The state received money from the federal coronavirus state fiscal recovery fund pursuant to the "American Rescue Plan Act of 2021" (ARPA money). ARPA money was deposited into the "American Rescue Plan Act of 2021" cash fund and then transferred to various cash funds (recipient funds) and appropriated for various programs. The bill requires the state treasurer to transfer specified amounts of ARPA money from specified recipient funds at the close of the 2023-24 state fiscal year to the "American Rescue Plan Act of 2021" cash fund. The bill requires the state treasurer to transfer money from the general fund to a new ARPA refinance state money cash fund. Money in the new ARPA refinance state money cash fund is transferred to the specified recipient funds. The bill requires the general assembly to appropriate ARPA money from the "American Rescue Plan Act of 2021" cash fund to state departments for personal services in fiscal year 2023-24. For fiscal year 2024-25, the general assembly shall appropriate the balance of the cash fund for personal services or for other purposes permitted under the "American Rescue Plan Act of 2021", and the money so appropriated must be expended on or before January 31, 2025. On December 1, 2024, any unspent and unobligated money in a recipient fund, other than money designated for personal services or operating costs that will be spent by January 31, 2025, reverts to the "American Rescue Plan Act of 2021" cash fund. The reverted money is continuously appropriated to any department designated by the governor for any purpose that was funded with general fund money in the general appropriations act for fiscal year 2024-25. After December 31, 2024, any ARPA money in a recipient fund that was obligated as of December 31, 2024, but not expended on an eligible activity at the conclusion of the appropriation reverts to the "American Rescue Plan Act of 2021" cash fund and is continuously appropriated to any department designated by the governor for any purpose for which a general fund appropriation was made in the general appropriation act for the state fiscal year in which the reversion occurred. The amount of general fund money appropriated in a line item in a general appropriations act is reduced by the amount of ARPA money appropriated pursuant to the bill's provisions that is spent for the line item. The bill repeals the requirement for a subrecipient to obligate ARPA money by November 30, 2024. The bill authorizes the state controller to take certain measures to implement the bill and ensure that ARPA money is expended within the time allowed by federal law. The governor and the state controller shall jointly submit a report to the joint budget committee, the speaker of the 1466 -2- house of representatives, the minority leader of the house of representatives, the president of the senate, and the minority leader of the senate about the transfers in the bill and about spending ARPA money. The bill makes changes to various programs related to refinancing ARPA money, including clarifying spending and obligation deadlines for program money that is not ARPA money and exempting the use of state money from requirements for capitol construction projects that use federal money. The bill makes changes to appropriations. Be it enacted by the General Assembly of the State of Colorado:1 SECTION 1. Legislative declaration - legislative intent.2 (1) The general assembly finds and declares that:3 (a) The state received money from the federal government4 pursuant to the federal "American Rescue Plan Act of 2021" (ARPA5 money), and federal law requires that money to be obligated by December6 31, 2024, and spent by December 31, 2026;7 (b) ARPA money not obligated by December 31, 2024, must be8 returned to the federal government;9 (c) The state appropriated ARPA money for a number of programs10 and purposes, but appropriating money is not an obligation for the11 purposes of federal law; and12 (d) To preserve the greatest flexibility for the state after December13 31, 2024, and to ensure the uninterrupted implementation of programs, it14 is in the best interest of the state to spend ARPA money before December15 31, 2024, on eligible ARPA uses and substitute state funds for programs16 that extend beyond December 31, 2024, and on personal services, as17 permitted by federal law, before January 31, 2025.18 (2) It is the general assembly's intent that:19 (a) Most of the ARPA money appropriated for programs intended20 to be spent after December 31, 2024, be substituted with state money,21 1466-3- changing the source of program funds while maintaining funding for the1 programs;2 (b) This act does not change the requirements, timelines, or3 spending deadlines for any program; and4 (c) The exchanged ARPA money be spent on personal services5 retroactively in fiscal year 2023-24 and in the first half of fiscal year6 2024-25 so that all of the state's unobligated ARPA money will be spent7 by the end of 2024, ensuring compliance with federal deadlines.8 SECTION 2. In Colorado Revised Statutes, 24-75-226, amend9 (2), (4)(a), (4)(c)(I), (4)(d), (5)(b) introductory portion, and (5)(f); and10 add (1)(a.7), (1)(c.5), (3.5), (4.1), (4.2), (4.3), and (6.5) as follows:11 24-75-226. "American Rescue Plan Act of 2021" cash fund -12 creation - recipient funds - limitations - reporting - appropriations -13 reduction in general fund appropriations - report - legislative14 declaration - definitions - repeal. (1) As used in this section, unless the15 context otherwise requires:16 (a.7) "D ISCRETIONARY ACCOUNT " MEANS THE DISCRETIONARY17 ACCOUNT CREATED IN THE FUND IN SUBSECTION (4)(a)(II) OF THIS18 SECTION.19 (c.5) "P ERSONAL SERVICES" HAS THE SAME MEANING AS SET FORTH20 IN SECTION 24-75-112 (1)(m).21 (2) The "American Rescue Plan Act of 2021" cash fund is hereby22 created in the state treasury. The general assembly may transfer25 money in the fund to another cash fund that is established for the purpose26 of using the money from the federal coronavirus state fiscal recovery27 1466 -7- fund. Transfers from the fund to the general fund are prohibited. A1 DEPARTMENT SHALL NOT USE MONEY APPROPRIATED PURSUANT TO THIS2 SUBSECTION (4) FOR ANY PURPOSE PROHIBITED BY THE "AMERICAN3 R ESCUE PLAN ACT OF 2021". A DEPARTMENT SHALL COMPLY WITH ALL4 REQUIREMENTS SET FORTH IN THIS SECTION .5 (II) If there is any of the money transferred to the fund under6 subsection (3)(a) of this section remaining in the fund after any transfers7 from the fund required by bills enacted during the 2021 regular legislative8 session, then, of the remainder in the fund, the lesser of three hundred9 million dollars or the remainder IS PLACED IN THE DISCRETIONARY10 ACCOUNT, WHICH IS CREATED IN THE FUND , AND is continuously11 appropriated to any department designated by the governor for any12 allowable purpose under the "American Rescue Plan Act of 2021".13 (III) The money specified in subsection (3)(d) of this section IS14 PLACED IN THE DISCRETIONARY ACCOUNT AND is continuously15 appropriated to any department designated by the governor for any16 expenditures necessary to respond to the public health emergency with17 respect to COVID-19.18 (IV) F OR THE 2023-24 STATE FISCAL YEAR, THE GENERAL19 ASSEMBLY SHALL APPROPRIATE MONEY FROM THE FUND TO ANY20 DEPARTMENTS FOR PERSONAL SERVICES THAT WERE PAID FROM THE21 GENERAL FUND IN STATE FISCAL YEAR 2023-24.22 (V) F OR THE 2024-25 STATE FISCAL YEAR, THE GENERAL23 ASSEMBLY SHALL APPROPRIATE THE BALANCE OF THE FUND , EXCLUDING24 MONEY REMAINING IN THE DISCRETIONARY ACCOUNT . THE GENERAL25 ASSEMBLY MAY MAKE THE REQUIRED APPROPRIATIONS TO ANY26 DEPARTMENT FOR PERSONAL SERVICES AND FOR OTHER PURPOSES27 1466 -8- PERMITTED UNDER THE "AMERICAN RESCUE PLAN ACT OF 2021". ANY1 MONEY APPROPRIATED PURSUANT TO THIS SUBSECTION (4)(a)(V) MUST BE2 OBLIGATED AS REQUIRED IN SUBSECTION (4)(d) OF THIS SECTION AND3 EXPENDED ON OR BEFORE JANUARY 31, 2025.4 (c) (I) Notwithstanding any provision of law to the contrary, in5 order to ensure proper accounting for and compliance with the "American6 Rescue Plan Act of 2021", whenever money is transferred or appropriated7 to a recipient fund that also has money from other sources, the state8 controller or department controller shall create a companion cash fund9 that includes only the money the state received from the federal10 coronavirus state fiscal recovery fund under section 9901 of title IX,11 subtitle M of the "American Rescue Plan Act of 2021", but that is12 otherwise legally identical to the recipient fund, except as otherwise13 provided in subsection (4)(c)(II) of this section. T HE STATE CONTROLLER14 MAY PRESCRIBE PROCEDURES TO PERMIT CONTINUED USE OF COMPANION15 FUNDS, WITH PROPER SEGREGATION OF FUND SOURCES THROUGH16 COMPLETION OF A PROJECT, FOR ANY MONEY APPROPRIATED FOR A USE17 PERMITTED PURSUANT TO THE "AMERICAN RESCUE PLAN ACT OF 2021"18 THAT IS PARTIALLY REFINANCED.19 (d) (I) Money in the fund or a recipient fund THAT ORIGINATED20 FROM THE CORONAVIRUS STATE FISCAL RECOVERY FUND must be21 expended or obligated by December 31, 2024. Just prior to the close of22 business on December 30, 2024, any unexpended appropriations from a23 recipient fund THAT IS OF MONEY THAT ORIGINATED FROM THE24 CORONAVIRUS STATE FISCAL RECOVERY FUND AND THAT REMAINED IN THE25 RECIPIENT FUND AFTER THE REVERSION DESCRIBED IN SUBSECTION (4.2)26 OF THIS SECTION that are not for expenditures to be made after December27 1466 -9- 31, 2024, that were obligated before that date, revert to the "American1 Rescue Plan Act of 2021" cash fund, and the state treasurer shall transfer2 the unexpended and unobligated balance in the fund to the unemployment3 compensation fund created in section 8-77-101 (1). Any money THAT4 ORIGINATED FROM THE CORONAVIRUS STATE FISCAL RECOVERY FUND5 THAT IS obligated by December 31, 2024, must be expended by December6 31, 2026. Effective December 31, 2026, the state controller shall transmit7 any unexpended money in the fund or a recipient fund to the United8 States department of the treasury. M ONEY IN A RECIPIENT FUND THAT DID9 NOT ORIGINATE FROM THE CORONAVIRUS STATE FISCAL RECOVERY FUND10 MUST BE EXPENDED IN ACCORDANCE WITH ANY APPLICABLE LAW OR11 APPROPRIATION.12 (II) A subrecipient must spend or obligate money received from13 the fund or a recipient fund by November 30, 2024, and, by December 13,14 2024, shall notify the state agency from which the subrecipient received15 the money of the status of the money that is obligated or expended. The16 subrecipient shall return to the state any unexpended and unobligated17 money under terms dictated by the state controller, and the state treasurer18 shall transfer the amount returned to the unemployment compensation19 fund created in section 8-77-101 (1). Any money obligated by November20 