The specified rules will expire as scheduled in the "State Administrative Procedure Act" on May 15, 2025, on the grounds that the rules conflict with statute. Be it enacted by the General Assembly of the State of Colorado:1 SECTION 1. Extension of rules scheduled for expiration May2 15, 2025 - exceptions. (1) Except as indicated, the expiration of all rules3 of agencies in the following principal departments, which rules were4 adopted or amended on or after November 1, 2023, and before November5 1, 2024, and that are therefore scheduled for expiration May 15, 2025, is6 postponed:7 (a) Department of agriculture;8 (b) Department of corrections;9 (c) Department of early childhood;10 (d) Department of education; except that the following rules of the11 state board of education concerning rules for the administration of the12 public school finance act of 1994 (1 CCR 301-39) are not extended:13 (I) Rule 3.04, which states in part "The applicable 11-day count14 period is defined as ...";15 (II) Rule 5.04, which states in part "Pupils that first establish16 attendance after the applicable count date but within the applicable17 11-day count period ... for funding at the sending district"; and18 (III) Rule 5.12(6), which states in part "If a pupil transfers from19 one Colorado public school district to another, after the pupil enrollment20 count date but within the 11-day count period ...";21 (e) Department of health care policy and financing;22 (f) Department of higher education;23 SB25-125-2- (g) Department of human services;1 (h) Department of labor and employment;2 (i) Department of law;3 (j) Department of local affairs;4 (k) Department of military and veterans affairs;5 (l) Department of natural resources;6 (m) Department of personnel;7 (n) Department of public health and environment;8 (o) Department of public safety; except that the following rule of9 the division of fire prevention and control concerning rules for Colorado10 wildfire resilient homes grant program (8 CCR 1507-37) is not extended:11 Rule 2.1's definition of "homeowner", which states in part "'Homeowner'12 means a person who owns property ... wildfires";13 (p) Department of regulatory agencies;14 (q) Department of revenue;15 (r) Department of state;16 (s) Department of transportation; and17 (t) Department of the treasury.18 (2) The expiration of all rules of the public employees' retirement19 association, which rules were adopted or amended on or after November20 1, 2023, and before November 1, 2024, and which are therefore scheduled21 for expiration May 15, 2025, is postponed.22 (3) The expiration of all rules of the board of equalization, which23 rules were adopted or amended on or after November 1, 2023, and before24 November 1, 2024, and which are therefore scheduled for expiration May25 15, 2025, is postponed.26 (4) The recommendations of the committee on legal services as27 SB25-125 -3- reflected in this act apply to the specified rules in the form in which the1 rules were considered and acted upon by the committee. Any amendments2 or other changes in the specified rules that became effective before3 November 1, 2024, that comply with the recommendations of the4 committee on legal services are not affected by this act. Any subsequent5 amendments or other changes in the specified rules that became effective6 on or after November 1, 2024, are not affected by this act.7 SECTION 2. Safety clause. The general assembly finds,8 determines, and declares that this act is necessary for the immediate9 preservation of the public peace, health, or safety or for appropriations for10 the support and maintenance of the departments of the state and state11 institutions.12 SB25-125 -4-
