ONCERNING CLARIFICATION OF THE CONDITIONS UNDER WHICH AN
UNCONTESTED ELECTION IN A SPECIAL DISTRICT DIRECTOR DISTRICT
MAY BE CANCELED

Be it enacted by the General Assembly of the State of Colorado:
SECTION 1. In Colorado Revised Statutes, 1-13.5-513, amend (4);
and add (3.5) as follows:
1-13.5-513.  Election may be canceled - when - definition.
(3.5) (a)  I
F, PURSUANT TO SECTION 32-1-902.7, THE BOARD OF DIRECTORS
OF A SPECIAL DISTRICT HAS ADOPTED A RESOLUTION TO DIVIDE THE SPECIAL
DISTRICT INTO DIRECTOR DISTRICTS AND HAS DESIGNATED THAT THE
DIRECTORS REPRESENTING THE DIRECTOR DISTRICTS MUST BE ELECTED BY
THE ELIGIBLE ELECTORS WITHIN EACH DIRECTOR DISTRICT
, THEN THE
GOVERNING BODY MAY CANCEL THE ELECTION FOR ONE OR MORE DIRECTOR
DISTRICTS IF
, WITH RESPECT TO EACH SUCH DIRECTOR DISTRICT , ALL THE
CONDITIONS OF SUBSECTION 
(1) OF THIS SECTION EXIST AND ALL BALLOT
ISSUES OR BALLOT QUESTIONS
, IF ANY, HAVE BEEN WITHDRAWN FROM THE

(b)  A
S USED IN THIS SUBSECTION (3.5), "DIRECTOR DISTRICT" MEANS
THE AREA REPRESENTED BY ONE DIRECTOR WITHIN A SPECIAL DISTRICT IN
WHICH THE BOARD HAS ADOPTED A RESOLUTION TO DIVIDE THE SPECIAL
DISTRICT INTO DIRECTOR DISTRICTS PURSUANT TO SECTION 
32-1-902.7.
(4)  Except as provided in subsection (2)
 SUBSECTIONS (2) AND (3.5)
of this section, no election may be canceled in part.
SECTION 2. Act subject to petition - effective date -
applicability. (1)  This act takes effect at 12:01 a.m. on the day following
the expiration of the ninety-day period after final adjournment of the
general assembly; except that, if a referendum petition is filed pursuant to
section 1 (3) of article V of the state constitution against this act or an item,
section, or part of this act within such period, then the act, item, section, or
part will not take effect unless approved by the people at the general
election to be held in November 2026 and, in such case, will take effect on
the date of the official declaration of the vote thereon by the governor.

effective date of this act.
