AN ACT CONCERNING NOTIFICATION OF FINANCIAL STABILITY OF NURSING HOME FACILITIES AND MANAGED RESIDENTIAL COMMUNITIES TO PATIENTS AND RESIDENTS.

Be it enacted by the Senate and House of Representatives in General Assembly convened:

Section 1. (NEW) (Effective October 1, 2010) Each nursing home facility, as defined in section 19a-521 of the general statutes, shall notify each person seeking admission as a patient or admitted as a patient to the nursing home facility, prior to or at the time of admission and during the patient's stay, if the nursing home facility (1) is placed in receivership pursuant to sections 19a-541 to 19a-549, inclusive, of the general statutes; (2) is in bankruptcy; or (3) has filed a certificate of need pursuant to section 17b-352 of the general statutes.

Sec. 2. (NEW) (Effective October 1, 2010) Each managed residential community, as defined in section 19a-693 of the general statutes, shall notify each person seeking residency in the managed residential community or each resident of the managed residential community, prior to or at the time of admission and during the resident's stay, if the managed residential community is in bankruptcy.

Statement of Purpose: 

To provide consumers with full disclosure of the current financial status of the nursing home facility or managed residential community so that consumers can make an informed decision about admission.
