Under current law, retail establishments are prohibited from providing plastic carryout bags at the point of sale, but may provide recycled paper carryout bags for a fee of at least 10 cents per bag. The bill repeals the requirement that retail establishments charge a fee for providing recycled paper carryout bags. In Colorado Revised Statutes, 25-17-503, repeal (8)2 as follows:3 25-17-503. Definitions - rules. As used in this part 5, unless the4 context otherwise requires:5 (8) "Recycled paper carryout bag" means a carryout bag made6 from one hundred percent:7 (a) Recycled material; or8 (b) Other post-consumer content.9 SECTION 2. In Colorado Revised Statutes, 25-17-504, amend10 (1) introductory portion as follows:11 25-17-504. Restrictions on use of single-use plastic carryout12 bag - inventory exception. (1) Subject to section 25-17-505 (1), on and13 after January 1, 2024, A store or retail food establishment shall not14 provide a single-use plastic carryout bag to a customer; except that a retail15 food establishment need not comply with this section if the retail food16 establishment:17 SECTION 3. In Colorado Revised Statutes, repeal 25-17-505.18 SECTION 4. Act subject to petition - effective date. This act19 takes effect at 12:01 a.m. on the day following the expiration of the20 ninety-day period after final adjournment of the general assembly; except21 that, if a referendum petition is filed pursuant to section 1 (3) of article V22 of the state constitution against this act or an item, section, or part of this23 act within such period, then the act, item, section, or part will not take24 HB25-1051-2- effect unless approved by the people at the general election to be held in1 November 2026 and, in such case, will take effect on the date of the2 official declaration of the vote thereon by the governor.3 HB25-1051 -3-
