The bill creates the Colorado government efficiency authority (authority). The authority is governed by a board consisting of the following appointees: ! One representative of the private sector with business experience with state contracts, appointed by the governor; ! One representative of the private sector with experience in energy and environmental work, appointed by the president of the senate; ! One representative of the private sector with experience in transportation, appointed by the minority leader of the house of representatives; ! One representative of the private sector with experience in health care or real estate, appointed by the minority leader of the senate; ! The staff director of the joint budget committee, or the staff director's designee, as a nonvoting advisory member; ! The director of the office of state planning and budgeting, or the director's designee, as a nonvoting advisory member; and ! The state auditor, or the state auditor's designee, as a nonvoting advisory member. Members of the board serve without compensation for any service provided to the authority and do not receive any reimbursement from the board for expenses incurred in furtherance of the board's responsibilities. The board is charged with: ! Examining every state-funded state agency and state department's operations, personnel, and mission to determine whether the state agency or state department is maximizing the efficient use of state money and resources; ! Identifying efficiencies in state government that would result in cost savings and improved provision of government services; ! Working with the federal government to implement federal directives designed to increase government efficiency and reduce government costs; ! Providing recommendations to the governor and general assembly about implementing efficiencies in state government, leveraging money from the federal government, and implementing federal directives; ! Holding public hearings that solicit input from the public about increasing efficiencies in state government; and ! Developing a process for members of the public to make ongoing recommendations related to state government efficiency, which recommendations will be reviewed by the authority. The authority may accept gifts, grants, donations, and federal money to pay for the authority's operations. The authority is not funded by a state agency or state department. SB25-135-2- Be it enacted by the General Assembly of the State of Colorado:1 SECTION 1. In Colorado Revised Statutes, add 24-1-139 as2 follows:3 24-1-139. Government efficiency authority - creation - duties4 and powers - government efficiency fund. (1) T HERE IS CREATED THE5 C OLORADO GOVERNMENT EFFICIENCY AUTHORITY , ALSO REFERRED TO IN6 THIS SECTION AS THE "AUTHORITY", WHICH IS A BODY CORPORATE AND A7 POLITICAL SUBDIVISION OF THE STATE. THE AUTHORITY IS NOT AN AGENCY8 OF STATE GOVERNMENT AND IS NOT SUBJECT TO ADMINISTRATIVE9 DIRECTION BY ANY STATE AGENCY .10 (2) (a) T HE POWERS OF THE AUTHORITY ARE VESTED IN A BOARD11 OF DIRECTORS CONSISTING OF THE FOLLOWING MEMBERS :12 (I) O NE REPRESENTATIVE OF THE PRIVATE SECTOR WITH BUSINESS13 EXPERIENCE WITH STATE CONTRACTS , APPOINTED BY THE GOVERNOR;14 (II) O NE REPRESENTATIVE OF THE PRIVATE SECTOR WITH15 EXPERIENCE AS A CHIEF FINANCIAL OFFICER OR LEGAL ADVISOR ,16 APPOINTED BY THE SPEAKER OF THE HOUSE OF REPRESENTATIVES ;17 (III) O NE REPRESENTATIVE OF THE PRIVATE SECTOR WITH18 EXPERIENCE IN ENERGY AND ENVIRONMENTAL WORK , APPOINTED BY THE19 PRESIDENT OF THE SENATE;20 (IV) O NE REPRESENTATIVE OF THE PRIVATE SECTOR WITH21 EXPERIENCE IN TRANSPORTATION , APPOINTED BY THE MINORITY LEADER22 OF THE HOUSE OF REPRESENTATIVES ;23 (V) O NE REPRESENTATIVE OF THE PRIVATE SECTOR WITH24 EXPERIENCE IN HEALTH CARE OR REAL ESTATE , APPOINTED BY THE25 MINORITY LEADER OF THE SENATE;26 (VI) T HE STAFF DIRECTOR OF THE JOINT BUDGET COMMITTEE , OR27 SB25-135 -3- THE STAFF DIRECTOR'S DESIGNEE, AS A NONVOTING ADVISORY MEMBER ;1 (VII) T HE DIRECTOR OF THE OFFICE OF STATE PLANNING AND2 BUDGETING, OR THE DIRECTOR'S DESIGNEE, AS