AN ACT CONCERNING THE OPERATION OF BLOOD DRIVES.

Be it enacted by the Senate and House of Representatives in General Assembly convened:

Section 1. (NEW) (Effective October 1, 2011) (a) As used in this section:

(1) "AABB" means the not-for-profit association formerly known as the American Association of Blood Banks; and 

(2) "Blood collection technician" means a person who is trained in accordance with AABB professional standards and who meets all AABB professional competency requirements. 

(b) Any entity that conducts a blood drive in this state shall ensure that: (1) Only a blood collection technician, trained in procedures that comply with federal Food and Drug Administration guidelines and regulations, including, but not limited to, 21 CFR 606, may operate blood collection equipment or apheresis blood component collection equipment, including the administration of saline, citrate and other biologics required in the operation of such equipment; (2) a blood collection technician designated as the supervisor of any blood drive where apheresis collections occur shall be trained in apheresis collection procedures in accordance with all applicable federal Food and Drug Administration and AABB standards; and (3) a practical nurse or a registered nurse, licensed in accordance with the provisions of chapter 378 of the general statutes, is on-site at the location where such blood drive occurs for the entire duration of the blood drive.

Sec. 2. (NEW) (Effective October 1, 2011) No entity that conducts a blood drive in this state shall offer any employee any form of financial payment or incentive that is based on the employee's ability to attract individuals who agree to make a voluntary blood donation at a blood drive conducted by such entity. For purposes of this section, "employee" means any person engaged in service to an entity conducting a blood drive.

To enact professional standards concerning the operation of blood drives in the state.
