AN ACT CONCERNING THE RECOUPMENT OF NONECONOMIC DAMAGES BY AN ILLEGALLY UNINSURED MOTORIST.

Be it enacted by the Senate and House of Representatives in General Assembly convened:

Section 1. Section 52-572h of the general statutes is amended by adding subsection (p) as follows (Effective October 1, 2015, and applicable to actions filed on or after said date):

(NEW) (p) In any action filed on or after October 1, 2015, to recover damages resulting from personal injury or wrongful death, whether in tort or in contract, in which it is alleged such injury or death resulted from a motor vehicle accident, no owner-operator of a motor vehicle involved in the accident who fails to provide proof that such owner-operator was in compliance with the security requirements of section 38a-371 when the accident occurred may recover noneconomic damages.

 


This act shall take effect as follows and shall amend the following sections:
Section 1 October 1, 2015, and applicable to actions filed on or after said date 52-572h

Statement of Purpose: 

To prohibit certain claimants from recovering noneconomic damages in an action resulting from personal injury or wrongful death in which it is alleged such injury or death resulted from a motor vehicle accident.
