AN ACT CONCERNING THE AVAILABILITY OF AUTOMATIC EXTERNAL DEFIBRILLATORS IN CERTAIN HEALTH CARE SETTINGS.

Be it enacted by the Senate and House of Representatives in General Assembly convened:

Section 1. (NEW) (Effective October 1, 2011) (a) Each dialysis unit, outpatient surgical facility and residential care home seeking to be licensed or relicensed by the Department of Public Health shall, as a condition of obtaining licensure, demonstrate to the satisfaction of the department that such facility maintains not less than one automatic external defibrillator in a readily accessible, central location within the facility.

(b) Each dialysis unit, outpatient surgical facility and residential care home seeking to be licensed or relicensed by the Department of Public Health shall, as a condition of obtaining licensure, demonstrate to the satisfaction of the department that such facility employs personnel trained in the operation of an automatic external defibrillator and the use of cardiopulmonary resuscitation at all times while the facility is providing services to patients or residents, as the case may be.

(c) Not later than July 1, 2012, each dialysis unit, outpatient surgical facility and residential care home licensed by the Department of Public Health shall develop an emergency action response plan that addresses the appropriate use of facility personnel to respond to incidents involving an individual experiencing sudden cardiac arrest or a similar life-threatening emergency while on facility grounds. Such emergency action response plan shall be made available to the department, upon request.

(d) The Commissioner of Public Health may adopt regulations, in accordance with the provisions of chapter 54 of the general statutes, to carry out the provisions of this section.

Sec. 2. (NEW) (Effective October 1, 2011) (a) Each assisted living services agency, as defined in section 19a-490 of the general statutes, seeking to be licensed or relicensed by the Department of Public Health shall, as a condition of obtaining licensure, demonstrate to the satisfaction of the department that such agency maintains a sufficient number of automatic external defibrillators, taking into consideration the number of locations and persons served by such agency.

(b) Each assisted living services agency seeking to be licensed or relicensed by the Department of Public Health shall, as a condition of obtaining licensure, demonstrate to the satisfaction of the department that such agency employs a sufficient number of personnel trained in the operation of an automatic external defibrillator and the use of cardiopulmonary resuscitation at all times while such agency is providing assisted living services on behalf of clients. The number of personnel trained in the operation of an automatic external defibrillator and the use of cardiopulmonary resuscitation shall take into consideration the number of locations and persons served by such agency.

(c) Not later than July 1, 2012, each assisted living services agency licensed by the Department of Public Health shall develop an emergency action response plan that addresses the appropriate use of agency personnel to respond to incidents involving an individual experiencing sudden cardiac arrest or a similar life-threatening emergency while receiving assisted living services. Such emergency action response plan shall be made available to the department, upon request.

(d) The Commissioner of Public Health may adopt regulations, in accordance with the provisions of chapter 54 of the general statutes, to carry out the provisions of this section.

Statement of Purpose: 

To require the presence of automated external defibrillators in health care settings where instances of sudden cardiac arrest are most likely to occur.
