AN ACT CONCERNING A REGULATORY FAIRNESS BOARD.

Be it enacted by the Senate and House of Representatives in General Assembly convened:

Section 1. (NEW) (Effective from passage) (a) There is established within the Department of Economic and Community Development a Regulatory Fairness Board which shall advise the Commissioner of Economic and Community Development on matters of concern to small businesses relating to the enforcement activities and regulations of state agencies. Said board shall solicit input from the state's business community with regard to potential regulatory reform. Said board shall consist of no less than six nor more than eleven members appointed by the commissioner from a list of nominees submitted by the joint standing committee of the General Assembly having cognizance of matters relating to commerce. The joint standing committee of the General Assembly having cognizance of matters relating to commerce shall submit nominees representing the state's small business community and shall submit nominees from various types of business. Said committee shall submit nominees not later than ninety days after the effective date of this section.

(b) Initially, three members shall be appointed for a two-year term, three members for a three-year term and the remainder of the members for a four-year term. Appointments thereafter shall be for four-year terms. Any vacancy shall be filled by the commissioner for the unexpired portion of a term. The commissioner shall designate the chairperson of the board.

(c) Board members shall serve without compensation but shall be reimbursed for necessary expenses or services incurred in performing their duties, including the giving of testimony at any administrative hearing when requested by the commissioner. 

(d) The board shall meet at the call of the commissioner at least four times a year. 

(e) On or before January 1, 2013, and annually thereafter, the board shall report, in accordance with the provisions of section 11-4a of the general statutes, to the joint standing committee of the General Assembly having cognizance of matters relating to commerce regarding the board's suggestions for regulatory reform.
