Be it enacted by the General Assembly of the State of Colorado:1 SECTION 1. In Colorado Revised Statutes, 24-34-104, repeal2 (26)(a)(IV); and add (31)(a)(XIV) as follows:3 24-34-104. General assembly review of regulatory agencies4 and functions for repeal, continuation, or reestablishment - legislative5 declaration - repeal. (26) (a) The following agencies, functions, or both,6 are scheduled for repeal on September 1, 2025:7 (IV) The rural alcohol and substance abuse prevention and 8 treatment program created pursuant to section 27-80-117 in the9 behavioral health administration in the department of human services;10 (31) (a) The following agencies, functions, or both, are scheduled11 for repeal on September 1, 2030:12 (XIV) T HE RURAL ALCOHOL AND SUBSTANCE ABUSE PREVENTION13 AND TREATMENT PROGRAM CREATED PURSUANT TO SECTION 27-80-117 IN14 THE BEHAVIORAL HEALTH ADMINISTRATION IN THE DEPARTMENT OF15 HUMAN SERVICES.16 SECTION 2. In Colorado Revised Statutes, 27-80-117, amend17 (4)(a) as follows:18 27-80-117. Rural alcohol and substance abuse prevention and19 treatment program - creation - administration - cash fund -20 definitions - repeal. (4) (a) This section is repealed, effective September 21 1, 2025 SEPTEMBER 1, 2030.22 SECTION 3. In Colorado Revised Statutes, 18-19-103.5, amend23 (4) as follows:24 SB25-195-2- 18-19-103.5. Rural alcohol and substance abuse surcharge -1 repeal. (4) This section is repealed, effective September 1, 20252 S EPTEMBER 1, 2030, unless the general assembly extends the repeal of the3 rural alcohol and substance abuse prevention and treatment program4 created in section 27-80-117.5 SECTION 4. In Colorado Revised Statutes, 42-4-1307, amend6 (10)(d)(II) as follows:7 42-4-1307. Penalties for traffic offenses involving alcohol and8 drugs - legislative declaration - definitions - repeal. (10) Additional9 costs and surcharges. In addition to the penalties prescribed in this10 section:11 (d) (II) This paragraph (d) SUBSECTION (10)(d) is repealed,12 effective September 1, 2025 SEPTEMBER 1, 2030, unless the general13 assembly extends the repeal of the rural alcohol and substance abuse14 prevention and treatment program created in section 27-80-117.15 SECTION 5. In Colorado Revised Statutes, 42-4-1701, amend16 (4)(f)(III) as follows:17 42-4-1701. Traffic offenses and infractions classified -18 penalties - penalty and surcharge schedule - repeal. (4) (f) (III) This19 paragraph (f) SUBSECTION (4)(f) is repealed, effective September 1, 202520 S EPTEMBER 1, 2030, unless the general assembly extends the repeal of the21 rural alcohol and substance abuse prevention and treatment program22 created in section 27-80-117.23 SECTION 6. Act subject to petition - effective date. This act24 takes effect at 12:01 a.m. on the day following the expiration of the25 ninety-day period after final adjournment of the general assembly; except26 that, if a referendum petition is filed pursuant to section 1 (3) of article V27 SB25-195 -3- of the state constitution against this act or an item, section, or part of this1 act within such period, then the act, item, section, or part will not take2 effect unless approved by the people at the general election to be held in3 November 2026 and, in such case, will take effect on the date of the4 official declaration of the vote thereon by the governor.5 SB25-195 -4-