30, 2024, must be expended by December 11, 2026. On or before21 December 11, 2026, the subrecipient shall return to the state any22 remaining money under terms dictated by the state controller and23 thereafter the state controller shall transmit the money to the United States24 department of the treasury in accordance with the treasury's requirements.25 (III) M ONEY IN THE FUND OR IN A RECIPIENT F UND THAT26 ORIGINATED FROM THE CORONAVIRUS STATE FISCAL RECOVERY FUND IS27 1466 -10- OBLIGATED WHEN IT IS OBLIGATED IN ACCORDANCE WITH THE "AMERICAN1 R ESCUE PLAN ACT OF 2021" AND ANY FEDERAL RULES PROMULGATED2 THEREUNDER. THE OBLIGATION CRITERIA IN THE "AMERICAN RESCUE3 P LAN ACT OF 2021" AND FEDERAL RULES DO NOT APPLY TO MONEY IN THE4 FUND OR IN A RECIPIENT FUND THAT DID NOT ORIGINATE FROM THE5 CORONAVIRUS STATE FISCAL RECOVERY FUND . MONEY THAT DID NOT6 ORIGINATE FROM THE CORONAVIRUS STATE FISCAL RECOVERY FUND THAT7 IS NOT OBLIGATED BY AN APPLICABLE DEADLINE IN STATE LAW DOES NOT8 REVERT AND REMAINS AVAILABLE FOR EXPENDITURE IN ACCOR DANCE9 WITH ANY APPLICABLE APPROPRIATION . The state controller shall10 determine whether money is obligated for purposes of determining the11 deadline for expenditures and the reversion or repayment of money in12 accordance with this subsection (4)(d).13 (4.1) (a) (I) E FFECTIVE JUNE 30, 2024, THE AMOUNT OF GENERAL14 FUND MONEY APPROPRIATED IN A LINE ITEM FOR PERSONAL SERVICES15 EXPENSES IN THE GENERAL APPROPRIATION ACT FOR STATE FISCAL YEAR16 2023-24, SENATE BILL 23-214, IS REDUCED BY THE AMOUNT OF FEDERAL17 FUNDS APPROPRIATED PURSUANT TO SUBSECTION (4)(a)(IV) OF THIS18 SECTION THAT WERE SPENT FOR PERSONAL SERVICES IN THE LINE ITEM .19 (II) E FFECTIVE NOVEMBER 30, 2024, THE AMOUNT OF GENERAL20 FUND MONEY APPROPRIATED IN A LINE ITEM FOR PERSONAL SERVICES21 EXPENSES IN THE GENERAL APPROPRIATION ACT FOR STATE FISCAL YEAR22 2024-25, HOUSE BILL 24-1430, IS REDUCED BY THE AMOUNT OF FEDERAL23 FUNDS APPROPRIATED PURSUANT TO SUBSECTION (4)(a)(V) OF THIS24 SECTION THAT WERE SPENT FOR PERSONAL SERVICES IN THE LINE ITEM .25 (b) T O THE EXTENT PERMITTED BY FEDERAL LAW , THE GOVERNOR26 AND A DEPARTMENT THAT IS APPROPRIATED MONEY THAT ORIGINATED27 1466 -11- FROM THE FUND SHALL SPEND THE MONEY FOR THE PURPOSE FOR WHICH1 IT IS APPROPRIATED BEFORE SPENDING MONEY FROM ANY OTHER SOURCE2 FOR THE SAME PURPOSE.3 (c) F OR THE PURPOSE OF BALANCING THE STATE BUDGET AS4 REQUIRED BY ARTICLE X OF THE STATE CONSTITUTION DURING THE 20245 REGULAR LEGISLATIVE SESSION , THE AMOUNTS APPROPRIATED IN THE6 GENERAL APPROPRIATION ACTS FOR STATE FISCAL YEAR 2023-24, SENATE7 B ILL 23-214, AND STATE FISCAL YEAR 2024-25, HOUSE BILL 24-1430, TO8 EACH DEPARTMENT FOR PERSONAL SERVICES IS REDUCED BY THE AMOUNT9 APPROPRIATED FROM THE FUND FOR THE DEPARTMENT 'S PERSONAL10 SERVICES FOR THE APPLICABLE STATE FISCAL YEAR .11 (4.2) (a) (I) O N DECEMBER 1, 2024, ANY UNSPENT AND12 UNOBLIGATED MONEY THAT ORIGINATED FROM THE CORONAVIRUS STATE13 FISCAL RECOVERY FUND, OTHER THAN MONEY DESIGNATED FOR PERS ONAL14 SERVICES OR OTHER OPERATING COSTS AS DESCRIBED IN SUBSECTION15 (4.2)(a)(II) OF THIS SECTION, THAT IS IN THE FUND, A RECIPIENT FUND, OR16 THE DISCRETIONARY ACCOUNT REVERTS TO THE FUND . MONEY THAT17 REVERTS TO THE FUND PURSUANT TO THIS SUBSECTION (4.2) IS18 CONTINUOUSLY APPROPRIATED UNTIL JANUARY 31, 2025, TO ANY19 DEPARTMENT DESIGNATED BY THE GOVERNOR FOR ANY PURPOSE FOR20 WHICH A GENERAL FUND APPROPRIATION WAS MADE IN THE GENERAL21 APPROPRIATION ACT FOR STATE FISCAL YEAR 2024-25, HOUSE BILL22 24-1430.23 (II) O N OR BEFORE NOVEMBER 30, 2024, THE OFFICE SHALL24 DETERMINE THE AMOUNT OF UNSPENT AND UNOBLIGATED MONEY IN THE25 FUND, A RECIPIENT FUND, OR THE DISCRETIONARY ACCOUNT THAT26 ORIGINATED FROM THE CORONAVIRUS STATE FISCAL RECOVERY FUND27 1466 -12- THAT WILL BE SPENT BY A DEPARTMENT FOR PERSONAL SERVICES AND1 OTHER OPERATING COSTS ON OR BEFORE JANUARY 31, 2025, AND SHALL2 REPORT THAT AMOUNT TO THE STATE CONTROLLER . PURSUANT TO3 SUBSECTION (4.2)(a)(I) OF THIS SECTION, MONEY DESIGNATED FOR4 PERSONAL SERVICES AND OTHER OPERATING COSTS REPORTED TO THE5 STATE CONTROLLER DOES NOT REVERT TO THE FUND ON DECEMBER 1,6 2024.7 (b) E FFECTIVE JANUARY 31, 2025, THE AMOUNT OF GENERAL FUND8 MONEY APPROPRIATED IN A LINE ITEM IN THE GENERAL APPROPRIATION9 ACT FOR STATE FISCAL YEAR 2024-25, HOUSE BILL 24-1430, IS REDUCED10 BY THE AMOUNT OF FEDERAL MONEY THAT ORIGINATED FROM THE11 CORONAVIRUS STATE FISCAL RECOVERY FUND APPROPRIATED PURSUANT12 TO SUBSECTION (4.2)(a) OF THIS SECTION AND THAT WAS SPENT FOR THE13 LINE ITEM.14 (4.3) (a) A FTER DECEMBER 31, 2024, ANY MONEY IN A RECIPIENT15 FUND THAT ORIGINATED FROM THE CORONAVIRUS STATE FISCAL16 RECOVERY FUND THAT WAS OBLIGATED AS OF DECEMBER 31, 2024, BUT17 NOT EXPENDED ON AN ELIGIBLE ACTIVITY AT THE CONCLUSION OF THE18 APPROPRIATION REVERTS TO THE FUND . MONEY THAT REVERTS TO THE19 FUND PURSUANT TO THIS SUBSECTION (4.3) IS CONTINUOUSLY20 APPROPRIATED THROUGH DECEMBER 31, 2026, TO ANY DEPARTMENT21 DESIGNATED BY THE GOVERNOR FOR ANY PURPOSE FOR WHICH A GENERAL22 FUND APPROPRIATION WAS MADE IN THE GENERAL APPROPRIATION ACT23 FOR THE STATE FISCAL YEAR IN WHICH THE REVERSION OCCURRED .24 (b) E FFECTIVE ON THE DATE OF THE APPLICABLE REVERSION , THE25 AMOUNT OF GENERAL FUND MONEY APPROPRIATED IN A LINE ITEM IN THE26 GENERAL APPROPRIATION ACT FOR THE STATE FISCAL YEAR IN WHICH THE27 1466 -13- REVERSION OCCURRED IS REDUCED BY THE AMOUNT OF FEDERAL MONEY1 THAT ORIGINATED FROM THE CORONAVIRUS STATE FISCAL RECOVERY2 FUND APPROPRIATED PURSUANT TO SUBSECTION (4.3)(a) OF THIS SECTION3 AND THAT WAS SPENT FOR THE LINE ITEM.4 (5) (b) The office and the state controller shall establish5 compliance requirements CONCERNING THE USE OF MONEY THAT6 ORIGINATED FROM THE CORONAVIRUS STATE FISCAL RECOVERY FUND for7 any department that receives an appropriation from the fund or a recipient8 fund or any person that receives money from a department. THE OFFICE9 AND THE STATE CONTROLLER MAY ESTABLISH COMPLIANCE10 REQUIREMENTS FOR MONEY THAT ORIGINATES FROM THE ARPA11 REFINANCE STATE MONEY CASH FUND CREATED IN SECTION 24-75-226.5.12 If a department or person fails to comply with these requirements, then:13 (f) The general assembly may appropriate money from the FUND14 OR THE revenue loss restoration cash fund created in section 24-75-22715 to the department of personnel for use by the state controller and to the16 office for any direct or indirect expenses related to the administration of17 this subsection (5).18 (6.5) (a) T HE GOVERNOR AND THE STATE CONTROLLER SHALL19 JOINTLY SUBMIT A REPORT TO THE JOINT BUDGET COMMITTEE , THE20 SPEAKER OF THE HOUSE OF REPRESENTATIVES , THE MINORITY LEADER OF21 THE HOUSE OF REPRESENTATIVES , THE PRESIDENT OF THE SENATE, AND22 THE MINORITY LEADER OF THE SENATE, AS DESCRIBED IN THIS SUBSECTION23 (6.5).24 (b) O N OR BEFORE SEPTEMBER 15, 2024, THE GOVERNOR AND25 STATE CONTROLLER SHALL SUBMIT A REPORT THAT INCLUDES :26 (I) T HE TOTAL EXPENDITURE BY THE STATE OF MONEY THAT27 1466 -14- ORIGINATED FROM THE CORONAVIRUS STATE FISCAL RECOVERY F UND AND1 RELATED ADJUSTMENTS TO THE GENERAL FUND , AS DESCRIBED IN2 SUBSECTION (4.1) OF THIS SECTION, INCLUDING THE AMOUNT EXPENDED3 FROM THE FUND BY EACH DEPARTMENT FOR PERSONAL SERVICES FOR THE4 2023-24 STATE FISCAL YEAR FROM THE MONEY APPROPRIATED PURSUANT5 TO SUBSECTION (4)(a)(IV) OF THIS SECTION; AND6 (II) A N EXPLANATION OF ANY FURTHER ACTIONS THAT THE7 GOVERNOR AND ANY STATE DEPARTMENT WILL TAKE TO ENSURE THAT8 MONEY THAT ORIGINATED FROM THE CORONAVIRUS STATE FISCAL9 RECOVERY FUND IS FULLY EXPENDED IN COMPLIANCE WITH THE10 "A MERICAN RESCUE PLAN ACT OF 2021".11 (c) O N OR BEFORE FEBRUARY 15, 2025, THE GOVERNOR AND THE12 STATE CONTROLLER SHALL SUBMIT A REPORT THAT INCLUDES UPDATED13 INFORMATION ABOUT EACH OF THE SUBJECTS REQUIRED IN THE REPORT14 DESCRIBED IN SUBSECTION (6.5)(b)(I) OF THIS SECTION AND ANY15 EXPENDITURE FROM THE FUND PURSUANT TO SUBSECTION (4.2) OF THIS16 SECTION, INCLUDING THE AMOUNT EXPENDED FROM THE FUND BY EACH17 DEPARTMENT AS OF DECEMBER 31, 2024.18 SECTION 3. In Colorado Revised Statutes, add 24-75-226.5 as19 follows:20 24-75-226.5. ARPA refinance state money cash fund - creation21 - reduction in general fund appropriations - legislative intent -22 definitions - repeal. (1) A S USED IN THIS SECTION, UNLESS THE CONTEXT23 OTHERWISE REQUIRES:24 (a) "A MERICAN RESCUE PLAN ACT OF 2021" MEANS THE FEDERAL25 "A MERICAN RESCUE PLAN ACT OF 2021", PUB.L. 117-2, AS THE ACT MAY26 BE SUBSEQUENTLY AMENDED .27 1466 -15- (b) "CASH FUND" MEANS THE ARPA REFINANCE STATE MONEY1 CASH FUND CREATED IN THIS SECTION.2 (c) "C OMPANION FUND" MEANS A COMPANION CASH FUND3 CREATED BY THE STATE CONTROLLER PURSUANT TO SECTION 24-75-2264 (4)(c) THAT IS ASSOCIATED WITH A CASH FUND AND THAT INCLUDES ONLY5 THE MONEY THE STATE RECEIVED FROM THE CORONAVIRUS STATE FISCAL6 RECOVERY FUND.7 (d) "C ORONAVIRUS STATE FISCAL RECOVERY FUND " HAS THE SAME8 MEANING AS SET FORTH IN SECTION 24-75-226 (1)(a.5).9 (e) "R EFINANCE DISCRETIONARY ACCOUNT " MEANS THE10 REFINANCE DISCRETIONARY ACCOUNT CREATED IN THE CASH FUND11 PURSUANT TO SUBSECTION (1)(c) OF THIS SECTION.12 (2) (a) T HE ARPA REFINANCE STATE MONEY CASH FUND IS13 CREATED IN THE STATE TREASURY. THE CASH FUND CONSISTS OF MONEY14 TRANSFERRED TO THE CASH FUND PURSUANT TO SUBSECTION (3) OF THIS15 SECTION AND ANY OTHER MONEY THAT THE GENERAL ASSEMBLY MAY16 APPROPRIATE OR TRANSFER TO THE CASH FUND .17 (b) I N ACCORDANCE WITH SECTION 24-36-114 (1), THE STATE18 TREASURER SHALL CREDIT ALL INTEREST AND INCOME DERIVED FROM THE19 DEPOSIT AND INVESTMENT OF MONEY IN THE CASH FUND TO THE GENERAL20 FUND.21 (c) T HERE IS CREATED IN THE CASH FUND THE REFINANCE22 DISCRETIONARY ACCOUNT . THE REFINANCE DISCRETIONARY ACCOUNT23 CONSISTS OF MONEY CREDITED TO THE ACCOUNT PURSUANT TO24 SUBSECTION (4)(a) OF THIS SECTION. EFFECTIVE DECEMBER 31, 2026, THE STATE CONTROLLER SHALL3 TRANSMIT ANY UNEXPENDED AND UNENCUMBERED MONEY TRANSFERRED4 TO A FUND, OTHER THAN THE REFINANCE DISCRETIONARY ACCOUNT ,5 PURSUANT TO SUBSECTION (4) OF THIS SECTION THAT REMAINS IN THAT6 FUND TO THE CASH FUND.7 (7) ON JANUARY 2, 2027, THE STATE TREASURER SHALL TRANSFER8 ALL UNEXPENDED AND UNENCUMBERED MONEY IN THE CASH FUND , OTHER9 THAN THE MONEY IN THE REFINANCE DISCRETIONARY ACC OUNT , TO THE10 GENERAL FUND.11 (8) O N JUNE 1, 2027, THE STATE TREASURER SHALL TRANSFER ALL12 UNEXPENDED MONEY IN THE REFINANCE DISCRETI ONARY ACCOUNT TO THE13 GENERAL FUND.14 (9) T HIS SECTION IS REPEALED, EFFECTIVE JULY 1, 2027.15 SECTION 4. In Colorado Revised Statutes, 24-75-109, amend16 (1)(f)(II); and add (1)(g) and (3.5) as follows:17 24-75-109. Controller may allow expenditures in excess of18 appropriations - limitations - appropriations for subsequent fiscal19 year restricted - repeal. (1) For the purpose of closing the state's books,20 and