AN ACT CONCERNING MISCLASSIFICATION IN THE HOMEMAKER-COMPANION AGENCY INDUSTRY. 

Be it enacted by the Senate and House of Representatives in General Assembly convened:

Section 1. (Effective from passage) The Joint Enforcement Commission on Employee Misclassification established pursuant to section 31-57h of the general statutes shall study employee misclassification in the homemaker-companion agency industry. Such study shall include, but not be limited to, evaluating whether (1) homemaker-companion agencies that operate as registries or provide referral services should classify persons providing homemaker services through such agencies as employees of the agency, (2) such agencies should be subject to unemployment tax for such persons, and (3) such agencies should be required to have workers' compensation coverage for such persons. The commission shall submit, in accordance with section 11-4a of the general statutes, findings and recommendations to the joint standing committees of the General Assembly having cognizance of matters relating to aging and public health not later than January 1, 2012.
