AN ACT REQUIRING NOTICE PRIOR TO PESTICIDE APPLICATIONS BY RAILROAD COMPANIES AND REQUIRING VEGETATION MANAGEMENT PLANS BY SUCH COMPANIES. Be it enacted by the Senate and House of Representatives in General Assembly convened: That the general statutes be amended to require railroad companies to: (1) Provide notice to the chief elected official or board of selectmen of a municipality prior to pesticide or herbicide applications along railroad rights-of-way that pass through such municipality, and (2) file annually, for approval by the Department of Energy and Environmental Protection and each affected municipality, a vegetation management plan that identifies target vegetation and management methods along such rights-of-way. The Department of Energy and Environmental Protection and each such municipality would be authorized to reject such plan after notice and a public hearing. Statement of Purpose: To require notice of pesticide and herbicide applications along railroad rights-of-way and the filing of vegetation management plans with the state and each town along the right-of-way.