subject to the provisions of this section, the controller may, on or21 after May 1 of any fiscal year and before the forty-fifth day after the close22 thereof, upon approval of the governor, allow any department, institution,23 or agency of the state, including any institution of higher education, to24 make an expenditure in excess of the amount authorized by an item of25 appropriation for such fiscal year if:26 (f) The overexpenditure is by the department of education for27 1466 -20- either:1 (II) Distributing money to a participating school food authority to2 increase wages or provide stipends for individuals whom the participating3 school food authority employs to directly prepare and serve food for4 school meals, pursuant to section 22-82.9-206 (1); OR5 (g) T HE OVEREXPENDITURE IS OF MONEY THAT ORIGINATED FROM6 THE CORONAVIRUS STATE FISCAL RECOVERY FUND IN EXCESS OF THE7 AMOUNT AUTHORIZED BY AN ITEM OF APPROPRIATION OR THE AMOUNT IN8 A RECIPIENT FUND OR THE DISCRETIONARY ACCOUNT , AS EACH IS DEFINED9 IN SECTION 24-75-226, IN STATE FISCAL YEAR 2023-24 IF THE MONEY THAT10 FUNDED THE APPROPRIATION IS TRANSFERRED FROM THE RECIPIENT FUND11 OR DISCRETIONARY ACCOUNT TO THE "AMERICAN RESCUE PLAN ACT OF12 2021" CASH FUND PURSUANT TO SECTION 24-75-226 (3.5).13 (3.5) (a) N OTWITHSTANDING SUBSECTION (3) OF THIS SECTION, FOR14 AN OVEREXPENDITURE DESCRIBED IN SUBSECTION (1)(g) OF THIS SECTION,15 THE CONTROLLER SHALL RESTRICT , IN AN AMOUNT EQUAL TO SAID16 OVEREXPENDITURE, CORRESPONDING ITEMS OF APPROPRIATION MADE FOR17 THE FISCAL YEAR FOLLOWING THE FISCAL YEAR FOR WHICH THE18 OVEREXPENDITURE OCCURS , AS FOLLOWS:19 (I) A N APPROPRIATION FROM THE GENERAL FUND TO THE SAME20 DEPARTMENT FOR THE SAME PURPOSE OR , IF THERE IS NO APPROPRIATION21 FROM THE GENERAL FUND TO THE SAME DEPARTMENT FOR THE SAME22 PURPOSE, A CORRESPONDING ITEM OR ITEMS OF APPROPRIATION FROM THE23 GENERAL FUND, AS DESCRIBED IN SUBSECTION (3) OF THIS SECTION; AND24 (II) A N APPROPRIATION TO THE SAME DEPARTMENT FOR PERSONAL25 SERVICES MADE PURSUANT TO SECTION 24-75-226 (4)(a)(V), OR, IF THERE26 IS NO APPROPRIATION TO THE SAME DEPARTMENT FOR PERSONAL SERVICES27 1466 -21- MADE PURSUANT TO SECTION 24-75-226 (4)(a)(V), AN APPROPRIATION TO1 THE DEPARTMENT OF CORRECTIONS FOR PERSONAL SERVICES MADE2 PURSUANT TO SECTION 24-75-226 (4)(a)(V).3 (b) (I) T HE DEPARTMENT, INSTITUTION, OR AGENCY SHALL NOT BE4 ALLOWED TO EXPEND ANY AMOUNT RESTRICTED PURSUANT TO5 SUBSECTION (3.5)(a)(I) OF THIS SECTION. A DEPARTMENT THAT HAS AN6 APPROPRIATION RESTRICTED PURSUANT TO SUBSECTION (3.5)(a)(II) OF7 THIS SECTION MAY SUBMIT A REQUEST FOR A SUPPLEMENTAL8 APPROPRIATION FOR AN AMOUNT EQUAL TO THE AMOUNT RESTRICTED .9 (II) W HILE THE SUPPLEMENTAL APPROPRIATION PROCESS IS THE10 APPROPRIATE MEANS BY WHICH TO RESTORE FUNDING THAT WAS11 RESTRICTED PURSUANT TO THIS SUBSECTION (3.5), IT IS THE INTENT OF THE12 GENERAL ASSEMBLY THAT EACH DEPARTMENT RECEIVE THE FULL AMOUNT13 OF MONEY APPROPRIATED FOR A PROGRAM FOR WHICH AN14 OVEREXPENDITURE IS MADE PURSUANT TO SUBSECTION (1)(g) OF THIS15 SECTION OR FOR AN APPROPRIATION THAT IS RESTRICTED PURSUANT TO16 THIS SUBSECTION (3.5), THOUGH IT MAY BE NECESSARY TO ADJUST THE17 SOURCE OF THE MONEY THAT FUNDS THE APPROPRIATION .18 (c) O N OR BEFORE DECEMBER 31, 2024, THE STATE CONTROLLER19 SHALL REPORT TO THE JOINT BUDGET COMMITTEE INFORMATION ABOUT20 EACH OVEREXPENDITURE MADE PURSUANT TO SUBSECTION (1)(g) OF THIS21 SECTION AND EACH APPROPRIATION RESTRICTED PURSUANT TO THIS22 SUBSECTION (3.5).23 (d) T HIS SUBSECTION (3.5) IS REPEALED, EFFECTIVE JUNE 30, 2028.24 SECTION 5. In Colorado Revised Statutes, 24-75-201.1, amend25 (1)(d)(XXIII) as follows:26 24-75-201.1. Restriction on state appropriations - legislative27 1466 -22- declaration - definitions. (1) (d) For each fiscal year, unrestricted1 general fund year-end balances must be retained as a reserve in the2 following amounts:3 (XXIII) For the fiscal year 2022-23 and each fiscal year thereafter,4 fifteen percent of the amount appropriated for expenditure from the5 general fund for that fiscal year; EXCEPT THAT, FOR THE 2023-24 STATE6 FISCAL YEAR, THE AMOUNT RETAINED AS A RESERVE MUST BE FIFTEEN7 PERCENT OF THE AMOUNT APPROPRIATED FOR EXPENDITURE FROM THE8 GENERAL FUND FOR THAT FISCAL YEAR PLUS FIFTEEN PERCENT OF THE9 AMOUNT OF THE GENERAL FUND APPROPRIATIONS REDUCED PURSUANT TO10 SECTION 24-75-226 (4)(a)(I); AND FOR THE 2024-25 STATE FISCAL YEAR,11 THE AMOUNT RETAINED AS A RESERVE MUST BE FIFTEEN PERCENT OF THE12 AMOUNT APPROPRIATED FOR EXPENDITURE FROM THE GENERAL FUND PLUS13 FIFTY-SIX MILLION FOUR HUNDRED NINETY-THREE THOUSAND FIVE14 HUNDRED FORTY-THREE DOLLARS.15 SECTION 6. In Colorado Revised Statutes, 24-75-201.1, amend16 as added by House Bill 24-1231 (1)(d)(XXIII)(B) as follows:17 24-75-201.1. Restriction on state appropriations - legislative18 declaration - definitions. (1) (d) (XXIII) (B) For the fiscal year 2023-2419 and each fiscal year thereafter until the escrow money is released as set20 forth in section 23-40-107, fifteen percent of the amount appropriated for21 expenditure from the general fund THE AMOUNT OF THE RESERVE22 DESCRIBED IN SUBSECTION (1)(d)(XXIII)(A) OF THIS SECTION for that23 fiscal year reduced by forty-one million two hundred fifty thousand24 dollars. As used in this subsection (1)(d)(XXIII)(B), "escrow money" has25 the same meaning as set forth in section 23-40-107 (1)(c).26 SECTION 7. In Colorado Revised Statutes, 24-30-202, add (4.3)27 1466 -23- as follows:1 24-30-202. Procedures - vouchers, warrants, and checks -2 rules - penalties - definitions - repeal. (4.3) (a) T HE CONTROLLER MAY3 RETROACTIVELY ADJUST ENCUMBRANCES AGAINST APPROPRIATIONS FOR4 CONTRACTS AND GRANTS AUTHORIZED PURSUANT TO THE AUTHORITY TO5 SPEND MONEY FROM THE "AMERICAN RESCUE PLAN ACT OF 2021" CASH6 FUND, CREATED IN SECTION 24-75-226 (4)(a)(II), IF THE FUNDING SOURCE7 FOR THE CONTRACT OR GRANT IS SUBSEQUENTLY REFINANCED . ANY8 RETROACTIVE CONTRACT OR GRANT ENCUMBRANCE ADJUSTMENTS9 BETWEEN FUNDING SOURCES AUTHORIZED IN THIS SECTION ARE NOT10 PERMITTED TO INCREASE THE TOTAL ENCUMBRANCE .11 (b) T HIS SUBSECTION (4.3) IS REPEALED, EFFECTIVE JULY 1, 2027.12 SECTION 8. In Colorado Revised Statutes, 24-75-227, amend13 (2)(a) and (3)(a); and add (3.9) as follows:14 24-75-227. Revenue loss restoration cash fund - creation -15 allowable uses - definitions - repeal. (2) (a) The revenue loss16 restoration cash fund is created in the state treasury. The fund consists of17 money credited to the fund in accordance with subsection (2)(b) of this18 section and section 24-75-229 (4)(b) AND ANY OTHER MONEY THAT THE19 GENERAL ASSEMBLY MAY APPROPRIATE OR TRANSFER TO THE FUND .20 Subject to the limitations set forth in subsection (3) of this section, the21 general assembly may appropriate money from the fund to a department22 for the provision of government services, including kindergarten through23 twelfth grade public education, housing, state employees, asset24 maintenance, seniors, criminal justice, state parks, agriculture, and25 transportation infrastructure. The general assembly may transfer money26 from the fund to another cash fund to be used for the provision of such27 1466 -24- government services.1 (3) (a) The total amount that the general assembly appropriates or2 transfers from the fund shall not exceed:3 (I) Three hundred fifty-seven million dollars for the fiscal year4 2021-22; AND5 (II) Three hundred thirty-three million dollars for the fiscal year6 2022-23. and 7 (III) Three hundred ten million dollars for the fiscal year 2023-24.8 (3.9) P URSUANT TO SECTION 24-75-226.5 (6), ON DECEMBER 31,9 2026, THE STATE TREASURER SHALL TRANSFER ANY UNEXPENDED AND10 UNENCUMBERED MONEY IN THE FUND THAT ORIGINATES FROM THE ARPA11 REFINANCE STATE MONEY CASH FUND TO THE ARPA REFINANCE STATE12 MONEY CASH FUND.13 SECTION 9. In Colorado Revised Statutes, 24-75-228, amend14 (4); and add (2.5)(d) and (5.8) as follows:15 24-75-228. Economic recovery and relief cash fund - creation16 - allowable uses - interim task force - report - legislative declaration17 - definitions - repeal. (2.5) (d) A NY MONEY THAT ORIGINATES FROM THE18 ARPA REFINANCE STATE MONEY CASH FUND THAT IS TRANSFERRED TO A19 FUND PURSUANT TO SECTION 24-75-226.5 TO REFINANCE MONEY THAT20 WAS TRANSFERRED FROM THE ECONOMIC RECOVERY AND RELIEF CASH21 FUND PURSUANT TO THIS SUBSECTION (2.5) MUST BE SPENT FOR THE SAME22 PURPOSE AS THE REFINANCED MONEY AS SET FORTH IN SUBSECTION23 (2.5)(a) OF THIS SECTION.24 (4) A department may expend money THAT ORIGINATES FROM25 MONEY THE STATE RECEIVED FROM THE FEDERAL CORONAVIRUS STATE26 FISCAL RECOVERY FUND THAT IS appropriated or transferred from the fund27 1466 -25- for purposes permitted under the "American Rescue Plan Act of 2021"1 and shall not use the money for any purpose prohibited by the act. A2 department or any person who receives money from the fund shall comply3 with any requirements set forth in section 24-75-226.4 (5.8) P URSUANT TO SECTION 24-75-226.5 (6), ON DECEMBER 31,5 2026, THE STATE TREASURER SHALL TRANSFER ANY UNEXPENDED AND6 UNENCUMBERED MONEY IN THE FUND THAT ORIGINATES FROM THE ARPA7 REFINANCE STATE MONEY CASH F UND TO THE ARPA REFINANCE STATE8 MONEY CASH FUND.9 SECTION 10. In Colorado Revised Statutes, 24-75-229, amend10 (5); and add (6.8) as follows:11 24-75-229. Affordable housing and home ownership cash fund12 - creation - allowable uses - task force - legislative declaration -13 definitions - repeal. (5) A department may expend money THAT14 ORIGINATES FROM MONEY THE STATE RECEIVED FROM THE FEDERAL15 CORONAVIRUS STATE FISCAL RECOVERY FUND THAT IS appropriated from16 the fund for purposes permitted under the "American Rescue Plan Act of17 2021" and shall not use the money for any purpose prohibited by the act.18 A department, nonprofit organization, or local government, including a19 county, municipality, special district, or school district, or any other20 person who receives money from the fund shall comply with any21 requirements set forth in section 24-75-226.22 (6.8) P URSUANT TO SECTION 24-75-226.5 (6), ON DECEMBER 31,23 2026, THE STATE TREASURER SHALL TRANSFER ANY UNEXPENDED AND24 UNENCUMBERED MONEY IN THE FUND THAT ORIGINATES FROM THE ARPA25 REFINANCE STATE MONEY CASH F UND TO THE ARPA REFINANCE STATE26 MONEY CASH FUND.27 1466 -26- SECTION 11. In Colorado Revised Statutes, 24-75-230, amend1 (3); and add (4.8) as follows:2 24-75-230. Behavioral and mental health cash fund - creation3 - allowable uses - task force - definitions - repeal. (3) A department4 may expend money THAT ORIGINATES FROM MONEY THE STATE RECEIVED5 FROM THE FEDERAL CORONAVIRUS STATE FISCAL RECOVERY FUND THAT6 IS appropriated from the fund for purposes permitted under the "American7 Rescue Plan Act of 2021" Pub.L. 117-2, as the act may be subsequently8 amended, and shall not use the money for any purpose prohibited by the9 act. A department or any person who receives money from the fund shall10 comply with any requirements set forth in section 24-75-226. 