Background In 2015, the United States Supreme Court ruled in Obergefell v. Hodges that all states must grant and recognize same-sex marriages. Colorado voters also approved Amendment J at the November 2024 general election, which removed the constitutional provision stating that a marriage is only valid if it is between one man and woman. Assessment of No Fiscal Impact Removing the prohibition on same-sex marriage from state statute will have no impact on state agency or local government revenue or expenditures, as it conforms state laws with the state constitution and with current practices following the Supreme Court decision in Obergefell v. Hodges. For this reason, the bill is assessed as having no fiscal impact. Effective Date The bill takes effect upon signature of the Governor, or upon becoming law without his signature.
