Under current law, every year, the department of education (department) is required to prepare a report and evaluation on the SENATE SPONSORSHIP Lundeen and Coleman, HOUSE SPONSORSHIP (None), Shading denotes HOUSE amendment. Dashes through the words or numbers indicate deletions from existing law. successes or failures of charter schools, school reform efforts, and suggested changes to laws affecting charter schools. Beginning in the 2024-25 budget year, the bill requires the department to: ! Report additional school district information, that primarily compares district charter schools or institute charter schools located within the school district to traditional district schools, and report information relating to a school district that has no charter schools; and ! Publicly post the additional information on the department's website, with explanations in plain and easy-to-understand language. Be it enacted by the General Assembly of the State of Colorado: 1 SECTION 1. Legislative declaration. (1) (a) The general2 assembly finds that:3 (I) Current law requires the department of education to collect4 and report data related to the successes and failures of charter schools.5 However, current law states little about the data and practices of those6 who authorize charter schools.7 (II) High-quality charter school authorization practices play a8 critical role in establishing a high-functioning charter school sector9 which elevates all kindergarten through twelfth grade education in10 Colorado; and11 (III) More data and greater transparency into entities that12 authorize charter schools is necessary to ensure that charter school13 authorization is consistently occurring at the highest level of quality14 possible. Accordingly, to better inform best practices concerning charter15 school authorization, and to better inform the public about charter school16 authorization, this information should be publicly available, in plain and17 easy-to-understand language.18 (b) Therefore, the general assembly declares it necessary to19 SB24-088-2- supplement the department of education's report on charter schools to1 provide greater transparency and clarity regarding entities that authorize2 charter schools, including enrollment, school performance, resource3 sharing, and information concerning school districts that do not have a4 charter school.5 SECTION 2. In Colorado Revised Statutes, 22-30.5-113, add6 (4), (5), (6), and (7) as follows:7 22-30.5-113. (4) B EGINNING IN THE 2024-25 BUDGET YEAR, THE10 DEPARTMENT SHALL INCLUDE , AT A MINIMUM , THE FOLLOWING11 INFORMATION IN THE REPORT AND EVALUATION DESCRIBED IN12 SUBSECTION (1) OF THIS SECTION:13 (a) (I) THE SCHOOL DISTRICTS THAT HAVE A DISTRICT CHARTER14 SCHOOL, REPORTED AS A TOTAL NUMBER FOR THE STATE AND15 IDENTIFYING EACH APPLICABLE SCHOOL DISTRICT ; AND16 (II) THE SCHOOL DISTRICTS THAT HAVE AN INSTITUTE CHARTER17 SCHOOL THAT IS LOCATED AND OPERATING WITHIN THE SC HOOL18 DISTRICT'S GEOGRAPHIC BOUNDARIES , REPORTED AS A TOTAL NUMBER19 FOR THE STATE AND IDENTIFYING EACH APPLICABLE SCHOOL DISTRICT ;20 (b) FOR EACH SCHOOL DISTRICT IDENTIFIED PURSUANT TO21 SUBSECTION (4)(a) OF THIS SECTION:22 (I) THE DISTRICT CHARTER SCHOOLS AND INSTITUTE CHARTER23 SCHOOLS THAT ARE LOCATED AND OPERATING WITHIN THE SCHOOL24 DISTRICT'S GEOGRAPHIC BOUNDARIES , REPORTED AS A TOTAL NUMBER25 FOR THE DISTRICT AND DISAGGREGATED BY DISTRICT CHARTER SCHOOL26 OR INSTITUTE CHARTER SCHOOL , AND IDENTIFYING EACH DISTRICT27 SB24-088-3- CHARTER SCHOOL AND INSTITUTE CHARTER SCHOOL ;1 (II) THE NUMBER OF STUDENTS WHO ARE ENROLLED IN A PUBLIC2 SCHOOL, EXCLUDING AN ONLINE SCHOOL , THAT IS LOCATED AND3 OPERATING WITHIN THE SCHOOL DISTRICT 'S GEOGRAPHIC BOUNDARIES ,4 REPORTED AS THE TOTAL NUMBER FOR THE SCHOOL DISTRICT AND5 DISAGGREGATED BY THE NUMBER OF STUDENTS ENROLLED IN EACH TYPE6 OF SCHOOL, INCLUDING, BUT NOT LIMITED TO , DISTRICT CHARTER7 SCHOOLS, INSTITUTE CHARTER SCHOOLS, AND TRADITIONAL SCHOOLS OR8 PROGRAMS;9 (III) THE NUMBER OF STUDENTS WHO RESIDE IN THE SCHOOL10 DISTRICT'S GEOGRAPHIC BOUNDARIES AND ARE ENROLLED IN A PUBLIC11 SCHOOL, EXCLUDING AN ONLINE SCHOOL , THAT IS LOCATED AND12 OPERATING WITHIN THE SCHOOL DISTRICT 'S GEOGRAPHIC BOUNDARIES ,13 REPORTED AS THE TOTAL NUMBER FOR THE SCHOOL DISTRICT AND14 DISAGGREGATED BY THE NUMBER OF STUDENTS ENROLLED IN EACH TYPE15 OF SCHOOL, INCLUDING, BUT NOT LIMITED TO , DISTRICT CHARTER16 SCHOOLS, INSTITUTE CHARTER SCHOOLS, AND TRADITIONAL SCHOOLS OR17 PROGRAMS;18 (IV) THE NUMBER OF STUDENTS WHO DO NOT RESIDE IN THE19 SCHOOL DISTRICT'S GEOGRAPHIC BOUNDARIES AND ARE ENROLLED IN A20 PUBLIC SCHOOL, EXCLUDING AN ONLINE SCHOOL, THAT IS LOCATED AND21 OPERATING WITHIN THE SCHOOL DISTRICT 'S GEOGRAPHIC BOUNDARIES ,22 REPORTED AS THE TOTAL NUMBER FOR THE SCHOOL DISTRICT AND23 DISAGGREGATED BY THE NUMBER OF STUDENTS ENROLLED IN EACH TYPE24 OF SCHOOL, INCLUDING, BUT NOT LIMITED TO , DISTRICT CHARTER25 SCHOOLS, INSTITUTE CHARTER SCHOOLS, AND TRADITIONAL SCHOOLS OR26 PROGRAMS;27 SB24-088-4- (V) THE NUMBER OF STUDENTS WHO RESIDE IN THE SCHOOL1 DISTRICT'S GEOGRAPHIC BOUNDARIES AND ARE ENROLLED IN A DISTRICT2 PUBLIC SCHOOL, EXCLUDING AN ONLINE SCHOOL, REPORTED AS A TOTAL3 NUMBER FOR THE SCHOOL DISTRICT AND DISAGGREGATED BY :4 (A) THE NUMBER OF STUDENTS WHO ARE ENROLLED IN A SCHOOL5 THAT IS IN THE NEIGHBORHOOD SCHOOL GEOGRAPHIC