AN ACT ENSURING CHILD PLACEMENT DECISIONS THAT REFLECT THE BEST INTERESTS OF A CHILD.

Be it enacted by the Senate and House of Representatives in General Assembly convened:

That section 46b-140 of the general statutes be amended to provide the court, after consultation with the Department of Children and Families, may order that a child convicted as delinquent be placed in the care of an appropriate institution or agency, including placement in an out-of-state program or facility if no comparable program or facility is available in the state and such placement is found by the court to be in the best interests of the child.

Statement of Purpose: 

To ensure that a child placement decision reflects the best interests of the child and that an out-of-state placement is not unfairly denied when such placement is in fact the best placement option for the child.
