The CLER is a statewide law enforcement agency, governed by a board with representatives appointed by local governments that enter an intergovernmental agreement regarding the use of the CLER. The bill acknowledges the current status of Colorado Rangers serving with the CLER as peace officers with reserve police officer status whose duties are limited by statue and who must be certified by the Peace Officer Standards and Training (POST) Board in the Department of Law. The bill grants the CLER’s board authority to operate the CLER, including policies and procedures to allow compensation of Colorado Rangers during emergencies and the ability to accept gifts, grants, and donations. The bill removes references in existing law to the Colorado Mounted Rangers and replaces these with references to the Colorado Rangers. Finally, the CLER board is required to submit a sunrise application to the POST Board by July 1, 2025, to determine if any change in peace officer status is necessary. State Revenue POST Board Cash Fund To the extent that changes made by the bill requires more people to obtain POST certification to serve as Colorado Rangers, the bill may increase revenue to the POST Board Cash Fund from fees paid to acquire necessary peace officer certifications. This revenue is subject to TABOR. It is assumed that most persons currently serving as Colorado Rangers already have necessary POST certification, and any increase in state revenue is assumed to be minimal. State Expenditures Department of Law The bill will increase workload in the Department of Law to ensure that both the CLER and the Colorado Rangers comply with laws regarding peace officers, as well as for the POST Board to conduct the peace officer status sunrise review required by the bill. Any increase in workload is assumed to be minimal, and no change in appropriations is required. State Law Enforcement Agencies To the extent state law enforcement agencies, including the Department of Public Safety (CDPS) and the Department of Corrections (DOC), use the CLER or the Colorado Rangers as a resource, workload and expenditures may increase. These impacts are expected to be minimal, and if any additional funding is required the fiscal note assumes it will occur through the annual budget process. Page 3 February 19, 2025 HB 25-1181 Local Government The bill increases workload to local entities to make the required appointments to the CLER board. This workload is assumed to be minimal. In addition, to the extent policies adopted by the board result in local governments compensating the Colorado Rangers, costs to these local governments may increase. To the extent the CLER receives gifts, grants, and donations, the CLER’s revenue will increase. No source of gifts, grants, and donations have been identified at this time. Effective Date The bill takes effect upon signature of the Governor, or upon becoming law without his signature.