BOUNDARIES6 WHERE THE STUDENT RESIDES , AND FURTHER DISAGGREGATED BY THE7 TYPE OF NEIGHBORHOOD SCHOOL , INCLUDING, BUT NOT LIMITED TO,8 TRADITIONAL SCHOOLS OR PROGRAMS OR DISTRICT CHARTER SCHOOLS ;9 AND10 (B) THE NUMBER OF STUDENTS WHO ARE ENROLLED IN A SCHOOL11 THAT IS NOT IN THE NEIGHBORHOOD SCHOOL GEOGRAPHIC BOUNDARIES12 WHERE THE STUDENT RESIDES , AND FURTHER DISAGGREGATED BY THE13 TYPE OF SCHOOL, INCLUDING, BUT NOT LIMITED TO , TRADITIONAL14 SCHOOLS OR PROGRAMS OR DISTRICT CHARTER SCHOOLS .15 (VI) THE NUMBER OF STUDENTS WHO RESIDE IN THE SCHOOL16 DISTRICT'S GEOGRAPHIC BOUNDARIES AND ARE ENROLLED IN EACH17 GRADE, KINDERGARTEN THROUGH TWELVE , IN A DISTRICT CHARTER18 SCHOOL OR INSTITUTE CHARTER SCHOOL LOCATED AND OPERATING IN THE19 SCHOOL DISTRICT'S GEOGRAPHIC BOUNDARIES , REPORTED AS A20 PERCENTAGE OF THE TOTAL NUMBER OF STUDENTS WHO RESIDE IN THE21 SCHOOL DISTRICT'S GEOGRAPHIC BOUNDARIES AND ARE ENROLLED IN22 EACH RESPECTIVE GRADE IN THE SCHOOL DISTRICT OR AN INSTITUTE23 CHARTER SCHOOL LOCATED AND OPERATING IN THE SCHOOL DISTRICT 'S24 GEOGRAPHIC BOUNDARIES ;25 (VII) THE AVERAGE ANNUAL PERFORMANCE INDICATORS ,26 DETERMINED PURSUANT TO SECTION 22-11-204, REPORTED AS A TOTAL27 SB24-088-5- AVERAGE FOR ALL DISTRICT CHARTER SCHOOLS IN THE SCHOOL DISTRICT ,1 REPORTED AS A TOTAL AVERAGE FOR ALL INSTITUTE CHARTER SCHOOLS2 LOCATED AND OPERATING IN THE SCHOOL DISTRICT 'S GEOGRAPHIC3 BOUNDARIES, AND REPORTED AS A TOTAL AVERAGE FOR ALL OF THE4 DISTRICT'S TRADITIONAL SCHOOLS OR PROGRAMS ;5 (VIII) THE AVERAGE ANNUAL ACCREDITATION CATEGORY ,6 DETERMINED PURSUANT TO SECTION 22-11-208, REPORTED AS A TOTAL7 AVERAGE FOR ALL DISTRICT CHARTER SCHOOLS IN THE SCHOOL DISTRICT ,8 REPORTED AS A TOTAL AVERAGE FOR ALL INSTITUTE CHARTER SCHOOLS9 LOCATED AND OPERATING IN THE SCHOOL DISTRICT 'S GEOGRAPHIC10 BOUNDARIES, AND REPORTED AS A TOTAL AVERAGE FOR ALL OF THE11 DISTRICT'S TRADITIONAL SCHOOLS OR PROGRAMS ;12 (IX) THE AVERAGE ANNUAL EXPENDITURES DEDICATED PER13 STUDENT WHO IS ENROLLED IN A DISTRICT CHARTER SCHOOL , AND PER14 STUDENT WHO IS ENROLLED IN AN INSTITUTE CHARTER SCHOOL LOCATED15 AND OPERATING IN THE SCHOOL DISTRICT 'S GEOGRAPHIC BOUNDARIES ,16 REPORTED AS A PERCENTAGE OF THE AVERAGE ANNUAL EXPENDITURES17 DEDICATED PER STUDENT WHO IS ENROLLED IN A DISTRICT'S TRADITIONAL18 SCHOOL OR PROGRAM . THE REPORT MUST INCLUDE A LIST OF THE19 EXPENDITURES USED TO DETERMINE THE AVERAGE ANNUAL20 EXPENDITURES FOR STUDENTS ENROLLED IN A DISTRICT CHARTER21 SCHOOL, INSTITUTE CHARTER SCHOOL, AND A DISTRICT'S TRADITIONAL22 SCHOOL OR PROGRAM.23 (X) FOR ALL FEDERAL FUNDING RECEIVED BY THE SCHOOL24 DISTRICT, THE AVERAGE ANNUAL EXPENDITURES FROM THE FEDERAL25 FUNDING