Summary Information Overview. The bill clarifies that students with disabilities who are part of military families are eligible for open enrollment and guaranteed matriculation in school districts and charter schools. If these students have an Individualized Education Plan under the Federal Individuals with Disabilities Education Act (IDEA) or a Section 504 Plan under the Federal Rehabilitation Act, the school district or charter school must ensure they receive appropriate services. School districts and charter schools must take reasonable steps to notify incoming military families of the rights for their children to receive special education services. State Expenditures The Colorado Department of Education provides technical assistance to school districts and charter schools to ensure compliance with open enrollment requirements and special education services. Any additional guidance or support from the department is assumed to be minimal and can be accomplished with existing appropriations. School Districts School districts and charter schools will have increased workload to communicate with active duty military families. This increase in workload will vary depending on the number of military family students served. Effective Date The bill takes effect 90 days following adjournment of the General Assembly sine die, assuming no referendum petition is filed.
