AN ACT PROHIBITING THE CAPTURE AND USE OF FACIAL RECOGNITION TECHNOLOGY FOR COMMERCIAL PURPOSES.

Be it enacted by the Senate and House of Representatives in General Assembly convened:

Section 1. (NEW) (Effective July 1, 2016) (a) No person may capture a biometric identifier of an individual and use the biometric identifier for a commercial purpose unless the person: (1) Informs the individual before capturing the biometric identifier, and (2) receives the individual's consent to capture the biometric identifier and to use it for a commercial purpose. For the purposes of this section, "biometric identifier" means a record of face geometry, including, but not limited to, an image of an individual's face captured and stored utilizing facial recognition software.

(b) A person who possesses a biometric identifier of an individual that is captured for a commercial purpose in accordance with subsection (a) of this section may disclose the biometric identifier to another person if such disclosure is: (1) Related to a financial transaction that the individual requested or authorized, (2) made pursuant to a law enforcement investigation, or (3) required or permitted by federal or state law.

(c) A violation of the provisions of this section shall be an unfair or deceptive act or practice under subsection (a) of section 42-110b of the general statutes.