DEDICATED PER STUDENT WHO IS ENROLLED IN A DISTRICT26 CHARTER SCHOOL, OR PER STUDENT WHO IS ENROLLED IN AN INSTITUTE27 SB24-088-6- CHARTER SCHOOL LOCATED AND OPERATING IN THE SCHOOL DISTRICT 'S1 GEOGRAPHIC BOUNDARIES, REPORTED AS A PERCENTAGE OF THE AVERAGE2 ANNUAL EXPENDITURES DEDICATED PER STUDENT WHO IS ENROLLED IN3 A DISTRICT'S TRADITIONAL SCHOOL OR PROGRAM ;4 (XI) THE AVERAGE ANNUAL PERCENTAGE OF THE SCHOOL5 DISTRICT'S FUNDING, FROM THE DISTRICT'S TOTAL FORMULA PER PUPIL6 FUNDING AND ANY OTHER REVENUE SOURCE , THAT IS EXPENDED ON7 FACILITIES, FOR STUDENTS WHO ARE ENROLLED IN A DISTRICT CHARTER8 SCHOOL, FOR STUDENTS WHO ARE ENROLLED IN AN INSTITUTE CHARTER9 SCHOOL LOCATED AND OPERATING IN THE SCHOOL DISTRICT 'S10 GEOGRAPHIC BOUNDARIES , AND FOR STUDENTS WHO ARE ENROLLED IN A11 DISTRICT'S TRADITIONAL SCHOOL OR PROGRAM ;12 (XII) THE AVERAGE ANNUAL PERCENTAGE OF THE SCHOOL13 DISTRICT'S FUNDING, FROM THE DISTRICT'S TOTAL FORMULA PER PUPIL14 FUNDING AND CATEGORICAL FUNDING , THAT IS EXPENDED ON15 TRANSPORTATION, FOR STUDENTS WHO ARE ENROLLED IN A DISTRICT16 CHARTER SCHOOL, FOR STUDENTS WHO ARE ENROLLED IN AN INSTITUTE17 CHARTER SCHOOL LOCATED AND OPERATING IN THE SCHOOL DISTRICT 'S18 GEOGRAPHIC BOUNDARIES , AND FOR STUDENTS WHO ARE ENROLLED IN A19 DISTRICT'S TRADITIONAL SCHOOL OR PROGRAM ;20 (XIII) THE AVERAGE ANNUAL PERCENTAGE OF THE SCHOOL21 DISTRICT'S FUNDING, FROM THE DISTRICT'S TOTAL FORMULA PER PUPIL22 FUNDING AND CATEGORICAL FUNDING , THAT IS EXPENDED ON SPECIAL23 EDUCATION SERVICES, FOR STUDENTS WHO ARE ENROLLED IN A DISTRICT24 CHARTER SCHOOL, FOR STUDENTS WHO ARE ENROLLED IN AN INSTITUTE25 CHARTER SCHOOL LOCATED AND OPERATING IN THE SCHOOL DISTRICT 'S26 GEOGRAPHIC BOUNDARIES , AND FOR STUDENTS WHO ARE ENROLLED IN A27 SB24-088-7- DISTRICT'S TRADITIONAL SCHOOL OR PROGRAM ;1 (XIV) A DESCRIPTION OF THE SCHOOL DISTRICT 'S2 ADMINISTRATIVE SERVICES AND ANY ASSOCIATED COSTS THAT ARE3 DEDICATED TO AUTHORIZING , SUPPORTING, OR OVERSEEING DISTRICT4 CHARTER SCHOOLS, OR SUPPORTING INSTITUTE CHARTER SCHOOLS5 LOCATED AND OPERATING IN THE SCHOOL DISTRICT 'S GEOGRAPHIC6 BOUNDARIES, INCLUDING:7 (A) THE AMOUNT WITHHELD BY THE SCHOOL DISTRICT FOR8 ADMINISTRATIVE SERVICES OR ASSOCIATED COSTS PROVIDED TO A9 CHARTER SCHOOL, REPORTED AS THE TOTAL AMOUNT WITHHELD AND AS10 A PERCENTAGE OF THE TOTAL ADMINISTRATIVE SERVICES AND11 ASSOCIATED COSTS FOR THE SCHOOL DISTRICT ;12 (B) A DESCRIPTION OF THE SCHOOL DISTRICT STAFF WHOSE13 DUTIES, IN WHOLE OR IN PART, INCLUDE AUTHORIZING, SUPPORTING, AND14 OVERSEEING DISTRICT CHARTER SCHOOLS , OR SUPPORTING INSTITUTE15 CHARTER SCHOOLS LOCATED AND OPERATING IN THE SCHOOL DISTRICT 'S16 GEOGRAPHIC BOUNDARIES ; AND17 (C) WHETHER THE SCHOOL DISTRICT MAKES PROFESSIONAL18 DEVELOPMENT RESOURCES OR TRAINING AVAILABLE TO CHARTER SCHOOL19 STAFF AND WHAT CONDITIONS APPLY , IF ANY;20 (c) FOR EACH SCHOOL DISTRICT IDENTIFIED PURSUANT TO21 SUBSECTION (4)(a) OF THIS SECTION THAT WITHHELD FUNDS OR22 REQUESTED REIMBURSEMENT FOR THE PROVISION OF SPECIAL EDUCATION23 SERVICES OR ANY ASSOCIATED COSTS :24 (I) THE TOTAL AMOUNT WITHHELD OR REQUESTED FOR25 REIMBURSEMENT, AND AS A PERCENTAGE OF THE SCHOOL DISTRICT 'S26 TOTAL FORMULA PER PUPIL FUNDING THAT IS EXPENDED ON SPECIAL27 SB24-088-8- EDUCATION SERVICES, FOR STUDENTS WHO ARE ENROLLED IN A DISTRICT1 CHARTER SCHOOL, AND FOR STUDENTS WHO ARE ENROLLED IN AN2 INSTITUTE CHARTER SCHOOL LOCATED AND OPERATING IN THE SCHOOL3 DISTRICT'S GEOGRAPHIC BOUNDARIES;4 (II) A DESCRIPTION OF THE SPECIAL EDUCATION SERVICES, OR ANY5 ASSOCIATED COSTS, THAT WERE PROVIDED TO THE DISTRICT CHARTER6 SCHOOL OR INSTITUTE CHARTER SCHOOL LOCATED AND OPERATING IN THE7 SCHOOL DISTRICT'S GEOGRAPHIC BOUNDARIES IN EXCHANGE FOR THE8 WITHHOLDING OR REIMBURSEMENT ;9 (III) A DESCRIPTION OF THE SCHOOL DISTRICT 'S STAFF WHOSE10 DUTIES, IN WHOLE OR IN PART, INCLUDE PROVIDING SPECIAL EDUCATION11 SERVICES OR FUNCTIONS, AND THE SOURCES OF FUNDING THAT PROVIDE12 THAT FOR STAFF;13 (d) FOR EACH SCHOOL DISTRICT IDENTIFIED PURSUANT TO14 SUBSECTION (4)(a) OF THIS SECTION THAT PROVIDES, EITHER AT COST OR15 FOR FREE, SCHOOL-DISTRICT-OWNED LAND OR FACILITIES TO A DISTRICT16 CHARTER SCHOOL OR INSTITUTE CHARTER SCHOOL THAT IS LOCATED IN17 THE GEOGRAPHIC BOUNDARIES OF THE SCHOOL DISTRICT :18 (I) THE TOTAL SQUARE FOOTAGE OF LAND PROVIDED AS A WHOLE19 AND DISAGGREGATED BY SPECIFIC PARCEL ;20 (II) THE TOTAL SQUARE FOOTAGE OF FACILITIES PROVIDED AS A21 WHOLE AND DISAGGREGATED BY SPECIFIC FACILITY ;22 (III) THE TOTAL NUMBER OF DISTRICT CHARTER SCHOOLS AND23 INSTITUTE CHARTER SCHOOLS THAT ARE LOCATED IN THE GEOGRAPHIC24 BOUNDARIES OF THE SC HOOL DISTRICT THAT USE25 SCHOOL-DISTRICT-OWNED LAND OR A FACILITY;26 (IV) THE TOTAL NUMBER OF DISTRICT CHARTER SCHOOLS OR27 SB24-088-9- INSTITUTE CHARTER SCHOOLS THAT ARE LOCATED IN THE GEOGRAPHIC1 BOUNDARIES OF THE SC HOOL DISTRICT THAT OPERATE USING2 SCHOOL-DISTRICT-OWNED LAND OR A FACILITY;3 (V) THE AVERAGE COST PER SQUARE FOOT , AND THE TOTAL4 RANGE OF COSTS PER SQUARE FOOT, CHARGED OR PROVIDED FOR FREE BY5 THE SCHOOL DISTRICT TO THE DISTRICT CHARTER SCHOOLS AND INSTITUTE6 CHARTER SCHOOLS THAT USE SCHOOL -DISTRICT-OWNED LAND OR A7 FACILITY;8 (VI) THE TOTAL SQUARE FOOTAGE OF SCHOOL -DISTRICT-OWNED9 LAND THAT IS VACANT OR AVAILABLE FOR USE ;10 (VII) THE TOTAL SQUARE FOOTAGE OF SCHOOL -DISTRICT-OWNED11 FACILITIES THAT IS VACANT OR AVAILABLE