Be it enacted by the Senate and House of Representatives in General Assembly convened: Section 1. (NEW) (Effective October 1, 2011) (a) For the purposes of this section, "law enforcement agency" means the Division of State Police within the Department of Public Safety or any municipal police department. (b) Upon receipt of a report of a missing person, the law enforcement agency receiving said report may, pursuant to a voluntary program between broadcasters and law enforcement agencies, request the broadcast or dissemination of an emergency alert and information provided by a law enforcement agency concerning the abduction of a child, including, but not limited to, a description of the abducted child, a description of the suspected abductor and the circumstances of the abduction, if the following conditions are met: (1) The missing person is under sixteen years of age, but, if such person is over sixteen years of age, the law enforcement agency may, in its discretion, request such broadcast or dissemination; (2) The missing person is in danger of serious bodily harm or death; and (3) The law enforcement agency has enough information about the physical characteristics of the missing person so that such broadcast or dissemination could be effective. (c) Notwithstanding subsection (b) of this section, no law enforcement agency may request such broadcast or dissemination in the case of a familial custody dispute or if the person has been abandoned, as defined by section 46b-115a of the general statutes. (d) No law enforcement agency shall refuse to request such broadcast or dissemination for a person satisfying subsections (b) and (c) of this section because such person is a runaway.
