AN ACT AUTHORIZING REVIEW OF THE DEPARTMENT OF ENVIRONMENTAL PROTECTION'S GUIDANCE STATEMENTS AND POLICIES BY THE GENERAL ASSEMBLY'S REGULATION REVIEW COMMITTEE.

Be it enacted by the Senate and House of Representatives in General Assembly convened:

Section 1. Section 4-170 of the 2010 supplement to the general statutes is amended by adding subsection (g) as follows (Effective October 1, 2010):

(NEW) (g) The committee may receive any petition, signed by no fewer than twenty-five persons, that claims a guidance statement or policy of the Department of Environmental Protection, when applied to each signer of such petition, constitutes a regulation, as defined in section 4-166. Not later than ninety days after receipt of any such petition, the committee may hold a public hearing to review such guidance statement or policy of the department and determine whether such guidance statement or policy constitutes a regulation, as defined in section 4-166. Following any such public hearing, the committee shall inform the Commissioner of Environmental Protection of its determination and make any recommendation to the commissioner that is consistent with such determination.

Statement of Purpose: 

To provide the regulated community with an opportunity to have the guidance statements and policies of the Department of Environmental Protection reviewed by the Regulation Review Committee of the General Assembly.