11 (4.8) P URSUANT TO SECTION 24-75-226.5 (6), ON DECEMBER 31,12 2026, THE STATE TREASURER SHALL TRANSFER ANY UNEXPENDED AND13 UNENCUMBERED MONEY IN THE FUND THAT ORIGINATES FROM THE ARPA14 REFINANCE STATE MONEY CASH FUND TO THE ARPA REFINANCE STATE15 MONEY CASH FUND.16 SECTION 12. In Colorado Revised Statutes, 24-75-231, amend17 (3); and add (3.8) as follows:18 24-75-231. Workers, employers, and workforce centers cash19 fund - creation - allowable uses - definitions - repeal. (3) A20 department may expend money THAT ORIGINATES FROM MONEY THE21 STATE RECEIVED FROM THE FEDERAL CORONAVIRUS STATE FISCAL22 RECOVERY FUND THAT IS appropriated from the fund for purposes23 permitted under the "American Rescue Plan Act of 2021" and shall not24 use the money for any purpose prohibited by that act. A department or any25 person who receives money from the fund shall comply with any26 requirements set forth in section 24-75-226.27 1466 -27- (3.8) PURSUANT TO SECTION 24-75-226.5 (6), ON DECEMBER 31,1 2026, THE STATE TREASURER SHALL TRANSFER ANY UNEXPENDED AND2 UNENCUMBERED MONEY IN THE FUND THAT ORIGINATES FROM THE ARPA3 REFINANCE STATE MONEY CASH F UND TO THE ARPA REFINANCE STATE4 MONEY CASH FUND.5 SECTION 13. In Colorado Revised Statutes, 13-32-114, amend6 (4) as follows:7 13-32-114. Judicial department information technology cash8 fund - creation - uses. (4) In addition to the money deposited in the fund9 pursuant to subsection (1) of this section, the fund consists of money10 transferred to the fund from the revenue loss restoration cash fund11 pursuant to section 24-75-227 (3.5) AND MONEY TRANSFERRED TO THE12 FUND FROM THE ARPA REFINANCE STATE MONEY CASH FUND PURSUANT13 TO SECTION 24-75-226.5. Such transferred money is subject to annual14 appropriation by the general assembly to the judicial department for15 information technology infrastructure upgrades from the 2022-23 fiscal16 year through the 2024-25 fiscal year; except that all such transferred17 money THAT ORIGINATES FROM MONEY THE STATE RECEIVED FROM THE18 FEDERAL CORONAVIRUS STATE FISCAL RECOVERY FUND must be expended19 or encumbered OBLIGATED by the judicial department prior to December20 31, 2024.21 SECTION 14. In Colorado Revised Statutes, 23-3.9-302, amend22 (4)(b) as follows:23 23-3.9-302. Student educator stipend program - created -24 guidelines - definition - repeal. (4) (b) The department or the stipend25 recipients shall spend or obligate any money received pursuant to this26 subsection (4) by December 30, 2024. Any money obligated by December27 1466 -28- 31, 2024, must be expended by December 31, 2026 IN ACCORDANCE WITH1 SECTION 24-75-226 (4)(d).2 SECTION 15. In Colorado Revised Statutes, 23-3.9-303, amend3 (4)(b) as follows:4 23-3.9-303. Educator test stipend program - created -5 guidelines - repeal. (4) (b) The department or the stipend recipient shall6 spend or obligate any stipend money received pursuant to this subsection7 (4) by December 30, 2024. Any money obligated by December 31, 2024,8 must be expended by December 31, 2026 IN ACCORDANCE WITH SECTION9 24-75-226 (4)(d).10 SECTION 16. In Colorado Revised Statutes, 23-3.9-402, amend11 (1)(b) as follows:12 23-3.9-402. Temporary educator loan forgiveness program -13 administration - eligibility. (1) (b) The general assembly shall14 appropriate to the commission ten million dollars from the economic15 recovery and relief cash fund created pursuant to section 24-75-228 to16 fund the temporary educator loan forgiveness program. The commission17 or a loan forgiveness recipient shall spend or obligate any money received18 pursuant to this section by December 30, 2024. Any money obligated by19 December 31, 2024, must be expended by December 31, 2026 IN20 ACCORDANCE WITH SECTION 24-75-226 (4)(d).21 SECTION 17. In Colorado Revised Statutes, 24-32-104, amend22 (7)(c) and (7)(d) introductory portion as follows:23 24-32-104. Functions of the division - interconnectivity grant24 program - interconnectivity grant program fund - reporting -25 definition. (7) (c) The interconnectivity grant program fund is hereby26 created in the state treasury and consists of money the state received from27 1466 -29- the federal coronavirus state fiscal recovery fund created in the federal1 "American Rescue Plan Act of 2021", Pub.L. 117-2; MONEY2 TRANSFERRED TO THE FUND FROM THE ARPA REFINANCE STATE MONEY3 CASH FUND PURSUANT TO SECTION 24-75-226.5; and any money that the4 general assembly may appropriate TO THE FUND. Within three days after5 June 28, 2021, the state treasurer shall transfer five million dollars from6 the economic recovery and relief cash fund created in section 24-75-2287 (2)(a) to the fund for use by the division for the purpose of reviewing and8 awarding grants under the grant program. The money in the fund is9 subject to appropriation by the general assembly.10 (d) With respect to grants awarded from money transferred to the11 interconnectivity grant program fund from the economic recovery and12 relief cash fund created in section 24-75-228 (2)(a) OR FROM THE ARPA13 REFINANCE STATE MONEY CASH FUND CREATED IN SECTION 24-75-226.5,14 grants may only be awarded for broadband projects that, pursuant to15 treasury department interim regulations implementing the federal16 "American Rescue Plan Act of 2021", Pub.L. 117-2, provide broadband17 infrastructure that is designed to provide service to unserved or18 underserved households and businesses and that is designed to, upon19 completion:20 SECTION 18. In Colorado Revised Statutes, 24-32-721, amend21 (1) as follows:22 24-32-721. Colorado affordable housing construction grants23 and loans - housing development grant fund - creation - housing24 assistance for persons with behavioral, mental health, or substance25 use disorders - cash fund - appropriation - report to general assembly26 - rules - definitions - repeal. (1) There is created in the state treasury the27 1466 -30- housing development grant fund, which fund is administered by the1 division and is referred to in this section as the "fund". The fund consists2 of money credited to the fund in accordance with section 39-26-1233 (3)(b); money transferred to the fund in accordance with section4 24-22-118 (2); MONEY TRANSFERRED TO THE FUND FROM THE ARPA5 REFINANCE STATE MONEY CASH F UND PURSUANT TO SECTION 24-75-226.5;6 money appropriated to the fund by the general assembly; all money7 transferred to the fund from the marijuana tax cash fund created in section8 39-28.8-501 (1) and any other cash fund maintained by the state; all9 money transferred to the fund from the general fund and the revenue loss10 restoration cash fund created in section 24-75-227 (2) pursuant to11 subsections (6) and (7) of this section; all money collected by the division12 for purposes of this section from federal grants, from other contributions,13 gifts, grants, and donations received from any other organization, entity,14 or individual, public or private; and from any fees or interest earned on15 such money. The division is authorized and directed to solicit, accept,16 expend, and disburse all money collected for the fund from the sources17 specified in this subsection (1) for the purpose of making grants, loans,18 or other forms of assistance that may be awarded under section19 24-32-721.7 and for program administration as provided in this section.20 All such money must be transmitted to the state treasurer to be credited21 to the fund. The money in the fund is continuously appropriated to the22 division for the purposes of this section.23 SECTION 19. In Colorado Revised Statutes, 24-32-729, amend24 (4)(b) as follows:25 24-32-729. Transformational affordable housing through local26 investments - grant program - investments eligible for funding -27 1466 -31- report - definitions - repeal. (4) Funds. (b) The state treasurer shall1 credit all interest and income derived from the investment and deposit of2 money in the fund to the fund. Except as otherwise required by this3 subsection (4)(b), all money not expended or encumbered, and all interest4 earned on the investment or deposit of money in the fund, must remain in5 the fund and shall not revert to the general fund or any other fund at the6 end of any fiscal year. The money in the fund is continuously7 appropriated to the division for the purposes of this section. Any money8 in the fund THAT ORIGINATES FROM THE MONEY THE STATE RECEIVED9 FROM THE CORONAVIRUS STATE FISCAL RECOVERY FUND that is not10 expended or obligated by December 30, 2024, reverts to the "American11 Rescue Plan Act of 2021" cash fund created in section 24-75-226 (2) in12 accordance with section 24-75-226 (4)(d).13 SECTION 20. In Colorado Revised Statutes, 24-32-732, amend14 (5)(a), (5)(d) introductory portion, and (5)(f) as follows:15 24-32-732. Connecting Coloradans experiencing homelessness16 with services, recovery care, and housing supports grant program -17 funding - report - definitions - repeal. (5) Connecting Coloradans18 experiencing homelessness with services, recovery care, and housing19 supports fund - transfer of money to the fund - appropriation.20 (a) The connecting Coloradans experiencing homelessness with services,21 recovery care, and housing supports fund is created in the department.22 The fund consists of money transferred to the fund in accordance with23 subsection (5)(d) of this section; MONEY TRANSFERRED TO THE FUND24 FROM THE ARPA REFINANCE STATE MONEY CASH FUND PURSUANT TO25 SECTION 24-75-226.5; money appropriated to the fund by the general26 assembly; and any gifts, grants, or donations from any public or private27 1466 -32- sources, including governmental entities, that the division is authorized1 to seek and accept.2 (d) Within three business days of May 31, 2022, the state treasurer3 shall transfer one hundred five million dollars from the economic4 recovery and relief cash fund created in section 24-75-228 that originates5 from the money the state received from the federal coronavirus state6 fiscal recovery fund to the fund for the purpose of implementing this7 section. The department shall only use the money transferred pursuant to8 this subsection (5)(d), AND ANY MONEY TRANSFERRED TO THE FUND THAT9 ORIGINATES FROM THE ARPA REFINANCE STATE MONEY CASH FUND THAT10 IS SUBSTITUTED FOR MONEY TRANSFERRED FROM THE ECONOMIC11 RECOVERY AND RELIEF CASH FUND PURSUANT TO THIS SUBSECTION (5)(d),12 for:13 (f) Money spent pursuant to this subsection (5)(f) SUBSECTION (5)14 must conform with the allowable purposes set forth in the federal15 "American Rescue Plan Act of 2021", Pub.L. 117-2, as amended. The16 division shall spend or obligate such appropriation