AN ACT CONCERNING THE COMMUNITY SPOUSE OF AN INSTITUTIONALIZED PERSON.

Be it enacted by the Senate and House of Representatives in General Assembly convened:

That chapter 319v of the general statutes be amended to require the Commissioner of Social Services to amend the Medicaid state plan so that the community spouse of an institutionalized person receives the maximum community spouse protected amount, as determined pursuant to 42 USC 1396r-5, for a period of five years after the institutionalized person applies for Medicaid. 

Statement of Purpose: 

To allow the spouse of an institutionalized person to retain the maximum income allowable under federal law for five years after the institutionalized person applies for Medicaid.
