September 1, 2025, to September 1, 2030, for statutes authorizing the transfer of spending authority between line items in specified circumstances and allowing overexpenditures in excess of the amount authorized by an item of appropriation in specified circumstances. The bill also clarifies which transfers between appropriations are for like purposes in the statute allowing for intradepartmental transfers and specifies that transfers between any line items of appropriation in the department of corrections that are not explicitly authorized in a footnote to the annual general appropriation act are not for like purposes. Be it enacted by the General Assembly of the State of Colorado:1 SECTION 1. In Colorado Revised Statutes, 24-75-105, amend2 (2) as follows:3 24-75-105. Transfers required to implement conditional and4 centralized appropriations - repeal. (2) This section is repealed,5 effective September 1, 2025 SEPTEMBER 1, 2030.6 SECTION 2. In Colorado Revised Statutes, 24-75-106, amend7 (2) as follows:8 24-75-106. Transfers between departments of health care9 policy and financing and human services for materially similar items10 of appropriation for medicaid programs - limitation - repeal. (2) This11 section is repealed, effective September 1, 2025 SEPTEMBER 1, 2030.12 SECTION 3. In Colorado Revised Statutes, 24-75-106.5, amend13 (5) as follows:14 24-75-106.5. Transfers between departments of health care15 policy and financing and human services for corresponding items of16 appropriation - limitations - repeal. (5) This section is repealed,17 effective September 1, 2025 SEPTEMBER 1, 2030.18 SECTION 4. In Colorado Revised Statutes, 24-75-107, amend19 (2) as follows:20 SB25-263-2- 24-75-107. Cash fund transfers pursuant to sections 24-75-1051 and 24-75-106 - repeal. (2) This section is repealed, effective September2 1, 2025 SEPTEMBER 1, 2030.3 SECTION 5. In Colorado Revised Statutes, 24-75-108, amend4 (1), (2) introductory portion, and (11); and add (2)(h) as follows:5 24-75-108. Intradepartmental transfers between6 appropriations - definition - repeal. (1) Upon approval by the7 governor, the head of a principal department of state government may, on8 or after May 1 of any fiscal year and before the forty-fifth day after the9 close of such fiscal year, transfer moneys MONEY from one item of10 appropriation made to the principal department in the general11 appropriation act to another item of appropriation made to the same12 principal department in said act; except that such transfers shall MUST be13 made only between appropriations for like purposes. A TRANSFER IS14 BETWEEN APPROPRIATIONS FOR LIKE PURPOSES WHEN BOTH LINE ITEMS OF15 APPROPRIATION ARE FOR THE SAME SPECIFIED PURPOSE , AS THOSE16 PURPOSES ARE DEFINED IN SECTION 24-75-112. All transfers made17 pursuant to this section shall be ARE between appropriations made for the18 expiring fiscal year.19 (2) None of the following transfers shall be ARE deemed to be20 between like purposes within the meaning of subsection (1) of this21 section:22 (h) T RANSFERS BETWEEN ANY LINE ITEMS OF APPROPRIATION IN23 THE DEPARTMENT OF CORRECTIONS THAT ARE NOT EXPLICITLY24 AUTHORIZED IN A FOOTNOTE TO THE ANNUAL GENERAL APPROPRIATION25 ACT.26 (11) This section is repealed, effective September 1, 2025 27 SB25-263 -3- SEPTEMBER 1, 2030.1 SECTION 6. In Colorado Revised Statutes, 24-75-109, amend2 (6) as follows:3 24-75-109. Controller may allow expenditures in excess of4 appropriations - limitations - appropriations for subsequent fiscal5 year restricted - repeal. (6) The controller may allow overexpenditures6 pursuant to this section only for the fiscal years beginning on or after July7 1, 1998, but prior to July 1, 2025 JULY 1, 2030. This section is repealed,8 effective September 1, 2025 SEPTEMBER 1, 2030.9 SECTION 7. In Colorado Revised Statutes, 24-75-110, amend10 (2) as follows:11 24-75-110. Limitation on judicial department - repeal. (2) This12 section is repealed, effective September 1, 2025 SEPTEMBER 1, 2030.13 SECTION 8. Safety clause. The general assembly finds,14 determines, and declares that this act is necessary for the immediate15 preservation of the public peace, health, or safety or for appropriations for16 the support and maintenance of the departments of the state and state17 institutions.18 SB25-263 -4-
