Executive Committee of the Legislative Council. The bill suspends legislative interim committee activities during the 2025 legislative interim (interim). Specifically, the bill: ! Prohibits the legislative council of the general assembly from prioritizing any requests for interim committees, including task forces, for the interim; ! Prohibits meetings, field trips, and legislative recommendations and reports by, and suspends for one year certain reports required to be submitted to, existing interim committees, including the legislative emergency preparedness, response, and recovery committee; legislative oversight committee for Colorado jail standards; statewide health care review committee; Colorado health insurance exchange oversight committee; opioid and other substance use disorders study committee; legislative oversight committee concerning the treatment of persons with behavioral health disorders in the criminal and juvenile justice systems; pension review commission and pension review subcommittee; legislative oversight committee concerning tax policy; and sales and use tax simplification task force. Be it enacted by the General Assembly of the State of Colorado:1 SECTION 1. In Colorado Revised Statutes, 2-3-303.3, add (3)(e)2 as follows:3 2-3-303.3. Interim committees - repeal.4 (3) (e) (I) N OTWITHSTANDING ANY PROVISION OF THIS SECTION , THE5 LEGISLATIVE COUNCIL SHALL NOT PRIORITIZE ANY INTERIM COMMITTEES6 OR APPROVE ANY TASK FORCES FOR THE 2025 INTERIM. NOTHING IN THIS7 SUBSECTION (3)(e) PROHIBITS THE EXECUTIVE COMMITTEE OF THE8 LEGISLATIVE COUNCIL, WHETHER BEFORE OR AFTER THE GENERAL9 ASSEMBLY HAS ADJOURNED, FROM APPROVING AN INTERIM COMMITTEE BY10 RESOLUTION FOR THE 2025 INTERIM IN THE MANNER SPECIFIED IN11 SUBSECTION (3)(c) OF THIS SECTION.12 (II) T HIS SUBSECTION (3)(e) IS REPEALED, EFFECTIVE JULY 1, 2026.13 SB25-199-2- SECTION 2. In Colorado Revised Statutes, 2-2-1303, amend1 (2)(a)(III)(A) as follows:2 2-2-1303. Membership - selection - terms.3 (2) (a) Nonlegislative council members shall be appointed as follows:4 (III) (A) On or before August 31 of each year, EXCEPT FOR5 A UGUST 31, 2025, the council members shall approve subsequent6 appointments to the council. A youth who meets the criteria set forth in7 subsection (1) of this section may apply to the council to be considered8 for participation in the council.9 SECTION 3. In Colorado Revised Statutes, 2-2-1304, amend10 (2)(b) and (4)(a) as follows:11 2-2-1304. Duties - meetings - community outreach -12 designation of organization to accept donations - authority to13 contract - repeal. (2) (b) (I) The council shall meet at least four times14 each year, with two meetings occurring during the regular legislative15 session and two meetings occurring after the regular legislative session16 has concluded. Council members may attend and participate in council17 meetings remotely, but at least two of the council's meetings each year18 must be held in person, with all attending members at the same physical19 location. Additional meetings may be held at the discretion of council20 leadership, subject to available money.21 (II) (A) N OTWITHSTANDING SUBSECTION (2)(b)(I) OF THIS22 SECTION, THE COUNCIL SHALL MEET ONLY ONCE AFTER THE 2025 REGULAR23 LEGISLATIVE SESSION, IN JULY 2025, AND THE COUNCIL SHALL NOT MEET24 AT ANY TIME IN THE 2026 CALENDAR YEAR.25 (B) T HIS SUBSECTION (2)(b)(II) IS REPEALED, EFFECTIVE JULY 1,26 2027.27 SB25-199 -3- (4) (a) (I) On or before September 1, 2013, and every