Sections 3 through 5 make conforming amendments to provisions with internal references to the plumbing profession definitions. Be it enacted by the General Assembly of the State of Colorado:1 SECTION 1. In Colorado Revised Statutes, 12-155-103, add2 with relocated provisions (1.2) and (1.4); and add with amended and3 relocated provisions (1.6) as follows:4 12-155-103. Definitions. As used in this article 155, unless the5 context otherwise requires:6 (1.2) [Formerly 12-155-103 (6)] "Colorado fuel gas code" means7 a code adopted by rule of the board for the inspection of plumbing fuel8 gas pipe installations.9 (1.4) [Formerly 12-155-103 (5)] "Colorado plumbing code" or10 "the code" means a code established by the board that consists of11 standards for plumbing installation, plumbing materials, conservation,12 medical gas, sanitary drainage systems, and solar plumbing that could13 directly affect the potable water supply.14 (1.6) [Formerly 12-155-103 (7)] (a) "Conservation" means15 efficiency measures that meet national guidelines and standards and are16 tested and approved by a nationally recognized testing laboratory,17 including:18 (I) Water-efficient devices and fixtures; and19 (II) The use of locally produced materials, when practicable, to20 reduce transportation impacts.21 (b) When conservation conflicts with safety, the board shall give22 primary consideration to safety.23 (c) Nothing in this subsection (7) SUBSECTION (1.6) affects the24 board's authority to establish the Colorado plumbing code as specified in25 section 12-155-106.26 1306-2- SECTION 2. Repeal of relocated provisions in this act. In1 Colorado Revised Statutes, repeal 12-155-103 (5), (6), and (7).2 SECTION 3. In Colorado Revised Statutes, 12-155-106, amend3 (1) as follows:4 12-155-106. Colorado plumbing code - amendments -5 variances - Colorado fuel gas code. (1) In accordance with article 4 of6 title 24, the board shall establish a Colorado plumbing code, as defined7 in section 12-155-103 (5) (1.4). The code shall MUST represent the8 minimum standards for installation, alteration, and repair of plumbing9 equipment and systems throughout the state.10 SECTION 4. In Colorado Revised Statutes, 30-28-211, amend11 (2)(a.5) as follows:12 30-28-211. Energy efficient building codes - legislative13 declaration - definitions. (2) As used in this section, unless the context14 otherwise requires:15 (a.5) "Colorado plumbing code" has the meaning set forth in16 section 12-155-103 (5) (1.4).17 SECTION 5. In Colorado Revised Statutes, 31-15-602, amend18 (2)(a.5) as follows:19 31-15-602. Energy efficient building codes - legislative20 declaration - definitions - repeal. (2) As used in this section, unless the21 context otherwise requires:22 (a.5) "Colorado plumbing code" has the meaning set forth in23 section 12-155-103 (5) (1.4).24 SECTION 6. Act subject to petition - effective date. This act25 takes effect at 12:01 a.m. on the day following the expiration of the26 ninety-day period after final adjournment of the general assembly; except27 1306 -3- that, if a referendum petition is filed pursuant to section 1 (3) of article V1 of the state constitution against this act or an item, section, or part of this2 act within such period, then the act, item, section, or part will not take3 effect unless approved by the people at the general election to be held in4 November 2026 and, in such case, will take effect on the date of the5 official declaration of the vote thereon by the governor.6 1306 -4-
