AN ACT CONCERNING RENEWABLE RESOURCE GENERATION.

Be it enacted by the Senate and House of Representatives in General Assembly convened:

Section 1. (NEW) (Effective July 1, 2011) Notwithstanding any provision of the general statutes, an electric distribution company may construct, purchase, own or operate a generation facility for Class I or Class II renewable energy sources, as defined in section 16-1 of the general statutes for the purpose of meeting state or federal renewable resource portfolio standards, provided the capacity of such facilities does not exceed five megawatts for each company. An electric distribution company constructing or purchasing such generation facility shall recover the costs of such investment and operation, including a return on investment, in a nonbypassable charge as determined by the Department of Public Utility Control in an annual proceeding held pursuant to sections 16-19, 16-19b and 16-19e of the general statutes.