FOR USE ;12 (e) FOR EACH SCHOOL DISTRICT IDENTIFIED PURSUANT TO13 SUBSECTION (4)(a) OF THIS SECTION THAT PROVIDES ENGLISH LANGUAGE14 LEARNER SERVICES OR ANY ASSOCIATED COSTS , TRANSPORTATION15 SERVICES OR ANY ASSOCIATED COSTS , FOOD SERVICES OR ANY16 ASSOCIATED COSTS, OR A SERVICE DEEMED SIGNIFICANT OR ANY17 ASSOCIATED COSTS, TO A DISTRICT CHARTER SCHOOL OR INSTITUTE18 CHARTER SCHOOL LOCATED IN THE GEOGRAPHIC BOUNDARIES OF THE19 SCHOOL DISTRICT:20 (I) A DESCRIPTION OF THE SERVICE AND ASSOCIATED COSTS THAT21 WERE PROVIDED TO A DISTRICT CHARTER SCHOOL OR INSTITUTE CHARTER22 SCHOOL LOCATED AND OPERATING IN THE SCHOOL DISTRICT 'S23 GEOGRAPHIC BOUNDARIES ;24 (II) THE TOTAL NUMBER OF DISTRICT CHARTER SCHOOLS AND25 INSTITUTE CHARTER SCHOOLS LOCATED AND OPERATING IN THE SCHOOL26 DISTRICT'S GEOGRAPHIC BOUNDARIES THAT RECEIVED SERVICES OR27 SB24-088-10- ASSOCIATED COSTS, AND THE TOTAL NUMBER THAT DID NOT RECEIVE1 SERVICES OR ASSOCIATED COSTS;2 (III) THE FORMULA OR CRITERIA USED FOR DETERMINING THE3 COST OF THE SERVICE OR ANY ASSOCIATED COSTS ;4 (f) FOR EACH SCHOOL DISTRICT IDENTIFIED PURSUANT TO5 SUBSECTION (4)(a) OF THIS SECTION THAT HAS HAD A SCHOOL DISTRICT6 MILL LEVY OR BOND APPROVED BY THE VOTERS IN THE PRECEDING FIVE7 BUDGET YEARS:8 (I) A STATEMENT REGARDING WHETHER ANY OF THE MILL LEVY9 REVENUE WAS EXPENDED ON EXPENSES , LAND, OR A FACILITY USED BY A10 DISTRICT CHARTER SCHOOL OR AN INSTITUTE CHARTER SCHOOL LOCATED11 AND OPERATING IN THE SCHOOL DISTRICT 'S GEOGRAPHIC BOUNDARIES ,12 AND IF SO, A REPORT OF THE PERCENTAGE OF THE MILL LEVY REVENUE13 EXPENDED ON LAND OR A FACILITY USED BY A CHARTER SCHOOL14 ACCOMPANIED BY A REPORT OF THE PERCENTAGE OF STUDENTS WHO15 RESIDE IN THE SCHOOL DISTRICT WHO ARE ENROLLED IN A DISTRICT16 CHARTER SCHOOL OR AN INSTITUTE CHARTER SCHOOL LOCATED AND17 OPERATING IN THE SCHOOL DISTRICT'S GEOGRAPHIC BOUNDARIES; AND18 (II) A STATEMENT REGARDING WHETHER ANY OF THE BOND19 REVENUE WAS EXPENDED ON LAND OR A FACILITY USED BY A DISTRICT20 CHARTER SCHOOL OR AN INSTITUTE CHARTER SCHOOL LOCATED AND21 OPERATING IN THE SCHOOL DISTRICT'S GEOGRAPHIC BOUNDARIES, AND IF22 SO, THE PERCENTAGE OF THE BOND REVENUE EXPENDED ON LAND OR A23 FACILITY USED BY A CHARTER SCHOOL AND THE PERCENTAGE OF24 STUDENTS WHO RESIDE IN THE SCHOOL DISTRICT WHO ARE ENROLLED IN25 A DISTRICT CHARTER SCHOOL OR AN INSTITUTE CHARTER SCHOOL26 LOCATED AND OPERATING IN THE SCHOOL DISTRICT 'S GEOGRAPHIC27 SB24-088-11- BOUNDARIES;1 (g) FOR EACH SCHOOL DISTRICT IDENTIFIED PURSUANT TO2 SUBSECTION (4)(a) OF THIS SECTION, A STATEMENT REGARDING WHETHER3 THE SCHOOL DISTRICT HAS A CENTRALIZED ENROLLMENT SYSTEM , AND IF4 SO, WHETHER THE DISTRICT CHARTER SCHOOLS