grant program. Any money3 appropriated in this section not expended prior to July 1, 2023, is further4 appropriated to the department from July 1, 2023, through December 31,5 2026, for the same purpose.6 (3) For the 2022-23 state fiscal year, $1,500,000 is appropriated7 to the department of public health and environment for use by the8 prevention services division. This appropriation is from the behavioral9 and mental health cash fund created in section 24-75-230 (2)(a), C.R.S.,10 is of money the state received from the federal coronavirus state fiscal11 recovery fund, and is based on an assumption that the division will12 require an additional 0.4 FTE. O F THIS AMOUNT, $834,514 IS OF MONEY13 THE STATE RECEIVED FROM THE FEDERAL CORONAVIRUS STATE FISCAL14 RECOVERY FUND AND $665,486 ORIGINATES FROM THE GENERAL FUND. To15 implement this act, the division may use this appropriation for16 school-based health centers. Any money appropriated in this section not17 expended prior to July 1, 2023, is further appropriated to the division18 from July 1, 2023, through December 30, 2024, for the same purpose.19 SECTION 53. Appropriation to the department of human20 services for the fiscal year beginning July 1, 2022. For the 2022-23 state fiscal year,24 $5,000,000 is appropriated to the department of human services for use25 by the behavioral health administration. This appropriation is from the26 behavioral and mental health cash fund created in section 24-75-23027 HB24-1466 -53- (2)(a), C.R.S., and C.R.S. OF THIS AMOUNT, $3,500,000 is of money the1 state received from the federal coronavirus state fiscal recovery fund.2 FUND AND $1,500,000 ORIGINATES FROM THE GENERAL FUND . To3 implement this act, the administration may use this appropriation for the4 Colorado land-based tribe behavioral health services grant program. Any5 money appropriated in this section not expended prior to July 1, 2023, is6 further appropriated to the administration from July 1, 2023, through7 December 31, 2026, for the same purpose. M ONEY THAT ORIGINATED8 FROM THE FEDERAL CORONAVIRUS STATE FISCAL RECOVERY FUND SHALL9 BE OBLIGATED AND EXPENDED IN ACCORDANCE WITH SECTION 24-75-226,10 C.R.S.11 SECTION 54. Appropriation to the department of human12 services for the fiscal year beginning July 1, 2022. In Session Laws of13 Colorado 2022, amend section 3 of chapter 223, (SB 22-177), as section14 3 is amended by HB 24-____, as follows:15 Section 3. Appropriation. For the 2022-23 state fiscal year,16 $12,200,000 is appropriated to the department of human services for use17 by the behavioral health administration. This appropriation is from the18 behavioral and mental health cash fund created in section 24-75-23019 (2)(a), C.R.S., and C.R.S. OF THIS AMOUNT, $10,500,000 ORIGINATES20 FROM THE GENERAL FUND AND $1,700,000 is of money the state received21 from the federal coronavirus state fiscal recovery fund. The22 administration may use this appropriation for care coordination23 infrastructure. Any money appropriated in this section not expended prior24 to July 1, 2023, is further appropriated to the administration from July 1,25 2023, through December 31, 2026, for the same purpose. These26 appropriations are based on the assumption that the administration will27 HB24-1466 -54- require 3.0 FTE in the 2022-23 state fiscal year and 3.0 FTE in the1 2023-24 state fiscal year to implement this act. To implement4 this act, the department may use this appropriation as follows:5 SECTION 56. Appropriation to the department of human6 services, the judicial department, the department of public safety,7 and the department of corrections for the fiscal year beginning July8 1, 2022. OF THIS AMOUNT, $3,435,819 ORIGINATES FROM11 THE GENERAL FUND AND $64,181 is of money that the state received from12 the federal coronavirus state fiscal recovery fund. Any money13 appropriated in this section not expended prior to July 1, 2023, is further14 appropriated to the department from July 1, 2023, through December 31,15 2026, for the same purpose. To implement this act, the department may16 use this appropriation as follows:17 (5) For the 2022-23 state fiscal year, $3,000,000 is appropriated18 to the department of corrections for use by institutions. This appropriation19 is from the behavioral and mental health cash fund created in section20 24-75-230 (2)(a), C.R.S., and C.R.S. OF THIS AMOUNT, $2,554,12621 ORIGINATES FROM THE GENERAL FUND AND $445,874 