AN ACT CONCERNING BIFURCATED TRIALS FOR NEGLIGENCE ACTIONS.

Be it enacted by the Senate and House of Representatives in General Assembly convened:

That section 52-205 of the general statutes be amended to provide that: (1) A court may order that any negligence action that is to be tried to a jury may be bifurcated; (2) during the first phase of such trial the jury shall make a determination on the issue of negligence; and (3) the second phase of such trial shall address the issue of damages.

Statement of Purpose: 

To establish a bifurcated trial system for negligence actions.