prior to December 30,17 2024, and expend the appropriation on or before December 31, 2026 IN18 ACCORDANCE WITH SECTION 24-75-226 (4)(d).19 SECTION 21. In Colorado Revised Statutes, 24-32-3207, amend20 (6)(b) as follows:21 24-32-3207. Colorado heritage communities fund - creation -22 source of funds. (6) (b) The division of local government in the23 department shall use the money transferred pursuant to subsection (6)(a)24 of this section, AND ANY MONEY THAT IS TRANSFERRED FROM THE ARPA25 REFINANCE STATE MONEY CASH FUND TO THE COLORADO HERITAGE26 COMMUNITIES FUND PURSUANT TO SECTION 24-75-226.5 TO REFINANCE27 1466 -33- MONEY THAT WAS TRANSFERRED TO THE COLORADO HERITAGE1 COMMUNITIES FUND PURSUANT TO SUBSECTION (6)(a)(I) OF THIS SECTION,2 for the creation, implementation, and administration of the local3 government affordable housing development incentives grant program4 created in section 24-32-130 (2) in accordance with the requirements of5 section 24-32-130.6 SECTION 22. In Colorado Revised Statutes, 24-33.5-532,7 amend (4) as follows:8 24-33.5-532. Behavioral health information and data-sharing9 in the criminal justice system - grants - appropriation - repeal.10 (4) For the 2022-23 state fiscal year, the general assembly shall11 appropriate three million five hundred thousand dollars from the12 behavioral and mental health cash fund created in section 24-75-230 to13 the department for the purposes of this section. Any money remaining at14 the end of the 2022-23 state fiscal year from this appropriation is further15 appropriated to the department for the purposes of this section. Any16 money that is not expended or obligated by December 30, 2024, reverts17 to the "American Rescue Plan Act of 2021" cash fund created in section18 24-75-226 (2) THE DEPARTMENT SHALL OBLIGATE AND SPEND THE MONEY19 RECEIVED PURSUANT TO THIS SUBSECTION (4) in accordance with section20 24-75-226 (4)(d). Any money obligated by December 30, 2024, must be21 expended by December 31, 2026.22 SECTION 23. In Colorado Revised Statutes, 24-37.5-904,23 amend (1.5)(f)(II) and (2)(a) as follows:24 24-37.5-904. Digital inclusion grant program - income-eligible25 household reimbursement program - creation - award criteria -26 digital inclusion grant program fund - definition - reporting - repeal.27 1466 -34- (1.5) (f) (II) All money used for implementation of the program must be1 obligated by December 31, 2024. AND SPENT IN ACCORDANCE WITH2 SECTION 24-75-226 (4)(d).3 (2) (a) The digital inclusion grant program fund is hereby created4 in the state treasury and consists of money the state received from the5 federal coronavirus state fiscal recovery fund created in the federal6 "American Rescue Plan Act of 2021", Pub.L. 117-2; MONEY7 TRANSFERRED TO THE FUND FROM THE ARPA REFINANCE STATE MONEY8 CASH FUND PURSUANT TO SECTION 24-75-226.5; and any money that the9 general assembly may appropriate TO THE FUND. Within three days after10 June 28, 2021, the state treasurer shall transfer thirty-five million dollars11 from the economic recovery and relief cash fund created in section12 24-75-228 (2)(a) to the fund for use by the broadband office for the13 purpose of reviewing and awarding grants under the grant program. The14 money in the fund is subject to appropriation by the general assembly.15 SECTION 24. In Colorado Revised Statutes, 24-46.3-704,16 amend (2)(d) as follows:17 24-46.3-704. Work force innovation grant program - creation18 - local boards to administer - eligibility for grants - use of grants -19 grant proposal requirements - other innovation activities performed20 by local boards - reporting to statewide database. (2) (d) All grants21 awarded pursuant to this section must be obligated by December 31,22 2024, and expended by December 31, 2026 AND SPENT IN ACCORDANCE23 WITH SECTION 24-75-226 (4)(d).24 SECTION 25. In Colorado Revised Statutes, 24-48.5-406,25 amend (1)(a) introductory portion as follows:26 24-48.5-406. Regional talent development initiative grant27 1466 -35- program fund. (1) (a) There is created in the state treasury the regional1 talent development initiative grant program fund. T HE FUND CONSISTS OF2 MONEY TRANSFERRED TO THE FUND PURSUANT TO THIS SUBSECTION (1)3 AND MONEY TRANSFERRED TO THE FUND FROM THE ARPA REFINANCE4 STATE MONEY CASH FUND PURSUANT TO SECTION 24-75-226.5. Three days5 after May 26, 2022, the state treasurer shall transfer ninety-one million6 dollars from the workers, employers, and workforce centers cash fund7 created in section 24-75-231 (2)(a) to the fund as follows:8 SECTION 26. In Colorado Revised Statutes, 24-75-219, amend9 (7)(a)(I) as follows:10 24-75-219. Transfers - transportation - capital construction -11 definitions - repeal. (7) In addition to any other transfers required by this12 section:13 (a) On June 30, 2021, from the money that the state received from14 either the federal coronavirus state fiscal recovery fund under section15 9901 of title IX, subtitle M of the federal "American Rescue Plan Act of16 2021", Pub.L. 117-2, which is eligible to be used as specified in section17 602 (c)(I)(C) of said section 9901, or from the general fund, as specified,18 the state treasurer shall transfer:19 (I) One hundred eighty-two million one hundred sixty thousand20 dollars from money the state received from the federal coronavirus state21 fiscal recovery fund to the state highway fund. Of this amount,22 twenty-two million one hundred sixty thousand dollars is for the purpose23 of providing additional funding for the revitalizing main streets program24 and five hundred thousand dollars is for the purpose of acquiring,25 planning the development of, or developing the Burnham Yard rail26 property in Denver. A NY MONEY THAT IS TRANSFERRED FROM THE ARPA27 1466 -36- REFINANCE STATE MONEY CASH FUND TO THE STATE HIGHWAY FUND1 PURSUANT TO SECTION 24-75-226.5 TO REFINANCE MONEY THAT WAS2 TRANSFERRED TO THE STATE HIGHWAY FUND PURSUANT TO THIS3 SUBSECTION (7)(a)(I) MUST BE SPENT FOR THE SAME PURPOSES AS THE4 REFINANCED MONEY, AS SET FORTH IN THIS SUBSECTION (7)(a)(I).5 SECTION 27. In Colorado Revised Statutes, 25-1.5-102, amend6 (1)(e) as follows:7 25-1.5-102. Epidemic and communicable diseases - powers and8 duties of department - rules - definitions. (1) The department has, in9 addition to all other powers and duties imposed upon it by law, the10 powers and duties provided in this section as follows:11 (e) For fiscal year 2022-23, the general assembly shall appropriate12 ten million dollars from the economic recovery and relief cash fund13 created in section 24-75-228 to the department. The department shall use14 this appropriation for recruitment and re-engagement efforts of workers15 in the health-care profession with current or expired licenses and staffing.16 Any money remaining at the end of the 2022-23 state fiscal year from this17 appropriation is further appropriated to the department for the purposes18 of this section. Any money that is not expended or obligated by December19 30, 2024, reverts to the "American Rescue Plan Act of 2021" cash fund20 created in section 24-75-226 (2) THE DEPARTMENT SHALL OBLIGATE AND21 SPEND THE MONEY RECEIVED PURSUANT TO THIS SUBSECTION (1)(e) in22 accordance with section 24-75-226 (4)(d). Any money obligated by23 December 30, 2024, must be expended by December 31, 2026.24 SECTION 28. In Colorado Revised Statutes, 25-1.5-406, amend25 (9) as follows:26 25-1.5-406. School nurse grant program - creation - eligibility27 1466 -37- - award of grants - rules - report - legislative declaration - definitions.1 (9) The general assembly shall appropriate three million dollars from the2 economic recovery and relief cash fund created in section 24-75-228 to3 the department for the grant program. Any money remaining at the end of4 the 2022-23 state fiscal year from this appropriation is further5 appropriated to the department for the purposes of this section. Any6 money that is not expended or obligated by December 30, 2024, reverts7 to the "American Rescue Plan Act of 2021" cash fund created in section8 24-75-226 (2) THE DEPARTMENT SHALL OBLIGATE AND SPEND THE MONEY9 RECEIVED PURSUANT TO THIS SUBSECTION (9) in accordance with section10 24-75-226 (4)(d). Any money obligated by December 30, 2024, must be11 expended by December 31, 2026.12 SECTION 29. In Colorado Revised Statutes, 25.5-1-207, amend13 (2)(d) as follows:14 25.5-1-207. Rural provider access and affordability stimulus15 grant program - advisory committee - fund - reporting - rules -16 definitions - repeal. (2) Grant program - permissible uses of grant17 money. (d) To be eligible to receive grant money THAT ORIGINATES18 FROM THE MONEY THE STATE RECEIVED FROM THE CORONAVIRUS STATE19 FISCAL RECOVERY FUND for a capital expenditure, a grant recipient must20 submit to the state department a written justification as set forth in 3121 CFR 35.6 (b)(4) for the capital expenditure; except that this requirement22 does not apply if the state department determines that the written23 justification is not required based on how the expenditures authorized24 under this section will be reported to the United States department of the25 treasury. F OR GRANT MONEY THAT DOES NOT ORIGINATE FROM THE26 MONEY THE STATE RECEIVED FROM THE CORONAVIRUS STATE FISCAL27 1466 -38- RECOVERY FUND, A WRITTEN JUSTIFICATION IS NOT REQUIRED, EXCEPT AS1 THE STATE DEPARTMENT DETERMINES NECESSARY TO COMPLY WITH2 FEDERAL WRITTEN JUSTIFICATION REQUIREMENTS .3 SECTION 30. In Colorado Revised Statutes, 26-2-141, amend4 (2)(b) as follows:5 26-2-141. High-quality work management system -6 implementation - funding - repeal. (2) (b) T HE USE OF money spent 7 APPROPRIATED pursuant to this subsection (2) must conform with the8 allowable purposes set forth in the federal "American Rescue Plan Act of9 2021", Pub.L. 117-2, as amended. The state department shall either spend10 or obligate such appropriation prior to December 30, 2024, and expend11 the appropriation on or before December 31, 2026 IN ACCORDANCE WITH12 SECTION 24-75-226 (4)(d).13 SECTION 31. In Colorado Revised Statutes, 26-2-307, amend14 (1)(b)(III.5)(B) as follows:15 26-2-307. Fuel assistance payments - eligibility for federal16 standard utility allowance - supplemental utility assistance fund17 established - definitions - repeal. (1) (b) Except as provided in18 subsection (1)(d) of this section:19 (III.5) (B) T HE USE OF money spent APPROPRIATED pursuant to20 this subsection (1)(b)(III.5) must conform with the allowable purposes set21 forth in the federal "American Rescue Plan Act of 2021", Pub.L. 117-2,22 as amended. The state department shall either spend or obligate such23 appropriation prior to December 30, 2024, and expend the appropriation24 on or before December 31, 2026 IN ACCORDANCE WITH SECTION25 24-75-226 (4)(d).26 SECTION 32. In Colorado