Joint Budget Committee. Beginning with the 2025-26 budget
year, and each budget year thereafter, the state charter school institute
(institute) shall not distribute a portion of its appropriated mill levy

the institute.
Beginning in the 2024-25 budget year, if the institute receives
additional mill levy revenue from a school district for an institute charter
school within the geographic boundary of the school district, the general
assembly shall deduct the additional mill levy revenue from the amount
necessary to fully fund mill levy equalization.
The bill decreases an appropriation from the state education fund
to the department of education for use by the institute for mill levy
equalization.
Be it enacted by the General Assembly of the State of Colorado:1
SECTION 1. In Colorado Revised Statutes, 22-30.5-513.1,2
amend (2)(b); and add (2)(c) and (2)(d) as follows:3
22-30.5-513.1.  Mill levy equalization - legislative declaration4
- definitions. (2) (b)  S
UBJECT TO ANNUAL APPROPRIATION , the institute5
shall annually distribute the money appropriated for full mill levy6
equalization pursuant to subsection (2)(a.5)(I) of this section to the7
institute charter schools on an equal per-pupil basis, 
EXCLUDING PUPILS8
ENROLLED IN MULTI-DISTRICT ONLINE SCHOOLS, AS DEFINED IN SECTION9
22-30.7-102,
 THAT ARE AUTHORIZED BY THE INSTITUTE ; except that, in10
any budget year, an institute charter school must not receive a per pupil11
amount that is greater than the total amount of additional mill levy12
revenue, as defined in section 22-32-108.5, that the accounting district for13
the institute charter school is authorized to collect, divided by the funded14
pupil count, as determined pursuant to article 54 of this title 22, of the15
accounting district for the applicable budget year. The money distributed16
pursuant to this section is in addition to money distributed to institute17
charter schools pursuant to section 22-30.5-513.18

OTWITHSTANDING ANY PROVISION OF THIS SECTION TO THE19
CONTRARY, BEGINNING WITH THE 2025-26 BUDGET YEAR, AND EACH20
SB25-223-2- BUDGET YEAR THEREAFTER , THE INSTITUTE SHALL NOT DISTRIBUTE A1
PORTION OF THE FUNDS APPROPRIATED PURSUANT TO THIS SECTION TO A2
MULTI-DISTRICT ONLINE SCHOOL, AS DEFINED IN SECTION 22-30.7-102,3
THAT IS AUTHORIZED BY THE INSTITUTE.4

EGINNING IN THE 2024-25 BUDGET YEAR, IF AN INSTITUTE5
CHARTER SCHOOL WITHIN THE GEOGRAPHIC BOUNDARY OF A SCHOOL6
DISTRICT RECEIVES ADDITIONAL MILL LEVY REVENUE FROM THE SCHOOL7
DISTRICT, THE GENERAL ASSEMBLY SHALL DEDUCT THE ADDITIONAL MILL8
LEVY REVENUE FROM THE AMOUNT NECESSARY TO FULLY F UND MILL LEVY9
EQUALIZATION.10
SECTION 2. Appropriation - adjustments to 2025 long bill. To11
implement this act, the cash funds appropriation from the state education12
fund created in section 17 (4)(a) of article IX of the state constitution13
made in the annual general appropriation act for the 2025-26 state fiscal14
year to the department of education for use by the charter school institute15
for CSI mill levy equalization is decreased by $1,008,494.16
SECTION 3. Safety clause. The general assembly finds,17
determines, and declares that this act is necessary for the immediate18
preservation of the public peace, health, or safety or for appropriations for19
the support and maintenance of the departments of the state and state20
institutions.21
