Be it enacted by the Senate and House of Representatives in General Assembly convened: Section 1. (Effective July 1, 2011) The Joint Enforcement Commission on Employee Misclassification established pursuant to section 31-57h of the general statutes shall study employee misclassification in the homemaker-companion agency industry in order to evaluate whether (1) homemaker-companion agencies that operate as registries or provide referral services should classify persons providing home health care services through such agencies as employees, and (2) such agencies should be subject to unemployment tax. The commission shall submit, in accordance with section 11-4a of the general statutes, findings and recommendations to the joint standing committees of the General Assembly having cognizance of matters relating to aging and public health not later than January 1, 2012.