Revised Statutes, 26-5-117, amend27 1466 -39- (2)(b)(III) as follows:1 26-5-117. Out-of-home placement for children and youth with2 mental or behavioral needs - funding - report - rules - legislative3 declaration - definitions - repeal. (2) (b) (III) T HE USE OF money spent 4 APPROPRIATED pursuant to this subsection (2) must conform with the5 allowable purposes set forth in the federal "American Rescue Plan Act of6 2021", Pub.L. 117-2, as amended. The state department shall either spend7 or obligate such appropriation prior to December 30, 2024, and expend8 the appropriation on or before December 31, 2026 IN ACCORDANCE WITH9 SECTION 24-75-226 (4)(d).10 SECTION 33. In Colorado Revised Statutes, 26.5-3-804, amend11 (8.5)(b) as follows:12 26.5-3-804. Employer-based child care facility grant program13 - created - timeline and criteria - eligibility - grant awards - reports14 - funding - definitions - repeal. (8.5) (b) T HE USE OF money spent 15 APPROPRIATED pursuant to this subsection (8.5) must conform with the16 allowable purposes set forth in the federal "American Rescue Plan Act of17 2021", Pub.L. 117-2, as amended. The department shall either spend or18 obligate such appropriation prior to December 30, 2024, and expend the19 appropriation on or before December 31, 2026 IN ACCORDANCE WITH20 SECTION 24-75-226 (4)(d).21 SECTION 34. In Colorado Revised Statutes, 26.5-3-805, amend22 (7)(b) as follows:23 26.5-3-805. Early care and education recruitment and24 retention grant and scholarship program - created - criteria and25 eligibility - grant and scholarship awards - reports - funding - rules26 - definitions - repeal. (7) (b) T HE USE OF money spent APPROPRIATED27 1466 -40- pursuant to this subsection (7) must conform with the allowable purposes1 set forth in the federal "American Rescue Plan Act of 2021", Pub.L.2 117-2, as amended. The department shall either spend or obligate such3 appropriation prior to December 30, 2024, and expend the appropriation4 on or before December 31, 2026 IN ACCORDANCE WITH SECTION5 24-75-226 (4)(d).6 SECTION 35. In Colorado Revised Statutes, 26.5-3-808, amend7 (5)(b) as follows:8 26.5-3-808. Family, friend, and neighbor support programs -9 advisory group - training and support program - funding - definitions10 - repeal. (5) (b) T HE USE OF money spent APPROPRIATED pursuant to this11 subsection (5) AND MONEY THAT ORIGINATES FROM THE ARPA12 REFINANCE STATE MONEY CASH FUND , CREATED IN SECTION 24-75-226.5,13 APPROPRIATED FOR THE SAME PURPOSE , must conform with the allowable14 purposes set forth in the federal "American Rescue Plan Act of 2021",15 Pub.L. 117-2, as amended. The department shall either spend or obligate16 such appropriation prior to December 30, 2024, and expend the17 appropriation on or before December 31, 2026 IN ACCORDANCE WITH18 SECTION 24-75-226 (4)(d).19 SECTION 36. In Colorado Revised Statutes, 26.5-3-904, amend20 (1)(b) as follows:21 26.5-3-904. Home visiting grant program - authorized22 requirements - implementation partner - rules - definition - repeal.23 (1) (b) T HE USE OF money spent APPROPRIATED pursuant to this24 subsection (1) must conform with the allowable purposes set forth in the25 federal "American Rescue Plan Act of 2021", Pub.L. 117-2, as amended.26 The department shall either spend or obligate such appropriation prior to27 1466 -41- December 30, 2024, and expend the appropriation on or before December1 31, 2026 IN ACCORDANCE WITH SECTION 24-75-226 (4)(d).2 SECTION 37. In Colorado Revised Statutes, 27-60-103, amend3 (1.5)(b)(II) as follows:4 27-60-103. Behavioral health crisis response system - services5 - request for proposals - criteria - reporting - rules - definitions -6 repeal. (1.5) (b) (II) T HE USE OF money spent APPROPRIATED pursuant to7 this subsection (1.5) AND MONEY THAT ORIGINATES FROM THE ARPA8 REFINANCE STATE MONEY CASH FUND , CREATED IN SECTION 24-75-226.5,9 APPROPRIATED FOR THE SAME PURPOSE , must conform with the allowable10 purposes set forth in the federal "American Rescue Plan Act of 2021",11 Pub.L. 117-2, as the act may be subsequently amended. The state12 department shall either spend or obligate such appropriation prior to13 December 30, 2024, and expend the appropriation on or before December14 31, 2026 IN ACCORDANCE WITH SECTION 24-75-226 (4)(d).15 SECTION 38. In Colorado Revised Statutes, 27-60-114, amend16 (8) and (11) as follows:17 27-60-114. Colorado land-based tribe behavioral health18 services grant - creation - funding - definitions - repeal. (8) To be19 eligible to receive a grant, a grant applicant THAT REQUESTS GRANT20 MONEY THAT ORIGINATES FROM THE MONEY THE STATE RECEIVED FROM21 THE CORONAVIRUS STATE FISCAL RECOVERY FUND must submit to the state22 department a written justification as set forth in 31 CFR 35.6 (b)(4) for23 the capital expenditure; except that this requirement does not apply if the24 state department determines that the written justification is not required25 based on how the expenditures authorized pursuant to this section will be26 reported to the United States department of the treasury. F OR MONEY27 1466 -42- THAT DID NOT ORIGINATE FROM THE MONEY THE STATE RECEIVED FROM1 THE CORONAVIRUS STATE FISCAL RECOVERY FUND , A WRITTEN2 JUSTIFICATION IS NOT REQUIRED, EXCEPT AS THE STATE DEPARTMENT3 DETERMINES NECESSARY TO COMPLY WITH FEDERAL WRITTEN4 JUSTIFICATION REQUIREMENTS.5 (11) The state department shall distribute the grant money to the6 grant recipient within thirty days after the grant recipient submits a7 written justification specified in subsection (8) of this section but not later8 than December 31, 2024. The grant recipient shall spend or obligate all9 grant money awarded to the grant recipient by December 31, 2024. Any10 money obligated by December 31, 2024, must be expended by December11 31, 2026 IN ACCORDANCE WITH SECTION 24-75-226 (4)(d).12 SECTION 39. In Colorado Revised Statutes, 27-60-405, amend13 (2)(b) as follows:14 27-60-405. Grant program funding - requirements - reports15 - appropriation. (2) (b) For each grant awarded for a capital16 expenditure, the BHA is responsible for preparing the written justification17 required pursuant to 31 CFR 35.6 (b)(4). A grant applicant that requests18 grant money THAT ORIGINATES FROM THE MONEY THE STATE RECEIVED19 FROM THE CORONAVIRUS STATE FISCAL RECOVERY FUND for a capital20 expenditure must submit to the BHA information requested by the BHA21 for inclusion in the written justification; except that this requirement does22 not apply if the BHA determines that the written justification is not23 required based on how the expenditures authorized pursuant to this part24 4 will be reported to the United States department of the treasury. F OR25 GRANT MONEY THAT DID NOT ORIGINATE FROM THE MONEY THE STATE26 RECEIVED FROM THE CORONAVIRUS STATE FISCAL RECOVERY FUND , A27 1466 -43- WRITTEN JUSTIFICATION IS NOT REQUIRED , EXCEPT AS THE BHA1 DETERMINES NECESSARY TO COMPLY WITH FEDERAL WRITTEN2 JUSTIFICATION REQUIREMENTS.3 SECTION 40. In Colorado Revised Statutes, 27-60-505, amend4 (2) introductory portion and (3)(b) as follows:5 27-60-505. F OR GRANT MONEY THAT DID17 NOT ORIGINATE FROM THE MONEY THE STATE RECEIVED FROM THE18 CORONAVIRUS STATE FISCAL RECOVERY FUND , A WRITTEN JUSTIFICATION19 IS NOT REQUIRED, EXCEPT AS THE BHA DETERMINES NECESSARY TO20 COMPLY WITH FEDERAL WRITTEN JUSTIFICATION REQUIREMENTS .21 SECTION 41. In Colorado Revised Statutes, 27-71-103, amend22 (3) as follows:23 27-71-103. Mental health residential facilities - additional24 beds. (3) The department shall distribute the money for the creation of25 additional beds pursuant to this section no later than December 30, 2024.26 Any person receiving money pursuant to this section shall spend or27 1466 -44- obligate all money received by December 30, 2024. Any money obligated1 by December 30, 2024, must be expended by December 30, 2026 IN2 ACCORDANCE WITH SECTION 24-75-226 (4)(d).3 SECTION 42. In Colorado Revised Statutes, 27-80-127, amend4 (2)(a)(II) as follows:5 27-80-127. Children and youth in need of residential mental6 health and substance use treatment - repeal. (2) (a) (II) T HE USE OF7 money spent APPROPRIATED pursuant to this subsection (2) AND MONEY8 THAT ORIGINATES FROM THE ARPA REFINANCE STATE MONEY CASH FUND,9 CREATED IN SECTION 24-75-226.5, APPROPRIATED FOR THE SAME PURPOSE,10 must conform with the allowable purposes set forth in the federal11 "American Rescue Plan Act of 2021", Pub.L. 117-2, as amended. The12 department shall either spend or obligate such appropriation prior to13 December 30, 2024, and expend the appropriation on or before December14 31, 2026 IN ACCORDANCE WITH SECTION 24-75-226 (4)(d).15 SECTION 43. In Colorado Revised Statutes, 27-90-112, amend16 (2)(a)(II) as follows:17 27-90-112. Youth neuro-psych facility - funding - repeal.18 (2) (a) (II) Money spent pursuant to this subsection (2) must conform19 with the allowable purposes set forth in the federal "American Rescue20 Plan Act of 2021", Pub.L. 117-2, as amended. The department of human21 services shall either spend or obligate such appropriation prior to22 December 30, 2024, and expend the appropriation on or before December23 31, 2026 IN ACCORDANCE WITH SECTION 24-75-226 (4)(d).24 SECTION 44. In Colorado Revised Statutes, 27-94-107, amend25 (1) as follows:26 27-94-107. Renovation for additional beds. (1) The department27 1466 -45- of human services shall renovate a building at the center to add at least1 sixteen inpatient beds. The department shall spend or obligate all money2 appropriated for the renovation by December 30, 2024. Any money3 obligated by December 30, 2024, must be expended by December 30,4 2026 IN ACCORDANCE WITH SECTION 24-75-226 (4)(d).5 SECTION 45. In Colorado Revised Statutes, 35-1-117, amend6 (2)(b)(III), (3)(c)(III), and (6)(c) as follows:7 35-1-117. Community food access program - creation -8 purpose - duties and responsibilities - grant program - advisory9 committee - funding - reporting - rules - definitions - repeal.10 (2) (b) (III) T HE USE OF money spent APPROPRIATED pursuant to this11 subsection (2)(b) must conform with the allowable purposes set forth in12 the federal "American Rescue Plan Act of 2021", Pub.L. 117-2, as13 amended. The department shall either spend or obligate such14 appropriation prior to December 30, 2024, and expend the appropriation15 on or before December 31, 2026 IN ACCORDANCE WITH SECTION16 24-75-226 (4)(d).17 (3) (c) (III) Money spent pursuant to this subsection (3)(c) must18 conform with the allowable purposes set forth in the federal "American19 Rescue Plan Act of 2021", Pub.L. 117-2, as amended. The department20 shall either spend or obligate such appropriation prior to December 30,21 2024, and expend the appropriation on or before December 31, 2026 IN22 ACCORDANCE WITH SECTION 24-75-226 (4)(d).23 (6) (c) T HE USE OF money spent APPROPRIATED pursuant to this24 subsection (6) must conform with the allowable purposes set forth in the25 federal "American Rescue Plan Act of 2021", Pub.L. 117-2, as amended.26 The department of human services shall either spend or obligate such27 1466 -46- appropriation prior to December 30, 2024, and expend the appropriation1 on or before December 31, 2026 IN ACCORDANCE WITH SECTION2 24-75-226 (4)(d).3 SECTION 46. In Colorado Revised Statutes, 37-60-134, amend4 (7)(b) as follows:5 37-60-134. Groundwater compact compliance and6 sustainability fund - creation - conservation district7 recommendations for expenditures - state engineer approval -8 legislative declaration - transfer - definitions - reports - notice to9 revisor of statutes - repeal. (7) (b) On August 15, 2024, if there is10 unobligated OR UNENCUMBERED money in the fund, the state treasurer11 shall:12 (I) If the amount of unobligated OR UNENCUMBERED money is13 twenty million dollars or less, transfer all of the unobligated money to the14 water plan implementation account; or15 (II) If the amount of unobligated OR UNENCUMBERED money is16 greater than twenty million dollars, transfer to the water plan17 implementation account twenty million dollars.18 SECTION 47. Appropriation - adjustments to 2023 long bill.19 (1) For the 2023-24 state fiscal year, $495,000,000 is appropriated to the20 department of corrections. This appropriation is from the "American21 rescue plan act of 2021" cash fund created in section 24-75-226 (2),22 C.R.S., and is of money the state received from the federal coronavirus23 state fiscal recovery fund. To implement this act, the department may use24 this appropriation for centrally appropriated personal services pursuant to25 section 24-75-226 (4)(a)(IV), C.R.S. Amounts appropriated for centrally26 appropriated personal services may be expended by a department in any27 1466 -47- line item that includes a general fund appropriation for personal services1 up to the amount that is spent for personal services in the line item for2 state fiscal year 2023-24.3 (2) To implement this act and pursuant to section 24-75-2264 (4.1)(c), C.R.S., the total general fund appropriation made in the annual5 general appropriation act for the 2023-24 state fiscal year to the6 department of corrections is decreased by $495,000,000. To implement7 the reduction in the department's total general fund appropriation, and8 pursuant to section 24-75-226 (4.1)(a)(I), C.R.S., the amount of general9 fund money appropriated in a specific line item for personal services10 expenses for state fiscal year 2023-24 is reduced by the amount of money11 from the "American rescue plan act of 2021" cash fund that is expended12 in a line item under subsection (1) of this section.13 SECTION 48. Appropriation - adjustments to 2024 long bill.14 (1) For the 2024-25 state fiscal year, $324,000,000 is appropriated to the15 department of corrections. This appropriation is from the "American16 rescue plan act of 2021" cash fund created in section 24-75-226 (2),17 C.R.S., and is of money the state received from the federal coronavirus18 state fiscal recovery fund. To implement this act, the department may use19 this appropriation for centrally appropriated personal services pursuant to20 section 24-75-226 (4)(a)(V), C.R.S. Amounts appropriated for centrally21 appropriated personal services may be expended by a department in any22 line item that includes a general fund appropriation for personal services23 up to the amount that is spent for personal services in the line item as of24 January 31, 2025.25 (2) To implement this act and pursuant to section 24-75-22626 (4.1)(c), C.R.S., the total general fund appropriation made in the annual27 1466 -48- general appropriation act for the 2024-25 state fiscal year to the1 department of corrections is decreased by $324,000,000. To implement2 the reduction in the department's total general fund appropriation, and3 pursuant to section 24-75-226 (4.1)(a)(II), C.R.S., the amount of general4 fund money appropriated in a line item for personal services expenses for5 state fiscal year 2024-25 is reduced by the amount of money from the6 "American rescue plan act of 2021" cash fund that is expended in a line7 item under subsection (1) of this section.8 SECTION 49. Appropriation - adjustments to 2023 long bill.9 (1) For the 2023-24 state fiscal year, $214,000,000 is appropriated to the10 department of human services. This appropriation is from the "American11 rescue plan act of 2021" cash fund created in section 24-75-226 (2),12 C.R.S., and is of money the state received from the federal coronavirus13 state fiscal recovery fund. To implement this act, the department may use14 this appropriation for centrally appropriated personal services pursuant to15 section 24-75-226 (4)(a)(IV), C.R.S. Amounts appropriated for centrally16 appropriated personal services may be expended by a department in any17 line item that includes a general fund appropriation for personal services18 up to the amount that is spent for personal services in the line item for19 state fiscal year 2023-24.20 (2) To implement this act and pursuant to section 24-75-22621 (4.1)(c), C.R.S., the total general fund appropriation made in the annual22 general appropriation act for the 2023-24 state fiscal year to the23 department of human services is decreased by $214,000,000. To24 implement the reduction in the department's total general fund25 appropriation, and pursuant to section 24-75-226 (4.1)(a)(I), C.R.S., the26 amount of general fund money appropriated in a specific line item for27 1466 -49- personal services expenses for state fiscal year 2023-24 is reduced by the1 amount of money from the "American rescue plan act of 2021" cash fund2 that is expended in a line item under subsection (1) of this section. 3 SECTION 50. Appropriation - adjustments to 2024 long bill.4 (1) For the 2024-25 state fiscal year, $63,182,048 is appropriated to the5 department of human services. This appropriation is from the "American6 rescue plan act of 2021" cash fund created in section 24-75-226 (2),7 C.R.S., and is of money the state received from the federal coronavirus8 state fiscal recovery fund. To implement this act, the department may use9 this appropriation for centrally appropriated personal services pursuant to10 section 24-75-226 (4)(a)(V), C.R.S. Amounts appropriated for centrally11 appropriated personal services may be expended by a department in any12 line item that includes a general fund appropriation for personal services13 up to the amount that is spent for personal services in the line item as of14 January 31, 2025.15 (2) To implement this act and pursuant to section 24-75-22616 (4.1)(c), C.R.S., the total general fund appropriation made in the annual17 general appropriation act for the 2024-25 state fiscal year to the18 department of human services is decreased by $63,182,048. To implement19 the reduction in the department's total general fund appropriation, and20 pursuant to section 24-75-226 (4.1)(a)(II), C.R.S., the amount of general21 fund money appropriated in a line item for personal services expenses for22 state fiscal year 2024-25 is reduced by the amount of money from the23 "American rescue plan act of 2021" cash fund that is expended in a line24 item under subsection (1) of this section.25 SECTION 51. Appropriation - adjustments to 2023 long bill.26 (1) For the 2023-24 state fiscal year, $309,000,000 is appropriated to the27 1466 -50- judicial department, excluding judicial independent agencies. This1 appropriation is from the "American rescue plan act of 2021" cash fund2 created in section 24-75-226 (2), C.R.S., and is of money the state3 received from the federal coronavirus state fiscal recovery fund. To4 implement this act, the department, excluding judicial independent5 agencies, may use this appropriation for centrally appropriated personal6 services pursuant to section 24-75-226 (4)(a)(IV), C.R.S. Amounts7 appropriated for centrally appropriated personal services may be8 expended by a department in any line item that includes a general fund9 appropriation for personal services up to the amount that is spent for10 personal services in the line item for state fiscal year 2023-24.11 (2) To implement this act and pursuant to section 24-75-22612 (4.1)(c), C.R.S., the total general fund appropriation made in the annual13 general appropriation act for the 2023-24 state fiscal year to the judicial14 department, excluding judicial independent agencies, is decreased by15 $309,000,000. To implement the reduction in the department's total16 general fund appropriation, and pursuant to section 24-75-226 (4.1)(a)(I),17 C.R.S., the amount of general fund money appropriated in a specific line18 item for personal services expenses for state fiscal year 2023-24 is19 reduced by the amount of money from the "American rescue plan act of20 2021" cash fund that is expended in a line item under subsection (1) of21 this section.22 SECTION 52. Appropriation - adjustments to 2024 long bill.23 (1) For the 2024-25 state fiscal year, $200,000,000 is appropriated to the24 judicial department, excluding judicial independent agencies. This25 appropriation is from the "American rescue plan act of 2021" cash fund26 created in section 24-75-226 (2), C.R.S., and is of money the state27 1466 -51- received from the federal coronavirus state fiscal recovery fund. To1 implement this act, the department, excluding judicial independent2 agencies, may use this appropriation for centrally appropriated personal3 services pursuant to section 24-75-226 (4)(a)(V), C.R.S. Amounts4 appropriated for centrally appropriated personal services may be5 expended by a department in any line item that includes a general fund6 appropriation for personal services up to the amount that is spent for7 personal services in the line item as of January 31, 2025.8 (2) To implement this act and pursuant to section 24-75-2269 (4.1)(c), C.R.S., the total general fund appropriation made in the annual10 general appropriation act for the 2024-25 state fiscal year to the judicial11 department, excluding judicial independent agencies, is decreased by12 $200,000,000. To implement the reduction in the department's total13 general fund appropriation, and pursuant to section 24-75-226 (4.1)(a)(II),14 C.R.S., the amount of general fund money appropriated in a line item for15 personal services expenses for state fiscal year 2024-25 is reduced by the16 amount of money from the "American rescue plan act of 2021" cash fund17 that is expended in a line item under subsection (1) of this section. 