Joint Budget Committee. The bill repeals proficiency tests
administered by school districts. The bill reduces the cash fund
appropriation to the department of education for use by career pathways
for basic skills placement or assessment tests by $50,000.

SECTION 1. In Colorado Revised Statutes, repeal 22-32-109.5.2
SECTION 2. In Colorado Revised Statutes, 22-2-112, amend3
(4)(a) as follows:4
22-2-112.  Commissioner - duties - report - legislative5
declaration. (4) (a)  The commissioner shall ensure that the department,6
subject to available appropriations, annually allocates money to school7
districts, district charter schools and institute charter schools to reimburse8
them for the costs of administering developmental education placement9
or assessment tests pursuant to sections 22-32-109.5, SECTIONS10
22-30.5-117 and 22-30.5-526 respectively, to students enrolled in grades11
nine through twelve. The department shall allocate money to offset the12
costs incurred in administering each of the test units only once per student13
while the student is enrolled in grades nine through twelve.14
SECTION 3. In Colorado Revised Statutes, 22-2-136, amend15
(2)(a)(III) as follows:16
22-2-136.  Additional duty - state board - individual career and17
academic plans - standards - rules. (2)  In establishing the standards for18
individual career and academic plans, the state board shall ensure, at a19
minimum, that:20
(a)  Each individual career and academic plan includes a career21
planning and guidance component and a portfolio that reflects, at a22
minimum:23
(III)  For school districts and DISTRICT charter schools AND24
INSTITUTE CHARTER SCHOOLS that choose to administer the developmental25
education placement or assessment tests, the student's scores on the26

pursuant to section 22-30.5-117 
OR 22-30.5-526, or 22-32-109.5 (4),

intervention plan created for the student pursuant to those sections, and3
the student's progress in meeting the intervention plan;4
SECTION 4. Appropriation - adjustments to 2025 long bill. To5
implement this act, the cash funds appropriation from the state education6
fund created in section 17 (4)(a) of article IX of the state constitution7
made in the annual general appropriation act for the 2025-26 state fiscal8
year to the department of education for use by career pathways for basic9
skills placement or assessment tests is decreased by $50,000.10
SECTION 5. Safety clause. The general assembly finds,11
determines, and declares that this act is necessary for the immediate12
preservation of the public peace, health, or safety or for appropriations for13
the support and maintenance of the departments of the state and state14
institutions.15
