Dashes through the words or numbers indicate deletions from existing law. repeals this requirement. Be it enacted by the General Assembly of the State of Colorado:1 SECTION 1. In Colorado Revised Statutes, 42-4-316, repeal (2)2 and (3)(b) as follows:3 42-4-316. AIR program - demonstration of compliance with4 ambient air quality standards and transportation conformity. (2) The5 legislative audit committee shall cause to be conducted performance6 audits of the program, including the clean screen program. The audits7 must be completed not later than January 1, 2018, and January 1 of each8 fifth year thereafter. Upon completion of the audit report, the legislative9 audit committee shall hold a public hearing to review the report.10 (3) (b) In such audits, the determination as to whether an ongoing11 public need for the program has been demonstrated shall take into12 consideration the following factors, among others:13 (I) The demonstrable effect on ambient air quality of the program;14 (II) The cost to the public of the program;15 (III) The cost-effectiveness of the program relative to other air16 pollution control programs;17 (IV) The need, if any, for further reduction of air pollution caused18 by mobile sources to attain or maintain compliance with national ambient19 air quality standards;20 (V) The application of the program to assure compliance with21 legally required warranties covering air pollution control equipment.22 SECTION 2. Act subject to petition - effective date. This act23 takes effect at 12:01 a.m. on the day following the expiration of the24 ninety-day period after final adjournment of the general assembly; except25 1054-2- that, if a referendum petition is filed pursuant to section 1 (3) of article V1 of the state constitution against this act or an item, section, or part of this2 act within such period, then the act, item, section, or part will not take3 effect unless approved by the people at the general election to be held in4 November 2026 and, in such case, will take effect on the date of the5 official declaration of the vote thereon by the governor.6 1054 -3-
