Sterling correctional facility access controls project. The bill limits the
use of the Centennial correctional facility-south c-tower to only after the
department of corrections determines that there are no suitable beds
available to house an inmate in another department facility.
The bill appropriates $1,829,000 from the general fund to the
department of corrections to implement the bill.
Be it enacted by the General Assembly of the State of Colorado:1
SECTION 1.  Legislative declaration. The general assembly2
finds that the temporary use of c-tower at Centennial correctional3
facility-south is necessary to accommodate the impact of the access4
controls capital renewal project at the Sterling correctional facility. It is5
the general assembly's intent that major accommodations of this kind be6
considered by the capital development committee in the future.7
SECTION 2. In Colorado Revised Statutes, 17-1-104.3, add8
(1)(b.6) as follows:9
17-1-104.3.  Correctional facilities - locations - security level -10
report - repeal. (1) (b.6) (I)  N
OTWITHSTANDING ANY OTHER PROVISION11
OF LAW TO THE CONTRARY , THE CENTENNIAL CORRECTIONAL12
FACILITY-SOUTH C-TOWER MAY BE USED TO TEMPORARILY HOUSE13
PROTECTIVE-, CLOSE-, AND MEDIUM-CUSTODY INMATES FOR THE STERLING14
CORRECTIONAL FACILITY ACCESS CONTROLS PROJECT , FOR THE DURATION15
OF THAT PROJECT, AND FOR THE TIME REQUIRED TO TEMPORARILY16
RELOCATE THE INMATES AND THEN RETURN THEM TO THE STERLING17
CORRECTIONAL FACILITY. TO THE EXTENT FEASIBLE, THE DEPARTMENT18
SHALL HOUSE AN INMATE FROM THE STERLING CORRECTIONAL FACILITY19
IN THE CENTENNIAL CORRECTIONAL FACILITY -SOUTH C-TOWER ONLY20
AFTER DETERMINING THAT THERE ARE NO SUITABLE BEDS AVAILABLE21
THAT WOULD NOT REQUIRE ADDITIONAL APPROPRIATIONS TO HOUSE THAT22

CORRECTIONS.2

HE DEPARTMENT SHALL, AT LEAST THIRTY DAYS PRIOR TO

RELOCATING ANY INMATES PURSUANT TO SUBSECTION (1)(b.6)(I) OF THIS4
SECTION, PROVIDE A STRUCTURED RELOCATION PLAN TO THE JOINT5
BUDGET COMMITTEE AND THE HOUSE OF REPRESENTATIVES JUDICIARY6
COMMITTEE AND THE SENATE JUDICIARY COMMITTEE , OR THEIR7
SUCCESSOR COMMITTEES, AND SHALL UPDATE THOSE COMMITTEES DURING8
THE PROJECT. THE PLAN MUST INCLUDE, BUT IS NOT LIMITED TO:9
(A)  W
HAT SPECIFIC EDUCATIONAL , REHABILITATIVE, AND
10
VOCATIONAL PROGRAMS OR CLASSES WILL BE AVAILABLE TO THE11
INMATES, INCLUDING THE TYPE OF PROGRAMS, THE NUMBER OF INMATES12
THAT CAN BE ENROLLED IN EACH PROGRAM , THE LENGTH OF EACH13
PROGRAM, AND THE LOCATION WHERE EACH PROGRAM WILL BE14
DELIVERED;15

HAT BEHAVIORAL HEALTH AND MEDICAL CARE WILL BE

AVAILABLE;17

HAT EMPLOYMENT OPPORTUNITIES WILL BE AVAILABLE AND

CONTROLS PROJECT AT THE STERLING CORRECTIONAL FACILITY.10

HE DEPARTMENT SHALL PROVIDE UPDATES ON THE STATUS

OF THE ACCESS CONTROLS PROJECT AT ITS "SMART ACT" HEARING12
REQUIRED BY SECTION 2-7-203.13
(IV) THIS SUBSECTION (1)(b.6) IS REPEALED, EFFECTIVE JUNE 30,14
2027.15
SECTION 3. Appropriation. For the 2025-26 state fiscal year,16
$1,829,000 is appropriated to the department of corrections for use by17
institutions. This appropriation is from the general fund. To implement18
this act, the institutions may use this appropriation for Centennial19
correctional facility-south c-tower start-up costs related to the20
superintendents subprogram.21
SECTION 4. Safety clause. The general assembly finds,22
determines, and declares that this act is necessary for the immediate23
preservation of the public peace, health, or safety or for appropriations for24
the support and maintenance of the departments of the state and state25
institutions.26
