AN ACT CONCERNING FRIVOLOUS APPEALS OF ZONING BOARD DECISIONS.

Be it enacted by the Senate and House of Representatives in General Assembly convened:

That the general statutes be amended to provide that any frivolous appeal of a zoning board decision filed with the intent of delaying the implementation of a zoning change or decision shall constitute bad faith and shall be subject to double or treble damage claims by the municipality against the appellant.

Statement of Purpose: 

To provide that appellants who file frivolous appeals of zoning board decisions with the intent of delaying implementation of a zoning change or decision shall be subject to claims for double or treble damages.
