Be it enacted by the Senate and House of Representatives in General Assembly convened: Section 1. (NEW) (Effective January 1, 2016) (a) For the purposes of this section: (1) "Microbead" means any plastic component of a personal cosmetic product measured to be five millimeters or less in size; and (2) "Personal cosmetic product" means any (A) article intended to be rubbed, poured, sprinkled, or sprayed on, introduced into, or otherwise applied to the human body or any part thereof for cleansing, beautifying, promoting attractiveness, or altering the appearance, or (B) article intended for use as a component of any such article described in subparagraph (A) of this subdivision. "Personal cosmetic product" does not include any product for which a prescription is required for distribution or dispensation, as determined by the Commissioner of Consumer Protection. (b) No person shall import, sell or offer for sale any personal cosmetic product that contains intentionally-added microbeads except any personal cosmetic product that is also regulated as a drug by the United States Food and Drug Administration may be imported, sold or offered for sale until January 1, 2017. (c) The Commissioner of Energy and Environmental Protection, in consultation with the Commissioner of Consumer Protection, may adopt regulations, in accordance with the provisions of chapter 54 of the general statutes, to implement the provisions of this section. (d) Any person who violates the provisions of this section or any regulation adopted pursuant to subsection (c) of this section shall be fined two thousand five hundred dollars for each day during which such violation continues, and for any second or subsequent violation, five thousand dollars for each day during which such violation continues.
