AN ACT PROHIBITING THE USE OF COAL TAR SEALANTS ON STATE AND LOCAL HIGHWAYS.

Be it enacted by the Senate and House of Representatives in General Assembly convened:

Section 1. (NEW) (Effective October 1, 2017) No person shall use or apply any sealant that is made from coal tar to any state or local highway. The Commissioner of Transportation, in conjunction with the Commissioner of Energy and Environmental Protection, may enforce the provisions of this section.

Statement of Purpose: 

To protect the environment and public health by limiting human and wildlife exposure to hazardous materials.
