Committee on Legal Services. Based on the findings and
recommendations of the committee on legal services, the bill extends all
state agency rules that were adopted or amended on or after November 1,
2023, and before November 1, 2024, with the exception of certain rules
of the state board of education and the division of fire prevention and

The specified rules will expire as scheduled in the "State
Administrative Procedure Act" on May 15, 2025, on the grounds that the
rules conflict with statute.
Be it enacted by the General Assembly of the State of Colorado:1
SECTION 1.  Extension of rules scheduled for expiration May2
15, 2025 - exceptions. (1)  Except as indicated, the expiration of all rules3
of agencies in the following principal departments, which rules were4
adopted or amended on or after November 1, 2023, and before November5
1, 2024, and that are therefore scheduled for expiration May 15, 2025, is6
postponed:7
(a)  Department of agriculture;8
(b)  Department of corrections;9
(c)  Department of early childhood;10
(d)  Department of education; except that the following rules of the11
state board of education concerning rules for the administration of the12
public school finance act of 1994 (1 CCR 301-39) are not extended:13
(I)  Rule 3.04, which states in part "The applicable 11-day count14
period is defined as ...";15
(II)  Rule 5.04, which states in part "Pupils that first establish16
attendance after the applicable count date but within the applicable17
11-day count period ... for funding at the sending district"; and18
(III)  Rule 5.12(6), which states in part "If a pupil transfers from19
one Colorado public school district to another, after the pupil enrollment20
count date but within the 11-day count period ...";21
(e)  Department of health care policy and financing;22
(f)  Department of higher education;23

(h)  Department of labor and employment; except that the2
following rule of the division of labor standards and statistics concerning3
protections for public workers act (PROPWA) rules (7 CCR 1103-17) is4
not extended: Rule 1.3, which states in part "Incorporation by Reference.5
The Protections for ...";6
(i)  Department of law;7
(j)  Department of local affairs;8
(k)  Department of military and veterans affairs;9
(l)  Department of natural resources;10
(m)  Department of personnel;11
(n)  Department of public health and environment;12
(o)  Department of public safety; except that the following rule of13
the division of fire prevention and control concerning rules for Colorado14
wildfire resilient homes grant program (8 CCR 1507-37) is not extended:15
Rule 2.1's definition of "homeowner", which states in part "'Homeowner'16
means a person who owns property ... wildfires";17
(p)  Department of regulatory agencies; except that the following18
rule of the state board of nursing concerning nursing rules and regulations19
(3 CCR 716-1) is not extended: Rule 1.28 K. 1., which states in part "A20
Certified Midwife scope of practice is set ...";21
(q)  Department of revenue;22
(r)  Department of state;23
(s)  Department of transportation; and24
(t)  Department of the treasury.25
(2)  The expiration of all rules of the public employees' retirement26
association, which rules were adopted or amended on or after November27

-3- 1, 2023, and before November 1, 2024, and which are therefore scheduled1
for expiration May 15, 2025, is postponed.2
(3)  The expiration of all rules of the board of equalization, which3
rules were adopted or amended on or after November 1, 2023, and before4
November 1, 2024, and which are therefore scheduled for expiration May5
15, 2025, is postponed.6
(4)  The recommendations of the committee on legal services as7
reflected in this act apply to the specified rules in the form in which the8
rules were considered and acted upon by the committee. Any amendments9
or other changes in the specified rules that became effective before10
November 1, 2024, that comply with the recommendations of the11
committee on legal services are not affected by this act. Any subsequent12
amendments or other changes in the specified rules that became effective13
on or after November 1, 2024, are not affected by this act.14
SECTION 2. Safety clause. The general assembly finds,15
determines, and declares that this act is necessary for the immediate16
preservation of the public peace, health, or safety or for appropriations for17
the support and maintenance of the departments of the state and state18
institutions.19