third1 September 1 thereafter through September 1, 2019, the council shall, in2 conjunction with the director of the legislative council, use a request for3 proposal process to contract with and designate one or more nonprofit4 organizations to provide staffing and operational assistance and to serve5 as the custodian of money donated to the council through the designated6 organization. The contractor selected following the 2019 request for7 proposal process shall, pursuant to one or more contracts, provide such8 staffing, operational, and custodian services through June 30, 2023.9 Thereafter, the council shall, in conjunction with the director of the10 legislative council, on or before April 30, 2023, and, except as otherwise11 provided in this subsection (4)(a), on or before every second April 1512 thereafter, use a request for proposal process to contract with and13 designate one or more nonprofit organizations to provide such staffing,14 operational, and custodian services. The term of each contract entered15 into for a term commencing on or after July 1, 2023, is two state fiscal16 years; except that any such contract may be extended for one additional17 two-year term. If a contract is extended, the request for proposal for the18 next contract must be issued on or before the April 15 immediately19 preceding the expiration of the extension term. The designated20 organization shall not be the custodian of any money appropriated by the21 state and credited to the fund created in section 2-2-1306. The designated22 organization is authorized to expend any money it receives as is necessary23 for the operation of the council and may solicit and accept monetary and24 in-kind gifts, grants, and donations used to further the council's duties and25 responsibilities. Any money donated or awarded to the designated26 organization for the benefit of the council is not subject to appropriation27 SB25-199 -4- by the general assembly. Any money obtained by the council or the1 designated organization and THAT IS not in the fund AND that is2 unexpended and unencumbered at the time the council is dissolved shall3 be distributed according to appropriate federal and state laws governing4 nonprofit organizations. If a different nonprofit or private organization is5 subsequently designated as the custodian of donated money in accordance6 with this paragraph (a) SUBSECTION (4)(a)(I), any money that is7 unexpended and unencumbered at the time of the change in designation8 shall be promptly transferred by the previously designated organization9 to the newly designated organization.10 (II) N OTWITHSTANDING SUBSECTION (4)(a)(I) OF THIS SECTION:11 (A) T HE COUNCIL AND DIRECTOR OF THE LEGISLATIVE COUNCIL12 SHALL NEITHER CONTRACT WITH NOR DESIGNATE ONE OR MORE13 NONPROFIT ORGANIZATIONS TO PROVIDE STAFFING , OPERATIONAL, AND14 CUSTODIAN SERVICES FOR THE PERIOD BEGINNING ON JULY 1, 2025, AND15 ENDING ON JUNE 30, 2027; AND16 (B) T HE CONTRACT THAT TERMINATES ON JULY 1, 2025, IS17 EXTENDED FOR ONE MONTH TO ALLOW THE COUNCIL THE OPPORTUNITY TO18 PRESENT ITS REPORT TO THE REVIEW COMMITTEE IN JULY 2025. THE19 CONTRACT TERMINATES ON AUGUST 1, 2025.20 (III) S UBSECTION (4)(a)(II) OF THIS SECTION AND THIS SUBSECTION21 (4)(a)(III) ARE REPEALED, EFFECTIVE JULY 1, 2027.22 SECTION 4. In Colorado Revised Statutes, 2-2-1305.5, add23 (5)(c) and (6)(c) as follows:24 2-2-1305.5. Representative Hugh McKean Colorado youth25 advisory council review committee - created - repeal.26 (5) (c) (I) N