PARTICIPATE IN THE5 CENTRALIZED ENROLLMENT SYSTEM ;6 (h) FOR EACH SCHOOL DISTRICT IDENTIFIED PURSUANT TO7 SUBSECTION (4)(a) OF THIS SECTION:8 (I) THE TOTAL NUMBER OF CHARTER APPLICATIONS RECEIVED BY9 THE DISTRICT, THE TOTAL NUMBER OF REQUESTS FOR PERMISSION TO10 SUBMIT A CHARTER APPLICATION TO THE CHARTER SCHOOL INSTITUTE ,11 AND THE TOTAL NUMBER OF CHARTER RENEWAL APPLICATIONS RECEIVED12 BY THE SCHOOL DISTRICT IN THE PRECEDING BUDGET YEAR ;13 (II) A SUMMARY OF THE RESOLUTION OR CURRENT STATUS OF14 EACH APPLICATION OR REQUEST DESCRIBED PURSUANT TO SUBSECTION15 (4)(h)(I) OF THIS SECTION, INCLUDING THE DURATION OF EACH APPROVED16 CHARTER CONTRACT TERM , AND THE RATIONALE FOR DETERMINING THE17 DURATION OF EACH CHARTER CONTRACT TERM THAT IS LESS THAN FIVE18 YEARS;19 (III) (A) A COMPREHENSIVE DESCRIPTION OF EACH INSTANCE20 WHEN A SHORT-TERM CONTRACT PROVIDED INSUFFICIENT SECURITY TO21 ISSUE A BOND, AND CONSEQUENTLY, A CHARTER SCHOOL WAS REQUIRED22 TO PROCURE SUPPLEMENTAL FINANCIAL RESOURCES OR ABSORB THE23 RESULTING FINANCIAL COST. THE COMPREHENSIVE DESCRIPTION MUST24 INCLUDE, AT A MINIMUM, THE TOTAL AMOUNT OF SUPPLEMENTAL25 FINANCIAL RESOURCES OR FINANCIAL COST TO THE CHARTER SCHOOL ,26 AND WHAT ASSISTANCE, FACILITIES, OR FINANCIAL RESOURCES, IF ANY,27 SB24-088-12- WERE PROVIDED BY THE SCHOOL DISTRICT TO THE CHARTER SCHOOL TO1 ASSIST THE CHARTER SCHOOL.2 (B) FOR THE 2024-25 AND 2025-26 REPORTS, THE INFORMATION3 PROVIDED PURSUANT TO THIS SUBSECTION (4)(h)(III) MUST INCLUDE THE4 PRECEDING FIVE STATE FISCAL YEARS. FOR THE 2026-27 REPORT, AND5 EACH REPORT THEREAFTER, THE INFORMATION PROVIDED PURSUANT TO6 THIS SUBSECTION (4)(h)(III) MUST INCLUDE THE PRECEDING TEN STATE7 FISCAL YEARS.8 (IV) A COMPREHENSIVE DESCRIPTION OF THE PRACTICES OR9 POLICIES FOR PUBLISHING AND DISTRIBUTING INFORMATION CONCERNING10 THE CHARTER SCHOOL APPLICATION PROCESS ; AND11 (V) A COMPREHENSIVE DESCRIPTION OF THE PRACTICES OR12 POLICIES FOR PUBLISHING INFORMATION AND REPORTS REQUIRED BY A13 DISTRICT CHARTER SCHOOL;14 (i) THE SCHOOL DISTRICTS THAT DO NOT HAVE A DISTRICT15 CHARTER SCHOOL OR AN INSTITUTE CHARTER SCHOOL LOCATED IN THE16 GEOGRAPHIC BOUNDARIES OF THE SCHOOL DISTRICT , REPORTED AS A17 TOTAL NUMBER FOR THE STATE AND IDENTIFYING EACH APPLICABLE18 SCHOOL DISTRICT;19 (j) FOR EACH SCHOOL DISTRICT DESCRIBED IN SUBSECTION (4)(i)20 OF THIS SECTION:21 (I) THE TOTAL NUMBER OF STUDENTS, EXCLUDING STUDENTS WHO22 ARE ENROLLED IN AN ONLINE SCHOOL , WHO RESIDE IN THE SCHOOL23 DISTRICT'S GEOGRAPHIC BOUNDARIES AND ARE ENROLLED IN ANOTHER24 SCHOOL DISTRICT OR INSTITUTE CHARTER SCHOOL LOCATED AND25 OPERATING WITHIN ANOTHER SCHOOL DISTRICT 'S GEOGRAPHIC26 BOUNDARIES;27 