In the case of a veterinary health-care worker, dog groomer, humane agency personnel, professional dog handler, or trainer acting in the performance of that person's professional duties, the bill removes the term "or serious bodily injury" to the list provisions that the statute does not apply to, leaving just "bodily injury". In Colorado Revised Statutes, 18-9-204.5, amend2 (6) introductory portion, and (6)(b) as follows:3 18-9-204.5. Unlawful ownership of dangerous dog - legislative4 declaration - definitions. (6) The provisions of this section shall THIS5 SECTION DOES not apply to the following:6 (b) To any A dog that inflicts bodily or serious bodily injury to7 any A veterinary health-care worker, dog groomer, humane agency8 personnel, professional dog handler, or trainer, each acting in the9 performance of his or her THE PERSON'S respective duties, unless the10 DOG'S owner is subject to a court order issued pursuant to paragraph (e.5)11 of subsection (3) SUBSECTION (3)(e.5) of this section and the owner has12 failed to comply with the provisions of subparagraph (V) of paragraph13 (e.5) of subsection (3) SUBSECTION (3)(e.5)(V) of this section; or14 SECTION 2. Act subject to petition - effective date. This act15 takes effect at 12:01 a.m. on the day following the expiration of the16 ninety-day period after final adjournment of the general assembly; except17 that, if a referendum petition is filed pursuant to section 1 (3) of article V18 of the state constitution against this act or an item, section, or part of this19 act within such period, then the act, item, section, or part will not take20 effect unless approved by the people at the general election to be held in21 November 2026 and, in such case, will take effect on the date of the22 official declaration of the vote thereon by the governor.23 1034 -2-
