Be it enacted by the General Assembly of the State of Colorado:1 SECTION 1. Legislative declaration. (1) The general assembly2 finds and declares that:3 (a) In 2011, the state historical society, also known as history4 Colorado, acquired property that is referred to as the north storage facility5 (facility), which is the current collections storage facility and the state6 historical fund document repository. Initially, history Colorado intended7 to use the facility for temporary storage of large items in the collection8 while the history Colorado center was built, but it became clear that the9 storage space was still needed to house the collection and the facility was10 switched to permanent storage.11 (b) The collection has continued to grow and there are currently12 85,000 square feet of artifacts, which is more square footage than the13 facility adequately provides, making it too small to meet the storage and14 care needs of history Colorado. Additionally, issues with the different15 building systems, including electrical, mechanical, and fire suppression,16 make it difficult to maintain an optimal care environment for the17 collection.18 (c) History Colorado has determined that, due to these challenges,19 the facility is no longer a suitable facility for the consolidated collections,20 care, and storage necessary to house significant artifacts that history21 Colorado is statutorily responsible for collecting and preserving on the22 state's behalf. The disposition of the property will be in the best interest23 of the organization and allow history Colorado to lease a more suitable24 facility for ongoing storage and care of the collection and to provide25 177-2- current and future controlled maintenance needs of all of history1 Colorado's community and historic sites.2 SECTION 2. History Colorado authority to dispose of real3 property. (1) The state, acting by and through the state historical society,4 also known as history Colorado, is authorized to dispose of real property5 located at 1100 W. 47th Ave., Denver, Colorado 80211, lots 13 to 366 inclusive & vacated alley interjacent thereto block 13 Richards7 subdivision & NLY 8 1/2 feet of vacated Alice Place adjacent to 258 through 36 in SD block, City and County of Denver, state of Colorado.9 (2) The capital development committee and the state controller10 must approve all agreements relating to the disposition of the real11 property described in subsection (1) of this section prior to closing.12 (3) History Colorado shall credit the proceeds of the disposition13 of the real property described in subsection (1) of this section to the state14 museum cash fund created in section 24-80-214, Colorado Revised15 Statutes, to be used for moving, retrofitting, lease-related, and acquisition16 costs for a new storage facility that history Colorado will lease in the17 future or for controlled maintenance.18 SECTION 3. Act subject to petition - effective date. This act19 takes effect at 12:01 a.m. on the day following the expiration of the20 ninety-day period after final adjournment of the general assembly; except21 that, if a referendum petition is filed pursuant to section 1 (3) of article V22 of the state constitution against this act or an item, section, or part of this23 act within such period, then the act, item, section, or part will not take24 effect unless approved by the people at the general election to be held in25 November 2024 and, in such case, will take effect on the date of the26 official declaration of the vote thereon by the governor.27 177 -3-
