AN ACT REQUIRING THE COMMISSIONER OF TRANSPORTATION TO WAIVE CERTAIN INSURANCE REQUIREMENTS TO ALLOW THE FAIRMONT NEIGHBORHOOD ASSOCIATION TO ADOPT A TRAFFIC ISLAND.

Be it enacted by the Senate and House of Representatives in General Assembly convened:

Section 1. (Effective from passage) The Commissioner of Transportation shall waive any insurance required by said commissioner as a condition of issuing a permit to allow the Fairmont Neighborhood Association to engage in beautification efforts on a traffic island located at the intersection of Huntington Avenue and Middlesex Street in the city of Waterbury as part of said city's Adopt-a-Spot program. Notwithstanding the provisions of section 13a-144 of the general statutes or any other provision of the general statutes, no person injured in person or property while engaging in such beautification efforts on such traffic island may bring a civil action to recover damages against said commissioner or the state.

Statement of Purpose: 

To waive certain insurance requirements in order to allow the Fairmont Neighborhood Association to participate in a beautification program, and to hold the Commissioner of Transportation and the state harmless in the event anyone is injured while participating in such program.