OTWITHSTANDING SUBSECTION (5)(a) OF THIS SECTION, THE27 SB25-199 -5- REVIEW COMMITTEE MAY MEET ONLY ONCE AFTER THE 2025 REGULAR1 LEGISLATIVE SESSION, IN JULY 2025, TO HEAR THE REPORT OF THE2 COUNCIL.3 (II) N OTWITHSTANDING SUBSECTION (5)(a) OF THIS SECTION, THE4 REVIEW COMMITTEE SHALL NOT MEET DURING THE 2026 INTERIM.5 (III) T HIS SUBSECTION (5)(c) IS REPEALED, EFFECTIVE JULY 1,6 2027.7 (6) (c) (I) N OTWITHSTANDING SUBSECTION (6)(a) OF THIS SECTION,8 THE REVIEW COMMITTEE SHALL NOT RECOMMEND LEGISLATION DURING9 THE 2025 OR 2026 INTERIM.10 (II) T HIS SUBSECTION (6)(c) IS REPEALED, EFFECTIVE JULY 1, 2027.11 SECTION 5. In Colorado Revised Statutes, 25-1.5-111, amend12 (2)(a)(XI) as follows:13 25-1.5-111. Suicide prevention commission - created -14 responsibilities - gifts, grants, or donations - reimbursement for15 expenses - definition - repeal. (2) (a) The executive director of the16 department shall appoint to the commission no more than twenty-two17 members, including:18 (XI) A representative from the Colorado youth advisory council,19 IF THE COLORADO YOUTH ADVISORY COUNCIL HAS APPOINTED MEMBERS ;20 SECTION 6. In Colorado Revised Statutes, 2-3-1503, amend21 (1)(a) as follows:22 2-3-1503. Legislative emergency preparedness, response, and23 recovery committee - creation - membership - duties - repeal.24 (1) (a) (I) There is hereby created a legislative emergency preparedness,25 response, and recovery committee. The legislative committee shall26 develop a plan for the response by, and continuation of operations of, the27 SB25-199 -6- general assembly and the legislative service agencies in the event of an1 emergency epidemic or disaster. The legislative committee shall2 cooperate and coordinate with the division, the department, and the3 GEEERC in developing the plan. The legislative committee shall develop4 and submit the plan to the speaker of the house of representatives, the5 president of the senate, the governor, the executive director of the6 department, the director of the division, and the GEEERC no later than7 July 1, 2011. The legislative committee shall meet at least annually to8 review and amend the plan as necessary and shall provide any updated9 plan to the persons or entities specified in this paragraph (a) SUBSECTION10 (1)(a)(I). The legislative committee may recommend legislation11 pertaining to the preparedness, response, and recovery by, and12 continuation of operations of, the general assembly and the legislative13 service agencies in the event of an emergency epidemic or disaster. The14 legislative committee shall provide information to and fully cooperate15 with the division, the department, and the GEEERC in fulfilling its duties16 under PURSUANT TO this section.17 (II) (A) N OTWITHSTANDING SUBSECTION (1)(a)(I) OF THIS18 SECTION, THE COMMITTEE SHALL NOT MEET OR RECOMMEND LEGISLATION19 DURING THE 2025 INTERIM.20 (B) T HIS SUBSECTION (1)(a)(II) IS REPEALED, EFFECTIVE JULY 1,21 2026.22 SECTION 7. In Colorado Revised Statutes, 2-3-1901, amend23 (2)(a); and add (2)(e)(V) as follows:24 2-3-1901. Legislative oversight committee for Colorado jail25 standards - creation - duties - repeal. (2) Duties. (a) (I) The committee26 shall meet no more than four times each year.27 SB25-199 -7- (II) (A) NOTWITHSTANDING SUBSECTION (2)(a)(I) OF THIS1 SECTION, THE COMMITTEE SHALL NOT MEET DURING THE 2025 INTERIM.2 (B) T HIS SUBSECTION (2)(a)(II) IS REPEALED, EFFECTIVE JULY 1,3 2026.4 (e) (V) (A) N OTWITHSTANDING SUBSECTION (2)(e)(I) OF THIS5 SECTION, THE