AN ACT CONCERNING FREEDOM OF INFORMATION ACT APPEALS. Be it enacted by the Senate and House of Representatives in General Assembly convened: That section 1-206 of the general statutes be amended to (1) require any person who is not indigent to pay a one hundred twenty-five dollar fee for filing a second or subsequent notice of appeal per calendar year with the Freedom of Information Commission for denial of a right granted under chapter 14 of the general statutes, provided such fee shall be refunded if the appeal is withdrawn prior to a hearing or if such person prevails in his or her appeal, and (2) give the Freedom of Information of Commission the power to (A) require a complainant to participate in mandatory mediation, and (B) dismiss the appeal after notice and an opportunity for a hearing if the complainant refuses to negotiate in good faith to resolve the complaint. Statement of Purpose: To reduce frivolous complaints under the Freedom of Information Act.
