Joint Budget Committee. The bill requires 75% of the money collected from a bond forfeiture judgment against an individual to be deposited in the judicial collection enhancement fund. The bill requires all the money collected from a bail forfeiture judgment against an appearance bond written by a compensated surety to be deposited in the judicial collection enhancement fund. In Colorado Revised Statutes, 16-4-111, add (8) as2 follows:3 16-4-111. Disposition of security deposits upon forfeiture or4 termination of bond. (8) B EGINNING JULY 1, 2025, THE JUDICIAL5 DEPARTMENT SHALL TRANSFER SEVENTY -FIVE PERCENT OF THE MONEY6 COLLECTED PURSUANT TO THIS SECTION FROM A BOND FORFEITURE7 JUDGMENT TO THE STATE TREASURER FOR DEPOSIT IN THE JUDICIAL8 COLLECTION ENHANCEMENT FUND CREATED IN SECTION 16-11-101.6 (2).9 SECTION 2. In Colorado Revised Statutes, 16-4-114, add (7) as10 follows:11 16-4-114. Enforcement procedures for compensated sureties12 - definitions. (7) B EGINNING JULY 1, 2025, THE JUDICIAL DEPARTMENT13 SHALL TRANSFER THE MONEY COLLECTED PURSUANT TO THIS SECTION14 FROM A BAIL FORFEITURE JUDGMENT INVOLVING AN APPEARANCE BOND15 DESCRIBED IN THIS SECTION TO THE STATE TREASURER FOR DEPOSIT IN THE16 JUDICIAL COLLECTION ENHANCEMENT FUND CREATED IN SECTION17 16-11-101.6 (2).18 SECTION 3. In Colorado Revised Statutes, 16-11-101.6, amend19 (2) as follows:20 16-11-101.6. Collection of fines and fees - methods - charges21 - judicial collection enhancement fund - creation - definition. (2) T HE22 JUDICIAL COLLECTION ENHANCEMENT FUND IS CREATED IN THE STATE23 TREASURY. All time payment fees and late penalty fees collected shall be24 credited to the judicial collection enhancement fund. which fund is hereby 25 created in the state treasury. In addition, reasonable costs incurred and26 241-2- collected by the state shall be credited to the fund. THE FUND ALSO1 CONSISTS OF THE MONEY CREDITED TO THE FUND PURSUANT TO SECTIONS2 16-4-111 AND 16-4-114. The general assembly shall make annual3 appropriations from the fund to the judicial department for administrative4 and personnel costs incurred in collecting restitution, fines, costs, fees,5 and other monetary assessments. At the end of any fiscal year, all6 unexpended and unencumbered moneys MONEY and any interest shall7 remain REMAINS in the fund for appropriation to the judicial department8 for ongoing enforcement and collection of restitution, fines, fees, costs,9 surcharges, and other monetary assessments.10 SECTION 4. Safety clause. The general assembly finds,11 determines, and declares that this act is necessary for the immediate12 preservation of the public peace, health, or safety or for appropriations for13 the support and maintenance of the departments of the state and state14 institutions.15 241 -3-