COMMITTEE SHALL NOT RECOMMEND LEGISLATION DURING6 THE 2025 INTERIM.7 (B) T HIS SUBSECTION (2)(e)(V) IS REPEALED, EFFECTIVE JULY 1,8 2026.9 SECTION 8. In Colorado Revised Statutes, 10-16-221, add10 (3)(c) as follows:11 10-16-221. Statewide health care review committee - creation12 - membership - duties - repeal. (3) (c) (I) N OTWITHSTANDING13 SUBSECTION (3)(a) OF THIS SECTION, THE COMMITTEE SHALL NOT MEET OR14 TAKE FIELD TRIPS DURING THE 2025 INTERIM.15 (II) T HIS SUBSECTION (3)(c) IS REPEALED, EFFECTIVE JULY 1, 2026.16 SECTION 9. In Colorado Revised Statutes, 10-22-107, add17 (1)(c) and (5)(c) as follows:18 10-22-107. Colorado health insurance exchange oversight19 committee - creation - duties - repeal. (1) (c) (I) N OTWITHSTANDING20 SUBSECTION (1)(a) OF THIS SECTION, THE COMMITTEE SHALL NOT MEET21 DURING THE 2025 INTERIM.22 (II) T HIS SUBSECTION (1)(c) IS REPEALED, EFFECTIVE JULY 1, 2026.23 (5) (c) (I) N OTWITHSTANDING SUBSECTION (5)(a) OF THIS SECTION,24 THE COMMITTEE SHALL NOT REPORT TO THE LEGISLATIVE COUNCIL AND25 SHALL NOT RECOMMEND LEGISLATION DURING THE 2025 INTERIM.26 (II) T HIS SUBSECTION (5)(c) IS REPEALED, EFFECTIVE JULY 1, 2026.27 SB25-199 -8- SECTION 10. In Colorado Revised Statutes, 10-22.3-101,1 amend (3) as follows:2 10-22.3-101. Opioid and other substance use disorders study3 committee - creation - members - purposes - repeal. (3) (a) The4 committee may meet up to six times per interim in the 2023 and 20255 interims INTERIM. The committee may recommend up to a total of five6 bills during each interim. Legislation recommended by the committee7 must be treated as legislation recommended by an interim committee for8 purposes of applicable deadlines, bill introduction limits, and any other9 requirements imposed by the joint rules of the general assembly.10 (b) By December 1, 2023, and December 1, 2025, the committee11 shall make a report and a final report, respectively, to the legislative12 council created in section 2-3-301 that may include recommendations for13 legislation.14 SECTION 11. In Colorado Revised Statutes, 18-1.9-103, amend15 (2)(a)(II); and add (2)(a)(III) as follows:16 18-1.9-103. Legislative oversight committee concerning the17 treatment of persons with behavioral health disorders in the criminal18 and juvenile justice systems - creation - duties - repeal. (2) Duties.19 (a) (II) (A) Each committee member shall annually either attend or call20 into at least one regular task force meeting. Committee members are21 encouraged to attend separate meetings and inform the rest of the22 committee about the current work of the task force.23 (B) N OTWITHSTANDING SUBSECTION (2)(a)(II) OF THIS SECTION,24 COMMITTEE MEMBERS ARE NOT REQUIRED TO A TTEND OR CALL INTO A25 REGULAR TASK FORCE MEETING DURING THE 2025 INTERIM. THIS26 SUBSECTION (2)(a)(II)(B) IS REPEALED, EFFECTIVE JULY 1, 2026.27 SB25-199 -9- (III) (A) NOTWITHSTANDING SUBSECTION (2)(a)(I) OF THIS1 SECTION, THE COMMITTEE SHALL NOT MEET DURING THE 2025 INTERIM.2 (B) T HIS SUBSECTION (2)(a)(III) IS REPEALED, EFFECTIVE JULY 1,3 2026.4 SECTION 12. In Colorado Revised Statutes, 24-51.1-101, add5 (7) as follows:6 24-51.1-101. Pension review commission - repeal.7 (7) (a) N OTWITHSTANDING ANY PROVISION OF THIS SECTION , THE8 COMMISSION AND THE SUBCOMMITTEE SHALL NOT M EET DURING THE 20259 INTERIM AND LEGISLATIVE MEMBERS OF THE SUBCOMMITTEE ARE NOT10 REQUIRED TO ATTEND THE MEETINGS AND HEARINGS SPECIFIED IN11 SUBSECTION (5) OF THIS SECTION DURING THE 2025 INTERIM. IF A12 LEGISLATIVE