is of money that the22 state received from the federal coronavirus state fiscal recovery fund. Any23 money appropriated in this section not expended prior to July 1, 2023, is24 further appropriated to the department from July 1, 2023, through25 December 30, 2024, for the same purpose. To implement this act, the26 department may use this appropriation for operating expenses related to27 HB24-1466 -57- the mental health subprogram.1 SECTION 57. Appropriation to the department of local2 affairs for the fiscal year beginning July 1, 2022. In Session Laws of3 Colorado 2022, amend section 4 (1) of chapter 288, (SB 22-211), as4 section 4 (1) is amended by HB 24-____, as follows:5 Section 4. Appropriation. (1) For the 2022-23 state fiscal year,6 $45,000,000 is appropriated to the department of local affairs for use by7 the division of housing. This appropriation is from the economic recovery8 and relief cash fund created in section 24-75-228 (2)(a), C.R.S., is of9 money the state received from the federal coronavirus state fiscal10 recovery fund, and is based on an assumption that the division will11 require an additional 2.3 FTE. This appropriation is14 from the behavioral and mental health cash fund created in section15 24-75-230 (2)(a), C.R.S., and C.R.S. OF THIS AMOUNT, $1,245,147 is of16 money the state received from the federal coronavirus state fiscal17 recovery fund. FUND AND $1,754,853 ORIGINATES FROM THE GENERAL18 FUND. To implement this act, the division may use this appropriation for19 the universal contract for behavioral health services. Any money20 appropriated in this section that originated from money the state received21 from the federal coronavirus state fiscal recovery fund that is obligated22 prior to December 30, 2024, in accordance with the federal "American23 Rescue Plan Act of 2021", Pub.L. 117-2, as amended, but THAT IS not24 expended prior to December 30, 2024, is further appropriated to the25 department for use prior to December 31, 2026 for the same purpose.26 M ONEY THAT ORIGINATED FROM THE FEDERAL CORONAVIRUS STATE27 HB24-1466 -75- FISCAL RECOVERY FUND SHALL BE OBLIGATED AND EXPENDED IN1 ACCORDANCE WITH SECTION 24-75-226, C.R.S.2 SECTION 77. This appropriation is from the behavioral and18 mental health cash fund created in section 24-75-230 (2)(a), C.R.S., and19 C.R.S. Appropriation to the department of early25 childhood for the fiscal year beginning July 1, 2022. Any money appropriated in this section not expended10 prior to July 1, 2023, is further appropriated to administration and finance11 from July 1, 2023, through December 31, 2024, for the same purpose.12 (2) For the 2022-23 state fiscal year, $2,000,000 is appropriated13 to the department of human services for use by the office of economic14 security. To implement this act, the office of economic19 security may use this appropriation for fuel assistance payments related20 to food and energy assistance. Any money appropriated in this section not21 expended prior to July 1, 2023, is further appropriated to the office of22 economic security from July 1, 2023, through December 31, 2024, for the23 same purpose.24 (3) For the 2022-23 state fiscal year, $1,000,000 is appropriated25 to the department of human services for use by the office of economic26 security. This appropriation is from the economic recovery and relief cash27 HB24-1466 -78- fund created in section 24-75-228 (2)(a), C.R.S., and C.R.S. OF THIS1 AMOUNT, $190,000 is of money the state received from the federal2 coronavirus state fiscal recovery fund. FUND AND $810,000 ORIGINATES3 FROM THE GENERAL FUND. To implement this act, the office of economic4 security may use this appropriation for electronic benefits transfer5 programming related to food and energy assistance. Any money6 appropriated in this section not expended prior to July 1, 2023, is further7 appropriated to the office of economic security from July 1, 2023, through8 December 31, 2024, for the same purpose.9 (4) For the 2022-23 state fiscal year, $1,000,000 is appropriated10 to the department of agriculture for use by agricultural services. This11 appropriation is from the economic recovery and relief cash fund created12 in section 24-75-228 (2)(a), C.R.S., is of money the state received from13 the federal coronavirus state fiscal recovery fund ORIGINATES FROM THE14 GENERAL FUND, and is based on an assumption that agricultural services15 will require an additional 1.8 FTE.