SB24-088-13- (II) THE TOTAL NUMBER OF STUDENTS , EXCLUDING STUDENTS1 WHO ARE ENROLLED IN AN ONLINE SCHOOL , WHO RESIDE IN ANOTHER2 SCHOOL DISTRICT'S GEOGRAPHIC BOUNDARIES AND ARE ENROLLED IN THE3 SCHOOL DISTRICT; AND4 (III) THE TOTAL NUMBER OF STUDENTS , EXCLUDING STUDENTS5 WHO ARE ENROLLED IN AN ONLINE SCHOOL , REPORTED AS A NET POSITIVE6 OR NEGATIVE NUMBER, DETERMINED BY COMPARING :7 (A) THE TOTAL NUMBER OF STUDENTS WHO RESIDE IN THE8 SCHOOL DISTRICT'S GEOGRAPHIC BOUNDARIES AND ARE ENROLLED IN THE9 SCHOOL DISTRICT; AND10 (B) THE TOTAL NUMBER OF STUDENTS WHO RESIDE IN THE SCHOOL11 DISTRICT'S GEOGRAPHIC BOUNDARIES AND ARE ENROLLED IN ANOTHER12 SCHOOL DISTRICT OR AN INSTITUTE CHARTER SCHOOL LOCATED AND13 OPERATING IN ANOTHER SCHOOL DISTRICT 'S GEOGRAPHIC BOUNDARIES;14 (IV) THE TOTAL NUMBER OF CHARTER APPLICATIONS RECEIVED15 BY THE DISTRICT AND THE TOTAL NUMBER OF REQUESTS FOR PERMISSION16 TO SUBMIT A CHARTER APPLICATION TO THE CHARTER SCHOOL INSTITUTE ,17 RECEIVED BY THE SCHOOL DISTRICT IN THE PRECEDING TEN B UDGET18 YEARS; AND19 (V) A SUMMARY OF THE RESOLUTION OR CURRENT STATUS OF20 EACH APPLICATION OR REQUEST DESCRIBED PURSUANT TO THIS21 SUBSECTION (4)(j); AND22 (k) FOR EACH SCHOOL DISTRICT, A COMPREHENSIVE DESCRIPTION23 OF ITS PRACTICES OR POLICIES REGARDING SECTION 22-30.5-109 (6).24 (5) BEGINNING IN THE 2024-25 BUDGET YEAR, THE DEPARTMENT25 SHALL PUBLISH THE INFORMATION DESCRIBED PURSUANT TO SUBSECTION26 (4) OF THIS SECTION ON ITS WEBSITE, IN A FREE AND PUBLICLY AVAILABLE27 SB24-088-14- FORMAT, ACCOMPANIED BY EXPLANATIONS AND SUMMARIES IN PLAIN1 AND EASY-TO-UNDERSTAND LANGUAGE .2 (6) A SCHOOL DISTRICT, DISTRICT CHARTER SCHOOL, INSTITUTE3 CHARTER SCHOOL, AND THE CHARTER SCHOOL INSTITUTE SHALL PROVIDE4 ANY INFORMATION REQUESTED BY THE DEPARTMENT THAT IS NECESSARY5 FOR THE DEPARTMENT TO COMPLY WITH THIS SECTION .6 (7) AS USED IN THIS SECTION, UNLESS THE CONTEXT OTHERWISE7 REQUIRES, "TOTAL FORMULA PER PUPIL FUNDING " HAS THE SAME8 MEANING SET FORTH IN SECTION 22-54-104.3 (5)(f).9 SECTION 3. Act subject to petition - effective date. This act10 takes effect at 12:01 a.m. on the day following the expiration of the11 ninety-day period after final adjournment of the general assembly; except12 that, if a referendum petition is filed pursuant to section 1 (3) of article13 V of the state constitution against this act or an item, section, or part of14 this act within such period, then the act, item, section, or part will not15 take effect unless approved by the people at the general election to be16 held in November 2024 and, in such case, will take effect on the date of17 the official declaration of the vote thereon by the governor.18 SB24-088-15-