18 SECTION 53. Appropriation to the departments of education,19 higher education, and public health and environment for the fiscal20 year beginning July 1, 2022. In Session Laws of Colorado 2022, amend21 section 5 of chapter 175, (SB 22-147), as section 5 (1) and (2) are22 amended by HB 24-1465, as follows:23 Section 5. Appropriation. (1) For the 2022-23 state fiscal year,24 $4,600,000 is appropriated to the department of higher education for use25 by the regents of the university of Colorado. This appropriation is from26 the behavioral and mental health cash fund created in section 24-75-23027 1466 -52- (2)(a), C.R.S., and C.R.S. OF THIS AMOUNT, $185,931 is of money the1 state received from the federal coronavirus state fiscal recovery fund.2 FUND AND $4,414,069 ORIGINATES FROM THE GENERAL FUND . To3 implement this act, the regents may use this appropriation for the4 Colorado pediatric psychiatry consultation and access program. Any5 money appropriated in this section not expended prior to July 1, 2023, is6 further appropriated to the regents from July 1, 2023, through December7 31, 2026, for the same purpose.8 (2) For the 2022-23 state fiscal year, $5,000,000 is appropriated9 to the department of education. This appropriation is from the behavioral10 and mental health cash fund created in section 24-75-230 (2)(a), C.R.S.,11 is of money the state received from the federal coronavirus state fiscal12 recovery fund, and is based on an assumption that the department will13 require an additional 0.4 FTE. O F THIS AMOUNT, $1,483,419 IS OF MONEY14 THE STATE RECEIVED FROM THE FEDERAL CORONAVIRUS STATE FISCAL15 RECOVERY FUND AND $3,516,581 ORIGINATES FROM THE GENERAL FUND .16 To implement this act, the department may use this appropriation for the17 behavioral health care professionals matching grant program. Any money18 appropriated in this section not expended prior to July 1, 2023, is further19 appropriated to the department from July 1, 2023, through December 31,20 2026, for the same purpose.21 (3) For the 2022-23 state fiscal year, $1,500,000 is appropriated22 to the department of public health and environment for use by the23 prevention services division. This appropriation is from the behavioral24 and mental health cash fund created in section 24-75-230 (2)(a), C.R.S.,25 is of money the state received from the federal coronavirus state fiscal 26 recovery fund, and is based on an assumption that the division will27 1466 -53- require an additional 0.4 FTE. OF THIS AMOUNT, $834,514 IS OF MONEY1 THE STATE RECEIVED FROM THE FEDERAL CORONAVIRUS STATE FISCAL2 RECOVERY FUND AND $665,486 ORIGINATES FROM THE GENERAL FUND. To3 implement this act, the division may use this appropriation for4 school-based health centers. Any money appropriated in this section not5 expended prior to July 1, 2023, is further appropriated to the division6 from July 1, 2023, through December 30, 2024, for the same purpose.7 SECTION 54. Appropriation to the department of human8 services for the fiscal year beginning July 1, 2022. In Session Laws of9 Colorado 2022, amend section 3 of chapter 217, (SB 22-148), as section10 3 is amended by HB 24-1465 as follows:11 Section 3. Appropriation. For the 2022-23 state fiscal year,12 $5,000,000 is appropriated to the department of human services for use13 by the behavioral health administration. This appropriation is from the14 behavioral and mental health cash fund created in section 24-75-23015 (2)(a), C.R.S., and C.R.S. OF THIS AMOUNT, $3,500,000 is of money the16 state received from the federal coronavirus state fiscal recovery fund.17 FUND AND $1,500,000 ORIGINATES FROM THE GENERAL FUND . To18 implement this act, the administration may use this appropriation for the19 Colorado land-based tribe behavioral health services grant program. Any20 money appropriated in this section not expended prior to July 1, 2023, is21 further appropriated to the administration from July 1, 2023, through22 December 31, 2026, for the same purpose. M ONEY THAT ORIGINATED23 FROM THE FEDERAL CORONAVIRUS STATE FISCAL RECOVERY FUND SHALL24 BE OBLIGATED AND EXPENDED IN ACCORDANCE WITH SECTION 24-75-226,25 C.R.S.26 SECTION 55. Appropriation to the department of human27 1466 -54- services for the fiscal year beginning July 1, 2022. In Session Laws of1 Colorado 2022, amend section 3 of chapter 223, (SB 22-177), as section2 3 is amended by HB 24-1465, as follows:3 Section 3. Appropriation. For the 2022-23 state fiscal year,4 $12,200,000 is appropriated to the department of human services for use5 by the behavioral health administration. This appropriation is from the6 behavioral and mental health cash fund created in section 24-75-2307 (2)(a), C.R.S., and C.R.S. OF THIS AMOUNT, $10,500,000 ORIGINATES8 FROM THE GENERAL FUND AND $1,700,000 is of money the state received9 from the federal coronavirus state fiscal recovery fund. The10 administration may use this appropriation for care coordination11 infrastructure. Any money appropriated in this section not expended prior12 to July 1, 2023, is further appropriated to the administration from July 1,13 2023, through December 31, 2026, for the same purpose. These14 appropriations are based on the assumption that the administration will15 require 3.0 FTE in the 2022-23 state fiscal year and 3.0 FTE in the16 2023-24 state fiscal year to implement this act. M ONEY THAT ORIGINATED17 FROM THE FEDERAL CORONAVIRUS STATE FISCAL RECOVERY FUND SHALL18 BE OBLIGATED AND EXPENDED IN ACCORDANCE WITH SECTION 24-75-226,19 C.R.S.20 SECTION 56. Appropriation to the department of human21 services for the fiscal year beginning July 1, 2022. In Session Laws of22 Colorado 2022, amend section 6 (1) introductory portion and section 823 (1) introductory portion of chapter 452, (SB 22-181), as section 6 (1)24 introductory portion and section 8 (1) introductory portion are amended25 by HB 24-1465, as follows:26 Section 6. Appropriation. (1) For the 2022-23 state fiscal year,27 1466 -55- $35,087,650 is appropriated to the department of human services for use1 by the behavioral health administration. (1) For the 2022-23 state fiscal year,11 $15,193,018 is appropriated to the department of higher education. This12 appropriation is from the behavioral and mental health cash fund created13 in section 24-75-230 (2)(a), C.R.S., and C.R.S. OF THIS AMOUNT,14 $13,269,296 ORIGINATES FROM THE GENERAL FUND AND $1,923,722 is of15 money the state received from the federal coronavirus state fiscal16 recovery fund. Any money appropriated in this section not expended prior17 to July 1, 2023, is further appropriated to the department from July 1,18 2023, through December 31, 2026, for the same purpose. To implement19 this act, the department may use this appropriation as follows:20 SECTION 57. Appropriation to the department of human21 services, the judicial department, the department of public safety,22 and the department of corrections for the fiscal year beginning July23 1, 2022. To implement this act, the department may20 use this appropriation for adult district attorney pretrial diversion21 programs.22 (3) For the 2022-23 state fiscal year, $3,500,000 is appropriated23 to the department of public safety. This appropriation is from the24 behavioral and mental health cash fund created in section 24-75-23025 (2)(a), C.R.S., and C.R.S. OF THIS AMOUNT, $3,435,819 ORIGINATES FROM26 THE GENERAL FUND AND $64,181 is of money that the state received from27 1466 -57- the federal coronavirus state fiscal recovery fund. Any money1 appropriated in this section not expended prior to July 1, 2023, is further2 appropriated to the department from July 1, 2023, through December 31,3 2026, for the same purpose. To implement this act, the department may4 use this appropriation as follows:5 (5) For the 2022-23 state fiscal year, $3,000,000 is appropriated6 to the department of corrections for use by institutions. This appropriation7 is from the behavioral and mental health cash fund created in section8 24-75-230 (2)(a), C.R.S., and C.R.S. OF THIS AMOUNT, $2,554,1269 ORIGINATES FROM THE GENERAL FUND AND $445,874 is of money that the10 state received from the federal coronavirus state fiscal recovery fund. Any11 money appropriated in this section not expended prior to July 1, 2023, is12 further appropriated to the department from July 1, 2023, through13 December 30, 2024, for the same purpose. To implement this act, the14 department may use this appropriation for operating expenses related to15 the mental health subprogram.16 SECTION 58. Appropriation to the department of local17 affairs for the fiscal year beginning July 1, 2022. In Session Laws of18 Colorado 2022, amend section 4 (1) of chapter 288, (SB 22-211), as19 section 4 (1) is amended by HB 24-1465, as follows:20 Section 4. Appropriation. (1) For the 2022-23 state fiscal year,21 $45,000,000 is appropriated to the department of local affairs for use by22 the division of housing. This appropriation is from the economic recovery23 and relief cash fund created in section 24-75-228 (2)(a), C.R.S., is of24 money the state received from the federal coronavirus state fiscal25 recovery fund, and is based on an assumption that the division will26 require an additional 2.3 FTE. O F THIS AMOUNT, $910,000 IS OF MONEY27 1466 -58- THE STATE RECEIVED FROM THE FEDERAL CORONAVIRUS STATE FISCAL1 RECOVERY FUND AND $44,090,000 ORIGINATES FROM THE GENERAL FUND.2 To implement this act, the division may use this appropriation for ridge3 view campus. Appropriation to the department of public7 health and environment for the fiscal year beginning July 1, 2022. This appropriation is from the21 economic recovery and relief cash fund created in section 24-75-22822 (2)(a), C.R.S., and C.R.S. This appropriation is2 from the behavioral and mental health cash fund created in section3 24-75-230 (2)(a), C.R.S., and C.R.S. OF THIS AMOUNT, $1,245,147 is of4 money the state received from the federal coronavirus state fiscal5 recovery fund. FUND AND $1,754,853 ORIGINATES FROM THE GENERAL6 FUND. To implement this act, the division may use this appropriation for7 the universal contract for behavioral health services. This appropriation is from the economic recovery and relief cash3 fund created in section 24-75-228 (2)(a), C.R.S., and C.R.S. OF THIS4 AMOUNT, $185,384 is of money the state received from the federal5 coronavirus state fiscal recovery fund. FUND AND $1,814,616 ORIGINATES6 FROM THE GENERAL FUND. To implement this act, the office of economic7 security may use this appropriation for fuel assistance payments related8 to food and energy assistance. Any money appropriated in this section not9 expended prior to July 1, 2023, is further appropriated to the office of10 economic security from July 1, 2023, through December 31, 2024, for the11 same purpose.12 (3) For the 2022-23 state fiscal year, $1,000,000 is appropriated13 to the department of human services for use by the office of economic14 security. Effective date.