MEMBER OF THE SUBCOMMITTEE ATTENDS A MEETING OR13 HEARING SPECIFIED IN SUBSECTION (5) OF THIS SECTION DURING THE 202514 INTERIM, THE LEGISLATIVE MEMBER IS NOT ENTITLED TO PER DIEM15 COMPENSATION. THE SUBCOMMITTEE IS NOT REQUIRED TO COMPLY WITH16 THE REVIEW AND REPORTING REQUIREMENTS SET FORTH IN SUBSECTION17 (4) OF THIS SECTION DURING THE 2025 INTERIM.18 (b) T HIS SUBSECTION (7) IS REPEALED, EFFECTIVE JULY 1, 2026.19 SECTION 13. In Colorado Revised Statutes, 39-21-403, amend20 (2)(a)(I), (2)(d), and (2)(e) as follows:21 39-21-403. Legislative oversight committee concerning tax22 policy - creation - duties - report -repeal. (2) Duties. (a) (I) (A) The23 committee shall meet at least four times each year and at such other times24 as it deems necessary.25 (B) N OTWITHSTANDING SUBSECTION (2)(a)(I)(A) OF THIS SECTION,26 THE COMMITTEE SHALL NOT M EET DURING THE 2025 INTERIM. THIS27 SB25-199 -10- SUBSECTION (2)(a)(I)(B) IS REPEALED, EFFECTIVE JULY 1, 2026.1 (d) (I) The committee may recommend legislative changes that are2 treated as bills recommended by an interim legislative committee for3 purposes of any introduction deadlines or bill limitations imposed by the4 joint rules of the general assembly.5 (II) (A) N OTWITHSTANDING SUBSECTION (2)(d)(I) OF THIS6 SECTION, THE COMMITTEE SHALL NOT RECOMMEND LEGISLATION DURING7 THE 2025 INTERIM.8 (B) T HIS SUBSECTION (2)(d)(II) IS REPEALED, EFFECTIVE JULY 1,9 2026.10 (e) (I) On or before January 1 of each year, the committee shall11 submit, and make publicly available on its website, a report to the general12 assembly. The annual report must briefly summarize the study issues,13 recommendations considered, and any actions taken by the committee and14 the task force during the previous year. The report must comply with the15 provisions of section 24-1-136 (9). Notwithstanding section 24-1-13616 (11)(a)(I), the requirement in this section to report to the general assembly17 continues indefinitely.18 (II) (A) T HE COMMITTEE SHALL NOT SUBMIT A REPORT ON OR19 BEFORE JANUARY 1, 2026.20 (B) T HIS SUBSECTION (2)(e)(II) IS REPEALED EFFECTIVE, JULY 1,21 2026.22 SECTION 14. In Colorado Revised Statutes, 39-26-802, amend23 (3) and (5) as follows:24 39-26-802. Sales and use tax simplification task force -25 creation - definitions - repeal. (3) (a) Starting in 2021, the task force26 shall meet at least eight times, with the first meeting occurring no later27 SB25-199 -11- than July 16, 2021. Task force meetings shall be open to the public, and1 the task force shall solicit the testimony of the members of the public.2 (b) (I) N OTWITHSTANDING SUBSECTION (3)(a) OF THIS SECTION,3 THE TASK FORCE SHALL NOT MEET DURING THE 2025 INTERIM.4 (II) T HIS SUBSECTION (3)(b) IS REPEALED, EFFECTIVE JULY 1, 2026.5 (5) (a) No later than November 1, 2021, and no later than each6 November 1 thereafter, the task force shall make a report to the legislative7 council created in section 2-3-301 that may or may not include8 recommendations for legislation.9 (b) (I) N OTWITHSTANDING SUBSECTION (5)(a) OF THIS SECTION,10 THE TASK FORCE SHALL NOT MAKE A REPORT FOR THE 2025 INTERIM.11 (II) T HIS SUBSECTION (5)(b) IS REPEALED, EFFECTIVE JULY 1, 2026.12 SECTION 15. Safety clause. The general assembly finds,13 determines, and declares that this act is necessary for the immediate14 preservation of the public peace, health, or safety or for appropriations for15 the support and maintenance of the departments of the state and state16 institutions.17 SB25-199 -12-