A NONVOTING ADVISORY3 MEMBER; AND4 (VIII) THE STATE AUDITOR, OR THE STATE AUDITOR'S DESIGNEE,5 AS A NONVOTING ADVISORY MEMBER .6 (b) T HE BOARD MEMBERS ARE APPOINTED TO THREE -YEAR TERMS;7 EXCEPT THAT THREE OF THE MEMBERS APPOINTED ON OR BEFORE JANUARY8 1, 2026, SERVE AN INITIAL TERM OF TWO YEARS . EACH MEMBER9 CONTINUES IN OFFICE UNTIL THE MEMBER 'S SUCCESSOR IS APPOINTED.10 I NITIAL MEMBERS OF THE AUTHORITY MUST BE APPOINTED NO LATER THAN11 J ANUARY 1, 2026.12 (c) O N THE EXPIRATION OF THE TERM OF A MEMBER OF THE BOARD ,13 THAT MEMBER'S SUCCESSOR MUST BE APPO INTED BY THE RESPECTIVE14 APPOINTING AUTHORITY FOR A TERM OF THREE YEARS ; EXCEPT THAT, IN15 THE CASE OF A VACANCY, THE RESPECTIVE APPOINTING AUTHORITY SHALL16 APPOINT A PERSON TO SERVE FOR THE REMAINDER OF THE UNEXPIRED17 TERM.18 (3) (a) E ACH BOARD MEMBER WHO IS NOT AN ADVISORY MEMBER19 SHALL MEET THE FOLLOWING QUALIFICATIONS AT THE TIME OF20 APPOINTMENT AND THROUGHOUT THE MEMBER 'S TERM OF OFFICE:21 (I) RESIDENCY IN THIS STATE; AND22 (II) DEMONSTRATION OF ACTIVE INTEREST IN STREAMLINING23 GOVERNMENT REGULATIONS , COST MANAGEMENT , AND REDUCING24 GOVERNMENT WASTE .25 (b) T HE RESPECTIVE APPOINTING AUTHORITY SHALL IMMEDIATELY26 DECLARE THE OFFICE OF ANY MEMBER OF THE BOARD WHO IS NOT AN27 SB25-135 -4- ADVISORY MEMBER VACANT WHENEVER THE APPOINTING AUTHORITY1 FINDS THAT THE MEMBER NO LONGER MEETS THE QUALIFICATIONS SET2 FORTH IN SUBSECTION (3)(a) OF THIS SECTION OR THAT THE MEMBER IS3 UNABLE TO PERFORM THE DUTIES OF THE OFFICE .4 (c) M EMBERS SERVE WITHOUT COMPENSATION FOR ANY SERVICE5 PROVIDED TO THE AUTHORITY AND DO NOT RECEIVE ANY REIMBURSEMENT6 FROM THE BOARD FOR EXPENSES INCURRED FULFILLING THEIR7 RESPONSIBILITIES PURSUANT TO THIS SECTION.8 (4) T HE BOARD MAY:9 (a) E XAMINE EVERY STATE-FUNDED STATE AGENCY AND STATE10 DEPARTMENT'S OPERATIONS, PERSONNEL, AND MISSION TO DETERMINE11 WHETHER THE STATE AGENCY OR STATE DEPARTMENT IS MAXIMIZING THE12 EFFICIENT USE OF STATE MONEY AND RESOURCES ;13 (b) I DENTIFY EFFICIENCIES IN STATE GOVERNMENT THAT WOULD14 RESULT IN COST SAVINGS AND IMPROVED PROVISION OF GOVERNMENT15 SERVICES;16 (c) W ORK WITH THE FEDERAL GOVERNMENT TO IMPLEMENT17 FEDERAL DIRECTIVES DESIGNED TO INCREASE GOVERNMENT EFFICIENCY18 AND REDUCE GOVERNMENT COSTS ;19 (d) D EVELOP, ADOPT, AND IMPLEMENT A PROCESS TO FUND AND20 EXPEND MONEY FOR THE ACTIVITIES AND RESPONSIBILITIES OF THE BOARD ;21 (e) A CCEPT GIFTS, GRANTS, AND DONATIONS , INCLUDING22 PERSONAL SERVICES, AND MONEY FROM THE FEDERAL GOVERNMENT TO23 SUPPORT THE ACTIVITIES AND RESPONSIBILITIES OF THE BOARD . WHEN24 EXPENDING MONEY TO IMPLEMENT THIS SECTION , THE AUTHORITY SHALL25 GIVE PRIORITY TO LEVERAGING FEDERAL MONEY THAT MAY BE AVAILABLE26 TO FURTHER THE MISSION OF THE AUTHORITY ;27 SB25-135 -5- (f) PROVIDE RECOMMENDATIONS TO THE GOVERNOR AND GENERAL1 ASSEMBLY ABOUT IMPLEMENTING EFFICIENCIES IN STATE GOVERNMENT ,2 LEVERAGING MONEY FROM THE FEDERAL GOVERNMENT , AND3 IMPLEMENTING FEDERAL DIRECTIVES ;4 (g) H OLD PUBLIC HEARINGS THAT SOLICIT INPUT FROM THE PUBLIC5 ABOUT INCREASING EFFICIENCIES IN STATE GOVERNMENT ; AND6 (h) D EVELOP A PROCESS FOR MEMBERS OF THE PUBLIC TO MAKE7 ONGOING RECOMMENDATIONS RELATED TO STATE GOVERNMENT8 EFFICIENCY, WHICH RECOMMENDATIONS WILL BE REVIEWED BY THE9 AUTHORITY.10 (5) T HE AUTHORITY, CREATED PURSUANT TO THIS SECTION, IS NOT11 FUNDED BY OR THROUGH ANY STATE AGENCY OR STATE DEPARTMENT .12 SECTION 2. Act subject to petition - effective date. This act13 takes effect at 12:01 a.m. on the day following the expiration of the14 ninety-day period after final adjournment of the general assembly; except15 that, if a referendum petition is filed pursuant to section 1 (3) of article V16 of the state constitution against this act or an item, section, or part of this17 act within such period, then the act, item, section, or part will not take18 effect unless approved by the people at the general election to be held in19 November 2026 and, in such case, will take effect on the date of the20 official declaration of the vote thereon by the governor.21 SB25-135 -6-
