In addition, a contract entered into by a board of directors that involves a consideration that exceeds $250,000 but does not exceed $400,000 must be authorized and ratified in writing by no less than one-third of the electors of the irrigation district according to the number of votes cast at the last district election. A contract that exceeds $400,000 must be authorized and ratified at an election in the manner provided for the issuance of bonds. To account for inflation, the bill: ! Increases the amount of compensation for members of a board of directors and judges of election to up to $150 per day; and ! Requires that, to be binding, a contract entered into by a board of directors that exceeds $400,000 but does not exceed $650,000 must be authorized and ratified in writing by no less than one-third of the electors of the irrigation district according to the number of votes cast at the last district election, and a contract that exceeds $650,000 must be authorized and ratified at an election in the manner provided for the issuance of bonds. The bill requires that the dollar amounts related to compensation of members of a board of directors and judges of election, as well as those related to contracts entered into by a board of directors, must be increased every 5 years, beginning July 1, 2029, according to the rate of inflation. Be it enacted by the General Assembly of the State of Colorado:1 SECTION 1. In Colorado Revised Statutes, 37-41-107, amend2 (5) as follows:3 37-41-107. Office of board - elections. (5) Each judge of4 election shall receive as compensation the sum of up to one hundred5 FIFTY dollars per day, to be paid by the district.6 SECTION 2. In Colorado Revised Statutes, amend 37-41-108 as7 follows:8 37-41-108. Directors - secretary - salaries. Each member of the9 board of directors may receive compensation at the rate of up to one10 hundred FIFTY dollars per day while attending meetings and shall be11 reimbursed for his or her THEIR actual and necessary expenses while12 140-2- engaged in official business. No A director or officer named in this article1 ARTICLE 41 shall NOT be interested, directly or indirectly, in any manner,2 in any contract awarded or to be awarded by the board or in the profits to3 be derived therefrom FROM THE CONTRACT, nor shall he or she THEY4 receive any bonds, gratuity, or bribe. For any violation of this section,5 such officer commits a class 6 felony and shall be punished as provided6 in section 18-1.3-401. C.R.S. He or she shall also forfeit his or her THEIR7 office upon conviction.8 SECTION 3. In Colorado Revised Statutes, 37-41-113, amend9 (4) as follows:10 37-41-113. Dollar amounts adjusted for inflation - definition.23 (1) E VERY FIVE YEARS, BEGINNING ON JULY 1, 2029, THE DOLLAR24 AMOUNTS SET FORTH IN SECTIONS 37-41-107 (5), 37-41-108, AND25 37-41-113 (4) INCREASE BY THE RATE OF INFLATION, ROUNDED TO THE26 NEAREST DOLLAR.27 140 -3- (2) AS USED IN THIS SECTION, UNLESS THE CONTEXT OTHERWISE1 REQUIRES, "INFLATION" MEANS THE ANNUAL PERCENTAGE CHANGE IN THE2 U NITED STATES DEPARTMENT OF LABOR 'S BUREAU OF LABOR STATISTICS3 CONSUMER PRICE INDEX , OR A SUCCESSOR INDEX , FOR4 D ENVER-AURORA-LAKEWOOD FOR ALL ITEMS PAID FOR BY URBAN5 CONSUMERS.6 SECTION 5. Act subject to petition - effective date -7 applicability. (1) This act takes effect at 12:01 a.m. on the day following8 the expiration of the ninety-day period after final adjournment of the9 general assembly; except that, if a referendum petition is filed pursuant10 to section 1 (3) of article V of the state constitution against this act or an11 item, section, or part of this act within such period, then the act, item,12 section, or part will not take effect unless approved by the people at the13 general election to be held in November 2026 and, in such case, will take14 effect on the date of the official declaration of the vote thereon by the15 governor.16 (2) This act applies to events and circumstances occurring on or17 after the applicable effective date of this act.18 140 -4-
