AN ACT MAXIMIZING JOBS FOR STATE WORKERS BY REQUIRING PLANS OF LOCAL HIRING BY CONSTRUCTION COMPANIES.

Be it enacted by the Senate and House of Representatives in General Assembly convened:

Section 1. (NEW) (Effective October 1, 2013) (a) Notwithstanding any provision of the general statutes, on and after October 1, 2014, no business shall be eligible to bid on a contract or perform work pursuant to a subcontract for the construction, reconstruction, alteration, remodeling, repair or demolition of any public building or any other public work by the state unless the business has, within the preceding twelve months, filed a plan of local construction hiring with the Labor Department and the Department of Economic and Community Development.

(b) The plan of local construction hiring filed by a business shall include:

(1) The number of Connecticut residents employed by the business and the percentage of the business's workforce that is composed of Connecticut residents;

(2) (A) A description of efforts undertaken by the business to encourage subcontractors, if any, contracted by the business to hire Connecticut residents, and (B) the number of Connecticut residents employed by any such subcontractor, if available;

(3) (A) Letters of partnership between the business and (i) the state Jobs Funnel program, (ii) the Office of Apprenticeship Training, and (iii) one or more of the regional community-technical colleges or regional vocational-technical schools in which the business commits to work with such program and entities to hire Connecticut residents, and (B) the number of Connecticut residents hired by the business in connection with such program and entities;

(4) The average wages and benefits paid to construction workers employed by the business on projects funded in whole or in part by state funds, including the wage and benefit information for the employees of any subcontractor contracted by the business, if available; and

(5) Any other information required by the Labor Department and the Department of Economic and Community Development.

(c) Not later than February first, annually, the Department of Economic and Community Development and the Labor Department shall submit a report to the Governor, the General Assembly and the joint standing committees of the General Assembly having cognizance of matters relating to commerce and labor, in accordance with the provisions of section 11-4a of the general statutes. Such report shall summarize the plans of local construction hiring filed with said departments in the previous calendar year pursuant to subsection (a) of this section, and shall include, but not be limited to:

(1) A list of the businesses that filed a plan of local construction hiring;

(2) The number of Connecticut residents employed by each such business and their subcontractors, and in the aggregate;

(3) The increase or decrease in the number of Connecticut residents employed by each such business and subcontractor, and in the aggregate, since the preceding year's report;

(4) The number of workers hired by each such business in connection with the state Job Funnel program, the Office of Apprenticeship Training, the regional community-technical colleges and the regional vocational-technical schools;

(5) The average wage and benefits paid to construction workers, on projects funded in whole or in part by state funds, employed by each such business and subcontractor, and in the aggregate; and

(6) Any suggested corrective actions to be taken against businesses that do not exhibit a commitment to hiring Connecticut residents.

To require any business seeking to bid on a contract or perform work on any public work by the state to file an annual local construction hiring plan.
