AN ACT CONCERNING NOTICE TO APPEAR AND COMPLAINT.

Be it enacted by the Senate and House of Representatives in General Assembly convened:

That the general statutes be amended to provide that in any case in which a person with a proper identification is suspected of committing an infraction, violation or misdemeanor by any state or local peace officer, such officer shall release such person and issue a promise to appear in court containing the name and address of such person, the charge, and the time and place where and when such person shall appear in court, rather than take such person to process at the police department or other official office, provided, if such person thereafter fails to appear in court, the court shall issue a warrant of arrest on such failure to appear.

Statement of Purpose: 

To eliminate the requirement that a peace officer take a suspect into custody for processing when such suspect has proper identification and is accused only of a misdemeanor, violation or infraction.
